RE: Admin Review — Sierra Pinyon Amended Final Plat — Lots 8 and 9 (File No.
FPAA-8370)
Dear Mr. Harrah,
This letter is provided to you, as the authorized representative for Garfield County File
FPAA-8370, pertaining to an Amended Plat to adjust the lot lines between the existing
Lot 8 and Lot 9 of the Sierra Pinyon Subdivision. This letter is notification that the Directors
Determination issued on September 16, 2015 and finalized on September 28, 2015 to
amend the final plat of the Sierra Pinyon Subdivision expired on December 28, 2015.
Please see the attached email correspondence from County Staff regarding the
impending expiration and option for extension. Staff understands that Lot 8, previously
owned by Debra Failing, has been sold to a new owner and as a result, the application
will need to be resubmitted with the new owner of Lot 8 as co -applicant with the owner of
Lot 9 (see attached email from Jim Kalmon).
Condition number 3 of the Directors Determination (see attached) finalized on
September 28, 2015 states:
The Applicant has 90 days within which to satisfy conditions of approval and
provide the following documentation for BOCC signature and recordation:
a. A plat mylar with signed Certificates that include Dedication and
Ownership, Title, Taxes, Applicant's Surveyor, Lienholders and any
mortgagees;
b. Recording Fees.
Further, Section 4-101(H)(3) states:
The Applicant has 90 calendar days from the date of approval of an
Exemption or Final Plan/Plat application to submit a Final Plat suitable for
recording. Failure to timely file a Final Plat suitable for recording will result
in the expiration of the Exemption or Final Plat approval, and the Applicant
will be required to submit a new application for the desired Exemption or
Final Plan/Plat.

Hi David,
Thank you for your attention to this matter. This project has stalled because Debra Failing put her property on the
market and it sold before we could work out a resolution with the lien holder. If Tony decides to pursue this, it will have
to be with the new owner and we will have to start the process over.

I sent you the below email last Monday, December 21 regarding the upcoming expiration of the Amended Final Plat
approval for Sierra Pinyon Lots 8 and 9. I did not receive a response from this email. As a result, the approval for this
Amended Final Plat expired yesterday, December 28, 2015. If you would like to request an extension, please contact me
ASAP.

Hi Jim and Tony,
I am reviewing my upcoming deadlines and wanted to get in touch with you regarding the Sierra Pinyon Lots 8 and 9
Amended Final Plat. The deadline to complete the final plat is next Monday, December 28 (90 days from the close of the
call-up period which was September 28). From our previous correspondence, I understand you are working with the
lienholder to obtain their signature. If it looks like you will be needing more time to complete the plat, please send me
an email or a letter by next Monday, December 28 requesting an extension and the amount of time you think you will
need. I need to obtain approval from my supervisor for all extension requests, but generally as long as progress is being
made to complete the process and the requested timeline is reasonable, then extensions are not an issue.
Please let me know what you think.

DIRECTOR DETERMINATION — Sierra Pinyon Lots 8 and 9 Plat Amendment - Amended
Final Plat (File No. FPAA-8370)
Dear Mr. Harrah,
This letter is provided to you, as the authorized representative for Garfield County File
FPAA-8370, pertaining to an Amended Plat to adjust the lot lines between the existing
Lot 8 and Lot 9 of the Sierra Pinyon Subdivision. This letter is notification that your request
to amend the final plat of the Sierra Pinyon Subdivision has been reviewed by the
Community Development Department and the Director hereby issues a determination
conditionally approving the request. The conditions of approval are as follows:
1. That all representations of the Applicant contained in the Application submittals
shall be conditions of approval unless specifically amended or modified by the conditions
contained herein.
2. The Plat shall be subject to final review and approval by County Staff prior to
submittal of the Mylar plat for final execution, BOCC signature and recording (See
Condition #3). All standard plat certificates and signature blocks shall be included on the
final plat. The following amendments shall be made to the Plat:
a. The Lienholder Certificate shall be corrected to be in a form prescribed
by the County;
b. The Surveyor's Certificate shall be corrected to be in a form prescribed
by the County;

c. The Plat shall be black and white only. No color shall be used on the
plat;
d. The Name and Address of the property owners and any identified
mineral owners for each of the parcels shall be identified on the plat;
e. The Book and Page of the recorded Codes, Covenants and Restrictions
shall be noted on the plat;
f. The area of each parcel before and after the amendment shall be
identified on the plat;
g -
The plat note that states "There are no public right-of-ways being
dedicated with this plat" shall be removed;
h. The date of the survey shall be identified in plat note #1;
i. The plat shall be updated to reflect the title commitments for Lots 8 and
9 issued August 13, 2015 and conducted by the Title Company of the
Rockies. The amendments to the plat shall include any new, altered or
removed encumbrances to the properties as well as the addition of a
plat note indicating that the encumbrances represented on the plat are
as identified in the aforementioned title commitments in addition to the
original plat and previous amended plats.
3. The Applicant has 90 days within which to satisfy conditions of approval and
provide the following documentation for BOCC signature and recordation:
a. A plat mylar with signed Certificates that include Dedication and
Ownership, Title, Taxes, Applicant's Surveyor, Lienholders and any
mortgagees;
b. Recording Fees.
Notice of this decision will be provided to the Board of County Commissioners who has
the ability to `call-up' the application for review at a public hearing. You will be notified of
the Board decision once it is received or upon expiration of the 10 day notice period
(August 6, 2015).
