THULSON Re: Colorado Rocky Mountain School Special Use Application — Solar Array Dear Christina and Fred: Please accept this letter supplementing Colorado Rocky Mountain School's ("CRMS") Special Use Permit Application to construct a ground -mounted Solar Power Generating System. As you know, the Planning and Zoning Commission recommended that the Board of County Commissioners consider standards for evaluating such requests at its meeting on November 14, 2007. Based on these proposed criteria, we thought we should supplement the application with information on how CRMS is addressing these specific criteria. We are also providing several images of existing conditions and renderings of the proposed solar array for your use in preparing the Staff Report. A. The Application shall demonstrate how the proposed project will not impact wildlife and domestic animals through the creation of hazardous attractions, alteration of existing native vegetation, blockade of migration routes, use patterns or other disruptions; BALCOMB & GREEN, P.C. The ground -mounted system will be fenced with a "non -climb" style fencing typically used to prevent vandalism and/or damage by livestock or wildlife. The fence will be 5 feet high and will lie within an existing fenced area. Therefore, there should be no interference with wildlife or migration routes, etc. In addition, the existing fence will be relocated so as not to "trap" or contain the existing livestock use. B. The Application shall demonstrate how the proposed project will impact truck and automobile traffic to and from such uses and their impacts to areas in the County; Truck and automobile traffic will not be an issue. The site is designed for power production and no additional automobile or truck traffic will result from the construction of this solar array. C. That sufficient distances shall separate such use from abutting property which might otherwise be damaged by operations of the proposed use(s); A 150 -foot buffer zone has been established for safety, security, aesthetics and potential build -out in the future. D. The Application shall provide a plan for site rehabilitation after the use is terminated; The site is intended to produce power for a minimum of 20 years at which time the solar electric generating facility either continues production or, if dismantled, would be replaced by native grasses. There will be minimal disturbance of the site with the installation of the facility and will not require grading or other large-scale earthmoving. Concrete footers that can be removed once the facility is no longer operational will support the frame. While in use, the site will incorporate native grasses in between the solar arrays upon completion of the installation. The system is expected to operate for 40 years. E. The County Commissioners may in its discretion require security before a permit is issued, if security is deemed necessary. The Applicant shall furnish evidence of a bank commitment of credit, bond, certified check or other security deemed acceptable by the County Commissioners in the amount calculated by the County Commissioners to secure the execution of the site rehabilitation plan in workmanlike manner and in accordance with the specifications and BALCOMB & GREEN, P.C. Such commitments, bonds or check shall be payable to and held by the County Commissioners. CRMS does not believe that a bond is necessary for this project. CRMS has a contract with Aspen Ski Company concerning how the project would be cleaned up and rehabilitated should the project have to be taken out during the 20 -year period that ASC owns the project. CRMS will own the project after that date and if and when it is dismantled 30-40 years from now, would have its own incentive to do the limited site rehabilitation that may be required. F. The Application shall demonstrate that the facility shall be able to comply with the volume of sound standards set forth in the Colorado Revised Statutes. Solar electric systems are silent and this project will not impact the State's sound standards. G. The Application shall demonstrate that the facility shall be operated that the ground vibration inherently and recurrently generated is not perceptible, without instruments, at any point of any boundary line of the property on which the use is located; No vibration exists with these systems. H. The Application shall demonstrate how the proposed facility will be operated so that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard. Again, there no air quality issues. Potential reflectivity issues are addressed in two ways: first, the panels are treated with a non -reflective coating. Second, the panels point towards the sky at an angle of 35 degrees. This means that any residual reflection that might occur will be directed toward the south, upwards and away from immediately adjacent properties. I. Any repair and maintenance activity requiring the use of equipment that will generate noise, odors or glare beyond the property boundaries will be conducted within a building or outdoors during the hours of 8 a.m. to 6 p.m., Mon. -Fri. Generators should not be necessary for any service work. J. Any lighting of the facility shall be pointed downward and inward to the property center and shaded to prevent direct reflection on adjacent property. CRMS will not install any lighting for this facility. But should lighting become necessary, CRMS will comply with the above requirements. K. Such facilities shall not result in any structure exceeding the maximum height limit, setbacks, or lot coverage of the applicable to the zone district in which it is located. All setback and height parameters are incorporated into the system layout and design. These are ground mounted structures and will not exceed height limitations. Mr. Ely and his company, Sunsense, have been chosen as the contractor to install the Solar Electric Power Generating System if the requested Special Use Permit is approved. 2. As stated in Mr. Ely's memorandum, the Solar Electric Power Generating System will require a single water tap. This tap will be made onto existing water lines serving CRMS campus buildings. A copy of the applicable portion of the Garfield County Assessor's neap depicting the CRMS property is included. We have also included a list of the names and addresses of all public and private landowners owning property within 200 feet of the subject property. To our knowledge there are no severed mineral interests of the subject property. 5. A copy of the Deed by which CRMS took title to the subject property is included. 6. A letter from CRMS authorizing me and this firm to submit and prosecute this Application on CRMS's behalf. 7. This letter, which together with the Scott Ely memorandum, is the statement responding to the criteria found in Section 5.03 of the Zoning Resolution. Please note that no utility connections are necessary to provide water and sewer service to the proposed facility except for the water tap described in paragraph 2, above. The proposed use will not generate any additional traffic volume and the limited vehicular access to the site will be from existing roads upon the CRMS campus. If you will be using water or will be treating wastewater in conjunction with the proposed use, please detail the amount of water that would be used and the type of wastewater treatment. If you will be utilizing well water, please attach a copy of the appropriate well permit and any other legal water supply information, including a water allotment contract or an approved water augmentation plan to demonstrate that you have legal and adequate water for the proposed use. 3. Submit a site plan /map drawn to scale that portrays the boundaries of the subject property, all existing and proposed structures on the property, and the County or State roadways within one (1) mile of your property. If you are proposing a new or expanded access onto a County or State roadway, submit a driveway or highway access permit. 4. Submit a viciniy map showing slope / topography of your property, for which a U.S.G.S. 1:24,000 scale quadrangle map will suffice. 5. Submit a copy of the appropriate portion of a Garfield County Assessor's Map showing all the subject property and public and private landowners adjacent to your property (which should be delineated). In addition, submit a list of all property owners, public and private landowners and their addresses adjacent to or within 200 ft. of the site. This information can be obtained from the Assessor's Office. We will also need the names (if applicable) of all mineral right owners of the subject property. (That information can be found in your title policy under Exceptions to Title). 6. Submit a copy of the deed and a legal description of the subject property. 7. If you are acting as an agent for the property owner, you must attach an acknowledgement from the property owner that you may act in his/her behalf. 8. Submit an statement that specifically responds to each of the following criteria from Section 5.03 of the Zoning Regulations: (1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use. (2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use; (3) Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery • • of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character; 9. Depending on the type of Special Use Permit requested, you may need to respond to additional review standards in the Garfield County Zoning Resolution Section 5.00 [Supplementary Regulations]. This may include uses such industrial uses [section 5.03.07 & 5.03.08], Accessory Dwelling Units [section 5.03.21], Utility line/Utility Substations, etc. Specific sections of the Zoning Resolution which can be located on the Garfield County web site at http://www.garfield-county.com/buildinq and planninq/index.htm, or information can be obtained from this office 10. Submit 2 copies of this completed application form and all the required submittal materials to the Building and Planning Department. Staff will request additional copies once the Special Use Permit application has been deemed technically complete. II. PROCEDURAL REQUIREMENTS (The following steps outline how the Special Use Permit Application review process works in Garfield County.) 1. Submit this completed application form, base fee, and all supplemental information to the Garfield County Planning Department. It will be received and given to a Staff Planner who will review the application for technical completeness. 2. Once the application is deemed technically complete, the Staff Planner will send you a letter indicating the application is complete. In addition, Staff will also send you a "Public Notice Form(s)" indicating the time and date of your hearing before the Board of County Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum regarding your requested Special Use. (If Staff determines you application to be deficient, a letter will be sent to you indicating that additional information is needed to deem your application complete.) 3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the requested Special Use and the public hearing. If proper notice has not occurred, the public hearing will not occur. Notice requirements are as follows: a. Notice by publication, including the name of the applicant, description of the subject lot, a description of the proposed special use and nature of the hearing, and the date, time and place for the hearing shall be given once in a newspaper of general circulation in that portion of the County in which the subject property is located at least thirty (30) but not more than sixty (60) days prior to the date of such hearing, and proof of publication shall be presented at hearing by the applicant. b. Notice by mail, containing information as described in the paragraph above, shall be mailed to all owners of record as shown in the County Assessor's Office of lots within two hundred feet (200') of the subject lot and to all owners of mineral interest in the subject property at least thirty (30) but not more than sixty (60) days prior to such hearing time by certified return receipt mail, and receipts shall be presented at the hearing by the applicant. • • c. The site shall be posted such that the notice is clearly and conspicuously visible from a public right-of-way, with notice signs provided by the Planning Department. The posting must take place at least thirty (30) but not more than sixty (60) days prior to the hearing date and is the sole responsibility of the applicant to post the notice, and ensure that it remains posted until and during the date of the hearing. 4. The Applicant is required to appear before the Board of County Commissioners at the time and date of the public hearing at which time the Board will consider the request. In addition, the Applicant shall provide proof, at the hearing, that proper notice was provided. 5. Once the Board makes a decision regarding the Special Use request, Staff will provide the Applicant with a signed resolution memorializing the action taken by the Board. Following the Board's approval, this office will issue the Special Use Permit to the applicant. If the Board's approval includes specific conditions of approval to be met, this office will not issue the Official Special Use Permit certificate until the applicant has satisfied all conditions of approval. Green Last Revised: 02/2006 Attorney for Appl.cant • • TO: Garfield County Commissioners FROM: Scott Ely, Sunsense DATE: August 8, 2007 RE: A.SC/CRMS 154kW Grid -Tied Solar Electric System As you may be aware, the Aspen Skiing Company (ASC) and the Colorado Rocky Mountain School (CRMS) have negotiated a deal whereby ASC will hire a contractor (Sunsense Inc.) to provide turnkey services for the design. and installation of a 150kW (actually 147kW) grid -tied solar electric system on CRMS property in Carbondale. The purpose of this narrative is to supply a detailed description of this system, to the best of our abilities, and to assess it's footprint on the immediate neighborhood and surrounding area. Please understand that this system description is post -installation and that installation has another set of physical parameters and logistical issues. At this point, the system has been fully designed and all parties are ready and anxious to get things underway. We understand the need for a Special Use Permit and we stand ready to answer any and all questions that may arise from this process. The 147kW grid -tied solar electric system (to be referred to as simply the System) is designed to generate solar electricity for use at CRMS and for other Xcel customers down the line. Essentially, this is a solar electric generating station. Once installed, this System will represent the largest solar electric system in Western Colorado (to date). Utility power will be generated rather than consumed. A small electrical service as well as a small water tap will be needed for service and maintenance. The area will be fenced with appropriate signage to discourage theft and vandalism as well promoting safety. No parking will be necessary. Any service work to the system will be done within the fenced area. The System, as designed, will occupy and area of approximately 120 x 240 ft (28,800 sgft or about %Z acre) just to the north of the Jossman Building on the CRMS campus. The attached Vicinity/Site Map indicates the approximate location in relation to the Jossman Building and surroundings. Within this fenced area, Sunsense will install (3) solar electric panel arrays. Each array will consist of (256) solar electric panels. The arrays will mount on a galvanized pipe/aluminum extrusion structure with the galvanized pipe set in concrete piers. On the front end, the arrays will sit approximately 2 ft off the ground and on the back end they will sit approximately 12 ft off of grade (see DP&W Attachment). • • Centered behind each array will be an inverter and disconnect "kiosk" fondly referred to as the Sunny Tower. This is where the DC electrical power is converted to AC electrical power (see Sunny Tower Attachment). From each Sunny Tower, AC electricity is transmitted to an interconnection point located next to the transformer at the Jossman Building. Some ofthis power will be utilized by the Jossman Building and the remaining power.will feed back Into the utility grid. It should be noted that there are minimal, if any, impacts to the adjacent neighborhood. The System location has been defined by a 150 ft. buffer from Delores Way as well as proximity to the transformer. The System will operate during daylight hours (hence the "solar" electric) and will be silent at night. There are no hazardous materials integrated into this design. Some off grid solar electric system utilize batteries, but that is not the case here. Visually, the arrays are basically ground -mounted, elongated rectangles with multiple "blueish" crystalline cells contained in a silver framework (see BP SX3195 Attachment). Regarding community interaction, it should be noted that numerous solar electric systems already exist in Carbondale (see Community Installations Attachment). Solar electric systems have been embraced by the Town and having a large system close to Town is not only tolerable, but encouraged. APPLICANT has submitted to COUNTY an application for Special Use Permit (hereinafter, THE PROJECT). 2. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as amended, establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for the administration of the fee structure. 3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed project, it is not possible at this time to ascertain the full extent of the costs involved in processing the application. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to thereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional payments upon notification by the COUNTY when they are necessary as costs are incurred. 4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of consulting service determined necessary by the Board of County Commissioners for the consideration of an application or additional COUNTY staff time or expense not covered by the Base Fee. If actual recorded costs exceed the initial Base Fee, APPLICANT shall pay additional billings to COUNTY to reimburse the COUNTY for the processing of the PROJECT mentioned above. APPLICANT acknowledges that all billing shall be paid prior to the final consideration by the COUNTY of any land use permit, zoning amendment, or subdivision plan.
