In order to ensure that adequate and uninterrupted service is maintained at all times per their License Agreement with the Federal Communications Commission (FCC) as well as provide the residents, businesses, and traveling public in the area with new and faster voice and data services through the deployment of LTE/4G technology and now AWS. This site remains a critical component to the overall Verizon Wireless network and carries a high volume of call traffic every day making this an important site to receive these technological upgrades and remain in service. Verizon Wireless is seeking approval from Garfield County to upgrade its antennas and accessory equipment at the above referenced existing telecommunications facility. Verizon Wireless is submitting the following Administrative under the FCC ruling of Section 6409 (a). The above referenced telecommunications facility qualifies under 6409 (a) because the facility is existing and all of the requested upgrades to the facility will not substantially change the physical dimensions of the tower or base station. Per Section 6409 (a), Verizon Wireless will be monitoring the shot clock. If there is no response within 60 -days of this submittal, they will deem this project approved. Per the enclosed drawings titled CO3 — New Castle — Zoning Drawings, dated December 21, 2015, Verizon Wireless will be modifying its communication facility in the following way: • Installing additional equipment inside Verizon Wireless' existing leased equipment shelter. This equipment will not be visible from outside the room. • Remove two (2) existing Omni Antennas and replacing them with six (6) new panel antennas. These antennas will utilize new sector frames. In total there will be three (3) new sectors. Over all facility height will not be increasing. • Install three (3) new remote radio heads to a mount behind the antenna mount on monopole. GENERAL DESCRIPTION Pinnacle Consulting, representing Verizon, is seeking a modification to a Special Use Permit issued to GAMBELL, THOMAS R for an existing telecommunications facility. The facility was approved for a telecommunication tower in 1993 and memorialized under Resolution 93-109 (Reception Number 456219). The conditions of approval included Number 8, which states: "Any and all expansion or modification of the facility will require an amendment to the SUP." This SUP was modified in an amended Land Use Change Permit through a Director's Decision issued on February 1, 2013 and allowed for the "installation of two additional omni -whip antennas to the existing tower." Verizon would now like to further modify the telecommunication facility by "Removing 2 Omni antennas and replacing with 6 new antennas, 2 per sector, and add 3 new sector frames. This is a re-sectorization project (Adding a sector). This is adding antennas but the height of the tower will remain the same." II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS An amendment to a previously approved Special Use Permit is reviewed by the County pursuant to Section 4- 106 of the Land Use and Development Code. Page 1 of4 III. REVIEW PROCESS To process a request for an Amendment to an Approved Land Use Change Permit, the applicant shall schedule a pre -application conference. Within 10 days of the conference and after receiving all necessary information, the Director shall make one of the following determinations: a. Minor Modification b. Substantial Modification. c. Determination by the BOCC IV. DETERMINATION In reviewing the information submitted (attached), the Director has determined that the Review Criteria (Section 4-106.C) for determining this proposed amendment to be a Minor Modification, has been met, as follows: 1. Comply with all requirements of this Code; The Amendment continues to meet al! requirements of the Code. 2. Do not conflict with the Comprehensive Plan; The Amendment does not conflict with the County's adopted Comprehensive Plan. 3. Do not change the character of the development; The Amendment does not change the character of the development 4. Do not alter the basic relationship of the development to adjacent property; The Amendment does not change the basic relationship of the development to adjacent properties. 5. Do not change the uses permitted; The Amendment does not change the uses currently permitted. 6. Do not require amendment or abandonment of any easements or rights-of-way; The Amendment does not require abandonment of any easements or rights of way. 7. Do not increase the density; The Amendment does not increase the density of the project. 8. Do not increase the zone district dimensions to an amount exceeding the maximum dimension in the applicable zone district in Table 3-201; and The Amendment does not increase the zone district dimensions to an amount exceeding the maximum dimensions in the Rural Zone District. 9. Do not decrease the amount of the following to an amount below the minimum required in the applicable zone district: a. Amount of dedicated Open Space; b. The size of or change in the locations, lighting, or orientation of originally approved signs; c. Any zone district dimensions in Table 3-201. The Amendment does not decrease any of the previous items to an amount below the minimum required in the Rural zone district. In addition, staff has reviewed these proposed changes in light of the conditions of approval associated with the original SUP and the amended permit and finds that, so long as the colors of the new antenna are consistent with the prescribed paint color and there is no increase in height, staff does not believe this proposed amendment constitutes a substantial change to the approved Special Use Permit. The request is in regard to the approved Telecommunication Tower for the U.S. West New Vector Group on a site located at 319 County Road 138, in Section 35, T5S, R9OW, Parcel No. 2123-351-00-120. The request letter and associated plans are attached to this Director's Determination. As provided, your proposal includes the installation of two additional omni -whip antennas to the existing tower. The antennas will not increase the tower height and will not result in the addition of any new structures on the site. Additional underground cables including fiber optics will be installed and connected to the existing equipment shelter. New equipment will also be installed within the existing equipment shelter but will not be visible from or result in any outside changes to the shelter. The original tower was approved pursuant to a public hearing conducted by the Board of County Commissioners and memorialized in Resolution No. 93-109. The 40 foot tall pole currently has 4 omni/whip antennas at a max height of 51 feet. The proposal is to add two (2) new omni/whip antennas to provide 4G/LTE service from this site. The upgrade includes adding 2 new omni/whip antennas to the tower (going from 4 omni antennas to 6), see attached draft plans. The new antennas will be at a lower height than the existing antennas. I'm concerned since the attached approval resolution has a condition (#8) that states: "Any and all expansion or modification of the facility will require an amendment to the SUP." Does this mean to co -locate these 2 new antennas, we have to go back through the SUP hearing process? Also, according to Fred's 2008 memo regarding co -location, how do you interpret #1 that states "The new installation does not increase the height of the existing facility". Does this refer to raising the height of the tower and any appurtenance like antennas or just raising the support structure height (tower)? If omni/whip antennas are generally mounted above the top of the tower support structure and frequently need to be upgraded, what happens when the newer omni/whip antennas are taller than the existing antennas?
