County of Gar.field State of Colorado Together with a non-exclusive easement ind right-of-way for access and utility pmposes over and across Tract 21 of Antlers Orchard Development in Section 35, Township S South, Range 92 West of the 6tJi P.M. descnbed as follows : Commencing at ColDlty Road 260 to the south and west of the SW1/4NW1/4NE1/4 of Section 35, Township 5 South, Range 92 West of the 611 Principal Meridian (also known as Tract 13, Antlers Orchard, in Section 35, Township 5 South, Range 92 West of the 61h Principal Meridian), at its junction with a certain twenty-five (2S) foot access easement, shown and described on the Final Plat of the Bagley Subdivision Exemption, recorded as Reception No. 584619 of · the Garfield County records (said twenty-five foot utility and access casement also being specifically described in Book 1262 at Page 974, Reception No. 583076 of the Garfield County records); thence along said twenty-five (25) foot access and utility easement to the SE1/4SE1/4NW1/4 of Section JS, Township 5 South,.Range 92 West of the 6th P.M. The maintcnsn~e and repair of the shared roadway and the utilities within the above described non-exclusive casement shall be joint and equal between all parties utilizing said access and utility easement: Upon failure to pay any portion of the joint maintenance and repair responsibilities, any owner(s) may bring an ac tion for reimbursement against any other user, and the prevailing party shall be entitled to reasonable attorney's fees and costs of suit Fu.rthennore, if permanent improv~nnml8 arc= deemed necessary or advisable to the roadway or utilities within the easement, a majority of the users, by written vote, may commit all other owners and users to such permanent improvements.
