PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a)-(d)'as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the under-
signed WILLIAM G. OULD
respectfully petitions the Board of County Commissioners of Garfield County,
Colorado, to exempt by resolution the division of 35 acre tract of
land into 3 tracts of approximately (1-10), (1-10), (1-15) acres each,
more or less, and which tract to be subdivided is more particularly described as
follows: 1st EXEMPTION: That portion of the NE4 of the SE4 of Section 24, lying
northerly and easterly of County Road 119, including approximately 10 acres and the

from the definitions of "subdivision" and "subdivision land" as the terms are used
and defined in C.R.S. (1973) Section 30-28-101 (a) - (d) and the Garfield County
Subdivision Regulations, for the reasons stated below:

We have reviewed the material submitted for the above referenced
application for exemption. The developer proposes to use wells for the
water supply. These wells would intercept ground water which is tributary
to the Roaring Fork River at a point where there is still water available
for appropriation. This office can issue individual domestic well permits
to individual lot purchasers and we recommend approval of the Ould
Exemption.

RESOLUTION NO, 80 -
RESOLUTION CONCERNED WITH THE DENIAL OF SUBDIVISION EXEMPTION REQUEST
BY WILLIAM G. OULD.
WHEREAS, the Board of County Commissioners of Garfield County
has received an application from William G. Ould for subdivision
exemptions relating to tracts of land in NE/4SE/4 of Section 24,
Township 7 South, Range 88 West of the Sixth Principal Meridian; and
WHEREAS, the Board of County Commissioners has carefully considered
the said application together with the recommendation of the Garfield
County Planning Director, and has further viewed the site of the
proposed exemption and has considered the circumstances surrounding
the said subdivision exemption request and the subject property; and
WHEREAS, the Board of County Commissioners has made the following
determinations of fact:
1. That the public highways most nearly serving the subject
property, Garfield County Roads 115 and 119, are incapable of safely
carrying additional traffic which would be generated by the granting
of the requested subdivision exemptions;
2. That the pressure on the County Roads 115 and 119,in their
present condition,generated by additional building sites which would
pose a threat to the safety of travelers on said County Roads may
not, within County funding constraints, be alleviated in a manner
which would lessen the aforementioned hazard and permit the said
roadway to bear the additional traffic generated by divisions such
as those presently before the Board;
3. The applicant has attempted the subdivision of the subject
property through joint and repeated applications for subdivision
exemptions from this Board of County Commissioners, and the division
of the property into separate tracts of more than thirty-five acres, which
actions threaten to create a subdivision of the subject property with
neither public services or safeguards whose provision is the purpose
of the Garfield County Subdivision Regulations and Colorado law relating
to zoning and subdivision control;
4. That the method of disposition adopted by the applicant in
this and previous subdivision exemptions has been adopted for the
purposes of evading the Garfield County Subdivision Regulations and
Colorado law relating to subdivision process, due to the fact that
the proposed divisions are the part of a larger development plan;
5. That the proposed division of land falls within the purposes
of the Garfield County Subdivision Regulations and the statutes of
the State of Colorado relating to the subdivision of land within this
State;
6. That the growth pattern characterized by the proposed divi-
sion of land is of such form and physical shape that governmental
inefficiencies and unnecessary public costs and financial burdens
will inevitably result from the natural requirement that the County
provide extensions of public services and public support facilities

to the divided land, which services and facilities extensions cannot
be accomplished in a planned, ordered, or effective manner;
7. That the subject lands are not suitable for subdivision under
criteria established by the Garfield County Subdivision Regulations
for each and all of the foregoing reasons:
a) That the proposed division of land will not be adequately
served by existing street and roads and presents significant
problems related to the intensive use of land and the provision
of utilities and services;
b) That the proposed division of land is part of an existing
and potential larger land development project.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of the County of Garfield, State of Colorado:
That the requests for exemption from the Garfield County Subdi-
vision Regulations and the subdivision laws of the State of Colorado
by William G. Ould be and hereby are denied.
