BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the under-
signed ,a4) //.�n, /70A,
respectfully petitions the Board of County Commissioners of Garfield County,
Colorado, to exempt by resolution the division of acre tract of
1 - 5 acres, 1 - 11 acres,
land into three tracts of approximately and 1 - 16 acres acres each,
more or less, and which tract to be subdivided is more particularly described as
follows:

from the definitions of "subdivision" and "subdivision land" as the terms are used
and defined in C.R.S. (1973) Section 30-28-101 (a) - (d) and the Garfield County

I, DESMOND D. BERTHOLF, Clerk of the District Court of Garfield County, Colorado,
do hereby certify that the records on file in said Court in the above entitled cause
show as follows, to -wit:
That Alvin W. Ould, a resident of Garfield County, Colorado, died April 4, 1970,
and that on May 18, 1970, the Last Will and Testament of Alvin W. Ould was duly
admitted to probate in the District Court of Garfield County, Colorado, said Last
Will and Testament, so admitted to probate, being in words and figures as follows:
LAST .WILL AND TESTAMENT OF ALVIN W. OULD
I, ALVIN W..OULD, of the County of Garfield and State of Colorado,
being of sound mind and memory, do, by these presents, make, execute,
publish and declare this to be my Last Will and Testament, in the manner
following, to -wit:
FIRST: I hereby expressly revoke any and all prior wills, codicils
and testamentary documents at any time heretofore made by me.
SECOND: I direct that all estate, inheritance, transfer, legacy, or
succession taxes or death duties, both State and Federal, which may be
assessed or imposed with respect to my estate, or any part thereof, where-
soever situate, whether or not passing under my Will, shall be paid out of
my estate as an expense of administration and without apportionment.
THIRD: If he survives me, I give and bequeath to my brother, WILLIAM JAMES
OULD, the sum of Ten Thousand and no/100 ($10,000.00) Dollars, in cash.
FOURTH: If he survives me, I give, devise and bequeath all the rest,
residue and remainder of my property, of every kind and nature and where-
soever situate, including lapsed legacy if any, to my nephew, WILLIAM GEORGE
OULD. If the said WILLIAM GEORGE OULD shall not survive me, or if there is
no sufficient evidence that he and I have died otherwise than simultaneously,
then 1 give, devise and bequeath all said rest, residue and remainder of my
property, of every kind and nature and wheresoever situate, including lapsed
legacy if any, to my heirs at law.
FIFTH: I appoint my said nephew, WILLIAM GEORGE OULD, as Executor under
this Will. I direct that my said Executor shall not be obliged to give
security for the discharge of the duties of such office.
IN WITNESS WHEREOF, I have hereunto set my hand and seal this 9 day of
December, A.D. 1968.

by the said ALVIN W. OULD, signed, sealed, published as, and declared to
be the Last Will and Testament of the said ALVIN W. OULD, in the presence

at the time of the execution of this instrument the said testator, ALVIN W.
OULD, according to our best knowledge and belief, was of sound mind and

Re: Mednick and Ould Exemptions
We have reviewed the material submitted for the above referenced
applications for exemption. The developers propose to use wells for
the water supply which would intercept ground water tributary to the
Roaring Fork River at a point where there is still water available
for appropriation. This office can issue individual domestic well
permits to individual lot purchasers, and we recommend approval of
these exemption proposals.

I, DESMOND D. BERTHOLF, Clerk of the District Court of Garfield County, Colorado,
do hereby certify that
the records on file in said Court in the above entitled cause
show as follows, to -wit:
That Alvin W. Ould, a resident of Garfield County, Colorado, died April 4, 1970,
and that
admitted
Will -and
on May 18,
to probate
Testament,
1970, the Last Will and Testament of Alvin W. Ould was duly
in the District Court of Garfield County, Colorado, said Last
so admitted to probate, being in words and figures as follows:
LAST.WILL AND TESTAMENT OF ALVIN W. OULD
I, ALVIN W..OULD, of the County of Garfield and State of Colorado,
being of sound mind and memory, do, by these presents, make, execute,
publish and declare this to be my Last Will and Testament, in the manner
following, to -wit:
FIRST: I hereby expressly revoke any and all prior wills, codicils
and testamentary documents at any time heretofore made by me.
SECOND: I direct that all estate, inheritance, transfer, legacy, or
succession taxes or death duties, both State and Federal, which may be
assessed or imposed with respect to my estate, or any part thereof, where-
soever situate, whether or not passing under my Will, shall be paid out of
my estate as an expense of administration and without apportionment.
THIRD: If he survives me, I give and bequeath to my brother, WILLIAM JAMES
OULD, the sum of Ten Thousand and no/100 ($10,000.00) Dollars, in cash.
FOURTH: If he survives me, I give, devise and bequeath all the rest,
residue and remainder of my property, of every kind and nature and where-
soever situate, including lapsed legacy if any, to my nephew, WILLIAM GEORGE
OULD. If the said WILLIAM GEORGE OULD shall not survive me, or if there is
no sufficient evidence that he and I have died otherwise than simultaneously,
then I give, devise and bequeath all said rest, residue and remainder of my
property, of every kind and nature and wheresoever situate, including lapsed
legacy if any, to my heirs at law.
FIFTH: I appoint my said nephew, WILLIAM GEORGE OULD, as Executor under
this Will. I direct that my said Executor shall not be obliged to give
security for the discharge of the duties of such office.
IN WITNESS WHEREOF, I have hereunto set my hand and seal this 9 day of
December, A.D. 1968.

The foregoing instrument was, on the 9th day of December, A.D. 1968,
by the said ALVIN W. OULD, signed, sealed, published as, and declared to
be the Last Will and Testament of the said ALVIN W. OULD, in the presence
of us, who, at his request and in his presence, and in the presence of each
other, have subscribed our names as witnesses thereto; and we declare that
at the time of the execution of this instrument the said testator, ALVIN W.
OULD, according to our best knowledge and belief, was of sound mind and
memory and under no constraint.

That in the Order admitting said Will to probate, the Court found: That
service of notice of hearing was complete; that sufficient testimony, proofs and
evidence had been presented; that tie said Will was executed, declared and attested
as provided by law as said decedent's Last Will and Testament; that the testator
was of sound mind and memory at the time the said Will was executed, declared and
attested; and that no fraud, compulsion or other improper conduct had been exhibited.
That the said William George Ould qualified as Executor and was duly appointed
as such. That Letters Testamentary duly issued to the said William George Ould on
May 18, 1970; and that such remained in full force and effect until said Executor
was discharged on April 23, 1971; that said Estate has been fully administered; that
all claims filed in said Estate have been approved and paid in full; that after due.
and proper notice of hearing thereon, a Decree of Final Settlement was duly entered
in said Estate; that distribution of all personal property as required by said
Decree of Final Settlement has been made; and that said Executor has been discharged.
