The following items are required by Garfield County for a final inspection:
1. A final Electrical Inspection from the Colorado State Electrical Inspector;
2. Permanent address assigned by Garfield County Building Department posted where readily
visible from access road;
3. A finished roof, a lockable house, complete exterior siding, exterior doors and windows
installed, a complete kitchen with cabinets, a sink with hot & cold running water, non-absorbent
kitchen floor coverings, counter tops and finished walls, ready for stove and refrigerator, all
necessary plumbing;
4. A complete bathroom, with washbowl, tub or shower, toilet stool, hot and cold running water,
non-absorbent floors and walls finished and a privacy door;
5. All steps outside or inside over three (3) steps must have handrails, guard rails on balconies or
decks over 30" high constructed to all 1997 UBC requirements;
6. Outside grading done to where water will detour away from the building;
7. Exceptions to the outside steps, decks and grading may be made upon the demonstration of
extenuating circumstances, i.e. weather, but a Certificate of Occupancy will not be issued until
all the required items are completed and a final inspection made.
A CERTIFICATE OF OCCUPANCY WILL NOT BE ISSUED UNTIL ALL THE ABOVE

Plans to be included for a Building Permit must be on draft paper at least 18"x 24"" and drawn to
scale.
Plans must include a floor plan, a concrete footing and foundation plan, elevations all sides with
decks, balcony steps, hand rails and guard rails, windows and doors, including the finish grade
line. A section showing in detail, from the bottom of the footing to the top of the roof, including
re -bar, anchor bolts, pressure treated plates, floor joists, wall studs and spacing, insulation,
sheeting, house -rap, (which is required), siding or any approved building material.
A window schedule. A door schedule.
A floor framing plan, a roofing framing plan, roof must be designed to withstand a 40 pound per
square foot. up to 7,000 feet in elevation, an 80 M.P.H. windshear, wind exposure B, windload of
15 pounds per square foot and a 36 inch frost depth.
All sheets to be identified by number and indexed. All of the above requirements must be met or
your plans will be returned.
All plans submitted must be incompliance with the 1997 UBC, UMC and 1997 UPC.
Applicants are required to indicate appropriately and to submit completed checklist at time
of application for a permit:
1. Is a site plan included that identifies the location of the proposed structure, additions or
other buildings, setback easements, and utility easements showing distances to the
property lines from each corner of the proposed structure prepared by a licensed surveyor
and has the surveyors signature and professional stamp on the drawing? Slopes of 40% or
more on properties must be show on site plan.

FACILITIES EASEMENT AGREEMENT

THIS FACILITIES EASEMENT AGREEMENT ("Agreement") is made and entered into as of the 25th day
of April, 2002, by and between Aspen Glen Golf Company, a Colorado limited partnership ('Grantor"),
and AT&T Broadband of Colorado. L L.C., Delaware limited liability company ("Grantee").
Recitals
A. Grantor is the fee owner of certain real property located in the City of Carbondale, Garfield
County, Colorado, as more particularly shown on Exhibit A attached hereto and incorporated
herein by reference (the "Property).
B. Grantee has installed or plans to install underground and/or above -ground communications,
broadband, cable television system or other similar facilities, including, without limitation, lines,
cables, amplifiers and other electronic equipment, as well a building of dimensions not to exceed
14' long x 11' wide x 10' high (the "Facilities"), on a portion of the Property, as more particularly
shown on Exhibit B attached. hereto and incorporated herein by reference (the "Easement Area").
C. Grantee has requested, and Grantor hasagreed to grant and convey to Grantee, apermanent,.
non-exclusive easement over, across, under and through the Easement Area for access to, and
the installation, construction, operation, maintenance, repair, reconstruction, replacement; or
removal of the Facilities, and over and across the Property for pedestrian and vehicular access
and ingress to and egress from the Easement Area.
NOW, THEREFORE, in consideration of the recitals set forth above, the mutual promises
hereinafter set forth, and other good and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged, the parties hereto agree as follows:
Easement
1. Grantor hereby grants and conveys to Grantee a perpetual, non-exclusive easement and right of
way over, across, under, and through the Easement Area, together with a non-exclusive
easement and right of way over, across, under, and through those portions of the Property as are
reasonably necessary for Grantee to access the Facilities and perform such installation,
construction, operation, maintenance; repair, reconstruction, replacement, or removal of the
Facilities, whether by pedestrian or vehicular access.
2. The easement granted herein is for the purpose of allowing Grantee's employees, agents, and
contractors to access. install, construct, operate, maintain, repair, reconstruct, replace or remove
the Facilities, and Grantee shall not use the Easement Area for any other purpose.
3. Grantee shall have access to the Easement Area 24 hours a day, 7 days a week.
4. Certain additional equipment owned by Grantee ("Grantee's Equipment") is going to be installed
and operated from a building located on the Property. Grantee, its employees, agents, and
contractors shall have the right to access, operate, maintain, repair, reconstruct, replace or
remove the Equipment from the building.
5. Reservation of Rlaht to Use. Grantor reserves the right of ownership use, and occupancy of the
Property insofar as said ownership, use, and occupancy does not impair the rights granted to
Grantee in this Agreement. However, Grantor shall not use or occupy the Easement Area or the
Property in any manner that impairs the rights granted to Grantee in this Agreement. Without
limiting the foregoing, it is understood and agreed by Grantor that no building, structure, or other
improvements of any kind may be placed by Grantor on the Easement Area; provided, however,
that Grantor may install asphalt paving and curbing for a bicycle/pedestrian path, cement surface
sidewalks and curbs, sod, and other landscaping, turf irrigation lines, drainage pipe and other
utility lines on the Easement Area and the Property (the "improvements"), so long as the same do
not interfere with the Grantee's use of the Easement Area.
6. Repair of Damage. Grantee shall promptly repair and restore, to the reasonable satisfaction of
Grantor, any damage to the Easement Area, the Property, or the Grantor Improvements caused.

by the exercise of Grantee's rights. granted under this Agreement. All repair and restoration of
damage to the Easement Area caused by Grantor, its agents, or employees shall be the sole
responsibility of Grantor, including all maintenance and repair required to the Grantor
lmprovements.
7. Indemnity. Grantor and Grantee shall indemnify, defend, and hold each other harmless from and
against any and all claims, damages, costs; losses, or expenses arising out of or related to (i) the
use of the Easement Area by the other, its agents, employees, contractors, licensees, and
invitees; (ii) any negligent or willful act or omission of the other; or (iii) the failure of the other to
comply with the terms of this Agreement. Grantor shall indemnify, defend, and hold Grantee
harmless from and against any liability, daims, damages, costs, losses, or expenses arising out
of or related to Grantor's interference with •Grantee's use - and enjoyment of the Easement Area.

Grantor's use and enjoyment of the Property or of the Easement Area, except as permitted
herein..
8. Relinquishment. In the event that Grantee, in its sole discretion, determines that Grantee no
longer needs the Easement Area, Grantee may relinquish the rights granted to it under this
Agreement by quit -claiming Grantee's interest in the Easement Area to Grantor. Upon such
relinquishment, Grantee shall remove all Facilities installed. on the Easement- Area and shall
repair and restore any damage to the Easement Area and the Property caused by such removal.
9. Disputes. Any claim, controversy or dispute, related directly or indirectly to this Agreement, shall
be resolved by arbitration pursuant to the Federal Arbitration Act, 9 U.S.C. §§ 1-15. A single
arbitrator engaged in the practice of law who is knowledgeable about the subject matter of this
Agreement shall conduct the arbitration under the then current rules of the American Arbitration
Association (the "AAA"). The arbitrator shall have authority only to award compensatory
damages and shall not have authority to award punitive damages or other non -compensatory
damages, which claims are hereby waived by the parties. The parties shall share equally the
fees and expenses of the arbitrator. The decision and award of the arbitrator or arbitrators shall
be final and binding, and judgment on the award rendered by the arbitrator may be entered in any
court having jurisdiction thereof. The non -prevailing party shall pay the reasonable costs and
attorneys' fees of the prevailing party, as determined by the arbitrator.
10. Notices. All notices and other communications required or permitted under this Agreement shall
be in writing to the address set forth for such party below and shall be deemed to be effective
when actually received or refused. Either party may by similar notice given hereunder change the
address to which future notices or other communications shall be sent.
11. Consideration. As consideration for the use of the Easement granted herein, Grantee agrees to
provide Grantor video cable accounts to one outlet at each location as set forth below:

Analog Service w/ Basic & Expanded Basic programming tiers.
Fishing Cabin — Coryell Ranch
Analog Service w/ Basic & Expanded Basic programming tiers.

Analog Service w/ Basic & Expanded Basic programming tiers
Digital Service w/ all Digital programming tiers to include all premium channel & Plex tiers,
currently referred to as the "Platinum" Digital package.
Further, Grantee shall provide one remote control and one converter (if necessary to receive the
video cable service) for each location served.
In ail other respects, the relationship between the parties concerning these accounts shall be
govemed in accordance with any applicable subscriber agreement or work order. •

12. Buildinc Specifications. Grantee covenants that (1) the exterior color and finish will conform to
Grantor's requirements; (ii) it will install and maintain landscaping in the Easement Area in
conformance with Grantor's requirements; (iii) it will mitigate any noise generated by, or issuing
from, the Facilities to Grantor's satisfaction
13. Miscellaneous. This Agreement constitutes the entire agreement between Grantor and Grantee
with respect to the subject matter hereof, and there are no oral or other agreements existing
between Grantor and Grantee with respect to the subject matter hereof which are not expressly
set forth in this Agreement. This Agreement may be amended, revised, waived, discharged,
released or terminated only by a written instrument executed by both parties hereto. All of the
provisions of this Agreement shall be binding upon inure to the benefit of Grantor, Grantee and
their respective successors and assigns. The easement granted herein shall run with the land
and burden the Property. This Agreement shall be govemed by the laws of the State of
Colorado. This Agreement may be executed in counterparts, each of which (or any combination.
of which) when signed and delivered by all of the parties shall be deemedan original, but all of
which when taken together shall constitute one agreement.
IN WITNESS WHEREOF, Grantor and Grantee have -executed this Agreement as of the day and year
first written above.
