The following items are required by Garfield County for a final inspection:
1. A final Electrical Inspection from the Colorado State Electrical Inspector;
2. Permanent address assigned by Garfield County Building Department posted where readily
visible from access road;
3_ A finished roof, a lockable house, complete exterior siding, exterior doors and windows
installed, a complete kitchen with cabinets, a sink with hot & cold running water, non-absorbent
kitchen floor coverings, counter tops and finished walls, ready for stove and refrigerator, alt
necessary plumbing;
4. A complete bathroom, with washbowl, tub or shower, toilet stool, hot and cold running water,
non-absorbent floors and walls finished and a privacy door;
5. All steps outside or inside over three (3) steps must have handrails, guard rails on balconies or
decks over 3O" high constructed to all 1994 UBC requirements;
6. Outside grading done to where water will detour away from the building;
7. Exceptions to the outside steps, decks and grading may be made upon the demonstration of
extenuating circumstances, i.e. weather, but a Certificate of Occupancy will not be issued until
all the required items are completed and a final inspection made.

Plans to be included for a Building Permit, must be on drafting paper at least 18"x24" and drawn to
scale.
Plans must include a floor_plan, a concrete footing and foundation plan, elevations all sides with
decks, balcony, steps, hand rails and guard rails, windows and doors, including the finish grade line_ A
section showing in detail, from the bottom of the footing to the top of the roof, including re -bar,
anchor bolts, pressure treated plates, floor joists, wall studs and spacing, insulation, sheating, house -
rap, (which is required), siding or any approved building material.
A window schedule. A door schedule.
A floor framing plan, a roof framing plan, roof must be designed to withstand a 40# per ft. up to
7,000 F.O.S. and an 80 M.P.H. wind.
All sheets to be identified by number and indexed. All ofthe above requirements must be met or your

Dear Mr. Bean!
This letter is to follow up a conversation you had with my associate, Chris Geiger, at your
office on May 23, 2001. The topic of conversation was a building permit application filed by our
client, Rio Blanco Ranch (the "Ranch"). The Ranch operates as a resort under the authority of
a Garfield County special use permit granted by County Resolution 92-018. When the Ranch
applied for the special use permit, it was operating as a non -conforming use. County Resolution
92-018 brought the Ranch into conformity with Garfield County regulations.
When the Ranch obtained the special use permit, it was operating ten (10) guest cabins
with bed space for forty-six (46) guests. Garfield County Zoning Resolution, Section 2.02.448,
limits a resort to twelve (12) dwelling units and a visitor capacity of forty-eight (48). Consistent
with this regulation, the Garfield County Commissioners granted the Ranch the right to expand
its resort facilities by adding either two (2) more guest cabins and/or two (2) more bed spaces.
One of the ten (10) existing cabins on the Ranch had attained an age that made its
continued maintenance infeasible. The Ranch has applied for a building permit to replace this
structure with a new building which will meet the County's current safety regulations. Chris
informs me that your office will not grant this permit without assurance that the new structure
will maintain the historic size of the old structure. We are not aware of any authority which
allows the County to condition the approval of the building permit on the representation sought
here. Any authority for such a condition would have to be contained in either the Garfield
County Zoning Resolution of 1978 (the "Resolution") or the Ranch's special use permit.
The property in question is zoned A/R/RD. The submitted application, in connection with

the special use permit, is in conformity with the requirements detailed in the Resolution at
Section 3.02. Resolution Section 5 does not impose any additional requirements for resort uses.
The application also meets the requirements and limitations of the Ranch's special use
permit. Resolution Section 5.03.10 states that the County Commissioners "may impose
additional restrictions on the lot area, floor area, coverage" of a proposed use as a condition of
granting the special use. We think the meaning of the regulation is clear: conditions in special
use permits are not implied, but must be set forth explicitly by the Commissioners. There are
no conditions in the Ranch's special use permit that set size restrictions on any of the various
structures on the property. There is a catch-all phrase included in the permit that "proposals of
the applicant shall be considered conditions of approval." Upon reviewing the special use
application, it is clear that this paragraph refers to improvements that the Ranch specifically
proposed to make to its waste disposal and sanitary water systems . The special use application
contains no other proposals and, specifically, no representation or reference to the size of any
of the structures on the property.
There are, on the other hand, provisions in the special use permit that explicitly allow the
Ranch to expand the number of cabins by two (2) and/or increase its visitor capacity by two (2).
The permit allows this to be accomplished either by adding new structures or increasing the
number of bed spaces in existing structures. These allowances are the only limits on expansion
of the Ranch contained within the special use resolution. The proposed replacement cabin is
within these limits as it only maintains, and does not increase, the number of cabins and visitor
capacity.
Based on our understanding of the situation, Rio Blanco Ranch should not have to make
representations as to the size of the replacement cabin as a condition of obtaining a building
permit. If you concur with this position, please call so that we may instruct the Ranch to
proceed. Otherwise, please provide us with any facts or authority that we should be aware of
in assisting the Ranch in this situation. Thank you for your attention to this matter.

The unanticipated level of the ground water table has affected a foundation design change on
the Johnson cabin at the Rio Blanco Ranch. In order to avoid the ground water, the contractor
has suggested, and we have agreed, to raise the elevation of the footer by 12". In addition, the
height of the footer stem wall has been decreased by 12". The grade surrounding the cabin
will be raised by 12" to ensure adequate footer frost protection.
The contractor has elected to widen the footer from the specified width of 16" to a constructed
width of 18". This modification is acceptable.
