The primary reason for our request is the location of the proposed pipeline in relation to our water well. EnCana's Vicinity Map indicates "centerline of pipeline". It is difficult to determine how far the "centerline" is from our fence line. It is our understanding from EnCana's proposal the construction right-of-way width (ROW) will be 65 feet. It appears from EnCana's Vicinity Map and the survey stakes we have looked at if the ROW is 65 feet, their proposed right-of-way crosses onto our property, Our water well is located within our "well and utility easement" as indicated on the ILC. We are very concerned of the possibility of contamination to our water well. The proposed location by EnCana runs the entire length of our property/fence line. The area marked PI: 71+53.76 is located on top of a hill/knoll. The route to the hill/knoll gradually rises in elevation from PI: 65+76.59. Our water well is basically downhill from the hill/knoll. If there is a leak or break in the pipeline we believe the contents of the pipeline would run "downhill". As you can see from the enclosed Well Permit, Pump Installation and related documents, the static level for our well is at approximately 75 feet. Our well is at a depth of approximately 161 feet. According to the Geological Log column (line 5) on the Well Construction and Test Report there is Wasatch Formation at 35 — 161 feet. It is our understanding this is a type of rock formation with crevices, cracks, etc. If the pipeline forms a leak or breaks and the contents "run downhill" and seep into the Wasatch Formation we believe there is a possibility our water well would be contaminated. The power pole located in approximately the same location as PI: 71+53.76, has a transformer. Holy Cross had to blast through rock to place that power pole. It is our understanding the hill/knoll is primarily rock. How will EnCana put their pipeline through this hill/knoll? We have indicated 2 proposed routes for your consideration on the Vicinity Map enclosed. Proposal "A" indicates a route beginning at PI: 62+94.95 and running directly North and to the East of the hill/knoll, then running NW to the proposed location by EnCana, We believe this would be far enough to the East from our water well and be on a more level terrain. Proposal °B" indicates a route just West of County Road 319 and following an existing fence line. This route is still on the same parcel as EnCana's route. We do not know if EnCana needs to reapply or what they will be required to do to change their proposed location or how they would be inconvenienced. We would ask the County to please consider our proposed locations or another location a safe distance from our water well and on more level ground to avoid possible contamination of our water well. This is an important decision due to the fact that once the pipeline and right-of- way are established, future pipelines could be placed in the same right-of-way and this would increase the risk to our water well. We request the location of EnCana's proposed pipeline be moved to a different location. The following are my comments: 1. All comments from the fire district review recently conducted on the PDPA 6578- East Dry hollow pipeline Loop- phase 1 addition apply where applicable ( attached). Note: All issues have been adequately addressed and future submittals by EnCana should reflect these. Documents needed for this project are: a. Maps- Since this is a specific project, location of assembly points, emergency response staging areas, water supplies and normal routes of fire department vehicle access should be preplanned along the 3.9 mile route as much as possible. b. Narrative -Section 4.7- Explosives- if explosives are used a blasting permit maybe required from Rifle Fire. More information is needed. c. Our engineer has provided some more insight below: EnCana's design of pipelines is even more conservative for water service than for gas service. The water pipelines are designed to be converted to gas service to minimize future disturbance and the inconvenience of construction. For instance, the proposed waterline designated in the GarCo Hunter Mesa to Pumba Pipeline Development Plan is a 12", 0.312" wall thickness, pipeline with a Specified Minimum Yield Strength of 52,000 psig (X-52). Comparisons of Water and Gas Service: - Maximum Allowable Operating Pressure; Water = 2545 psig; Gas = 1527 psig (potentially, actual MAOP for gas would be 1480 psig) - Normal Operating Pressure; Water = 800 psig; Gas = 1000 psig Hoop Stress as a % of SMYS at Normal Operating Pressure; Water = 31%; Gas = 39% psig Other advantages of Pipeline used for water service: - Water pipeline has an internal high density polyethylene (HDPE) liner to prevent internal corrosion and to increase life span of pipe thus eliminating the need for replacement. -External corrosion is not a concern because the pipeline liner adds strength to the pipe.* *The liner manufacturer, a Durango, Colorado company doing business all over the world, has completed exhaustive testing of their liner. One test was to determine the deformation of the liner at 1" diameter holes, 1/2" diameter holes, and at slots cut into the pipe with an area of 1/2" x 6" and pressure tested over 4 hours at 900-1000 psig at the request of a pipeline operator. This application was not to prevent corrosion but to add strength to an existing pipeline. There was minor deformation and the pipe did not burst. Test results are available upon request pending consent from the manufacturer. Encana uses the liner for corrosion prevention. We hope this helps to clarify the concerns. Thank you! I explained to Joe that the pipeline does not cross Keith's property and our Construction Coordinator (Bob Anderson) confirmed that we would not be encroaching on his property. Joe directed Keith to contact me. Keith and I spoke over the phone and we set up a conference call. On Oct. 4, 2010, Bob Anderson, Joe Haney and I had a phone conference with Keith. Bob informed Keith of the standards and protocol in which our pipelines are constructed. Bob informed him of the mandatory 1 -call process. Advised him of the depth of our line, the grade and wall thickness, the fact that the pipes are lined and pressure tested, of safety valves and safety construction measures we would have in place, etc. We informed him that enough precautions are put into place that contamination of his water well would be very unlikely. Keith seemed satisfied when asked if we had addressed his concerns and he was appreciative of our time and the conversation ended on a good note. I also advised in the Modified Information, submitted on 10/19/10, that none of the buildings would be impacted by the construction of the pipeline. Below is some helpful information which our engineer has provided: Encana uses 'best management practices"(BMP) for sustainable operation of pipelines. in this case, we are building the natural gas pipeline in accordance with ASME 831.8, "Gas Transmission and Distribution Piping Systems" and CFR 49 Part 192, "Transportation of Natural Gas and Other Gas by Pipeline: Minimum Federal Safety Standards." This pipeline is a gathering pipeline. Also, we use only pipe and materials that are manufactured under the latest versions of industry, recognized specifications and standards. This pipeline could operate at the acceptable maximum operating pressure (MAOP) of 1890 psig (72% Hoop Stress as a percent of Specified Minimum Yield Strength for 20" pipe having a wall thickness of 0.375" and Specified Minimum Yield Strength of 70,000 psig) and deem the pipeline route a Class 1 location. A Location Class 1 is any 1 -mile section that has 10 or fewer buildings intended for human occupancy (ASME 831.8). However, Encana has taken a more conservative design approach and considers this pipeline a Class 2 location with an MAOP of 1480 psig. A Location Class 2 is any 1 -mile section that has more than 10 but fewer than 46 buildings intended for human occupancy (ASME 831.8). For day to day operations, Encana intends to operate this pipeline at approximately 1000 psig or approximately 38% of SMYS. This translates into a theoretical corrosion allowance for pipe wail thickness of 0.198" or more than 3/16". This is the difference in wall thickness of an MAOP of 1890 psig & 1000 psig. Encana is committed to sustainable development of natural gas. We have an aggressive integrity Management Program that collects data from pipelines to determine if there is any compromise to the integrity of the pipelines caused by corrosion. If there is any pipe wall loss due to corrosion, steps are taken to reduce or eliminate any risk to the public or the environment. Some of these steps taken are, but not limited to, installing internal liners in the pipe; replacing the pipe; and reducing the pressure in the pipe to a safe level. In summary, Encana goes far beyond the minimum acceptable industry practices for installing pipelines and facilities. We mitigate all risks to an acceptable level or the facility is not built. Because of the scale of the map it is difficult to tell if the new pipeline is on Wallace property or not. Regardless, it seems Wallace should be on the list of property owners within 200 ft of project. Please clarify. The pipeline is not on Wallace Revised Plan and Profile shows Wallace as a property owner within 200 (eel of the project, as well as the other property owners within 200 feet; those property owner boxes are outlined in red. There are only 3 landowners listed under Attachment 2; Shaeffer Limited, Benxel and the Bureau of Land Management (BLM). The Memorandum of Surface Use Agreement 1 (which is not acceptable for our review) lists 5 different land owners and legal descriptions; however, the document appears to be signed by only 3 of those owners. The 2005 Surface Use Agreement (SUA) also lists 5 separate land owners and includes their signatures but does not include the BLM. Our domestic water well, pump house, water line, telephone line, and power poles are all located within our "utility easement". The proposed pipeline location according to EnCana's vicinity map is within a couple feet of our "utility easement". The proposed pipeline location runs the entire length of our "utility easement" next to our fence. We have enclosed a copy of the documents sent to us from EnCana and the plat of our property showing our domestic water well location and utility easement. Our domestic water well sits at a very low geographical point as compared to the route of the proposed pipeline. If there is a leak/break we believe the contents of the pipes would flow downhill. Our concern is possible contamination of our domestic water well. The proposed pipeline will be carrying natural gas and EnCana is also proposing a water line in the same pipeline ditch. (It is not clear if this "water" will be fresh water or "contaminated" water). We are very concerned over possible soil contamination and/or aquifer contamination if either of these proposed lines form a leak or a break in the line. We are also concerned if in the future we need to drill a new domestic water well. It is our understanding from the current Water Well Construction rules that "a well shall not be located closer than 100 feet horizontally to the nearest source of contaminants or 50 feet from a septic tank, sewer line or other vessel containing contaminants". Is the pipeline/waterline considered "other vessel containing contaminants"? Will the pipeline prevent us from drilling a new water well in the future if needed? We would request the proposed pipeline be located a safe distance to the east of our property line and domestic water well to prevent contamination if a break or leak occurs in the pipeline. (EnCan) is proposing the installation of new pipelines; one (1) up to 24 -inch diameter, buried steel, high pressure natural gas discharge pipeline, a one (1) 12 - inch or less in diameter, buried steel, water line, along with the addition of two natural gas - driven compressor nits (3616 and 3612) at the existing Hunter Mesa Compressor Station (HMCS). This expansion project, consisting of the pipelines and additional compressor units, involves construction, operation, and maintenance of these new facilities. The pipelines will be approximately 21,054 feet (3.9 miles) in length. The route crosses 8,460 feet on Bureau of Land Management (BLM) surface lands and 12,712 feet on fee surface lands. Project maps arc included in Attachment 1. 1.2 PURPOSE AND NEED The purpose of the discharge line and additional compressor units is to increase the throughput capacity of the HMCS. The discharge pipeline will transport natural gas from the existing HMCS to the 24 -inch trunkiine just downstream of the existing Pumba Compressor Station for delivery of Mamma Creek field gas to a third party pipeline company at C:antes Itifle Booster .Compressor Station. The. current 12 -inch high pressure discharge pipeline -and existing Four compressors units cannot move the additional anticipated volumes. EnCana's drilling activity is expected. to increase in tlti s area over the next two to three years and- 3'i partympanies :want. to take advantage of EnCan&s existing infrastructure and deliver gas into our system. This activity will result in greater gas volumes (an additional 65 to 80 MMscfd rate) through these facilities. The water pipeline is needed for drilling activity and transporting water by pipeline and will significantly decrease road traffic in the area. 1.3 LOCATION The pipelines will start at EnCana's HMCS (Section 1, Township 7. South,.Range 93 West) and end near the outlet of Purnba Compressor Station (NW1/4 NE 114 Section 10, Township 7 South, Range 93 West). The pipelines and related project facilities will be located in Garfield County, Coinrado. 1.4 FACILITIES 1.4.1 Pro leet Design The proposed gas pipeline portion oldie project is approximately 3.9 miles in length of up to 24 - inch diameter steel pipe. The pipeline is designed to a Maximum Allowable Operating Pressure (MAOP) of 1480 psig (56% of SMYS) to ANSI B31.8 standards with a Class 2 Location (0.6 safety design factor). The pipeline will be constructed using X-60 grade pipe, 0.438 inch wall thickness (nr equivalent grade and wall thickness to establish an MAOP of at least 1480 psig), and ANSI 600 rated flanges. The pipeline will require above -ground appurtenances (block valves, meters, pig launchers and receivers) at both ends of the pipeline. Additional above ground appurtenances will be required to connect this pipeline to the existing 24 -inch pipeline near the Pumba Compressor Station. The pipeline will be buried at !east 48 inches in depth. EnCana will design and construct the pipeline and related facilities in conformance with the requirements of Title 49, CFR Part 192, "Regulations for the Transportation of Natural Gas and Other Uas by Pipeline: Minimum Federal Safety Standard". The proposed water pipeline will be constructed in the same manner as the natural gas pipeline in the event that it may be converted to natural gas service in the future. It will most likely be a 12 - inch diameter pipeline and be designed to a Maximum Allowable Operating Pressure (MAO?) of 1480 psig (58% of SMYS) to ANSI B31.8 standards with a Class 2 Location (0.6 safety design factor). The pipeline will be constructed using X-52 grade pipe, 0.312 inch wail thickness (or equivalent grade and wall thickness to establish an MAOF"ofat least 1480 psig), and ANSI 600 rated flanges. The additional reciprocating statural gas compressors and drivers including accessories shall be designed, constructed, and tested in accordance with the applicable seetivrrs of the latest editions of the following codes and standards: • ASME Boiler and Pressure Vessel Code Section VIII, Dtvisiorr 1. • API 618 Reciprocating Compressors for General Refinery. COC74637 and COC74637-01 Natural Gas Pipeline & Produced Water Pipeline Refer to Statutory Categorical Exclusion DUI-BLM-CO-N040-2010-0079-SCX Lease Stipulations: Federal lease C0054737 has the following stipulations: a Controlled Surface Use to protect fragile soils with performance requirements and a Timing Limitation to protect big game winter habitats from 12/1 through 4/30 with exception language for the last 60 days. 1. Administrative Notification. The operator shall notify the BLM representative at least 48 hours prior to initiation of construction. If requested by the BLM representative, the operator shall schedule a pre - construction meeting, including key operator and contractor personnel, to ensure that any unresolved issues are fully addressed prior to initiation of surface -disturbing activities or placement ofproduction facilities. 2. Application of GAP COAs_ Standard Conditions of Approval outlined in Appendix C of the Grass Mesa Geographic Area Plan will apply and remain in full force and effect. 3. Facility Paint Color. The paint color to be used on all surface facilities including pipeline risers and metal containment rings surrounding the launchers or receivers shall be Shadow Gray. 4. Dust Abatement. The operator shall implement dust abatement measures as needed to prevent fugitive dust from vehicular traffic, equipment operations, or wind events. The BLM may direct the operator to change the level and type of treatment (watering or application of various dust agents, surfactants, and road surfacing material) if dust abatement measures are observed to be insufficient to prevent fugitive dust. 5. Saturated Soil Conditions. When saturated soil conditions exist 011 or along die proposed right-of-way, construction shall be halted until soil material dries out or is frozen sufficiently for construction to proceed without undue damage and erosion to soils. 6. Construction Right -of -Way Width. The disturbance width within the proposed pipeline corridor shall not exceed the authorized right-of-way width of 75 feet. Limits of disturbance shall be staked on the ground prior to beginning of associated construction work. No surface disturbance beyond the flagged or staked working Iimits of the project area is authorized 7. Holder of this right-of-way agrees to indemnify the United States against any liability arising from the release of any hazardous substance or hazardous waste (as these terms are defined in the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, 42 U.S.C. 9601, et an. or the Resource Conservation and Recovery Act, 42 U.S.C. 6901, et seq.) on this RIGHT-OF- WAY (unless the release or threatened release is wholly unrelated to Holder's activity in this RIGHT- OF-WAY). This agreement applies without regard to whether a release is caused by the Holder, their agent, or unrelated third parties. Holder(s) shall comply with all applicable Federal laws and regulations existing or hereafter enacted or promulgated. In any event, Holder(s) shall comply with the Toxic Substances Control Act of 1976, as amended (15 U.S.C. 2601, et .) with regard in any toxic substances that are used, generated by, or stored on the right-of-way or on facilities authorized under this right-of-way grant. (See 40 CFR, Part EnCana /C0C74637Gas Pipeliiae/C0C74637-01 Water Pipeline/CO-N040-2010-0079-CX/09-2010 7 702-799 and especially, provisions on polycholrinated biphenyls, 40 CFR 761.1-761.193.) Additionally, any release of toxic substances (leaks, spills, etc.) in excess attic reportable quantity established by 40 CFR, Part 117 shall be repotted as required by the Comprehensive Environmental Response, Compensation and Liability Act of 1980, Section 102h. A copy of any report required or requested by any Federal agency or State government as a result of a reportable release of spill of any toxic substances shall be furnished to the BLM concurrent with the filing of the reports to the involved Federal agency or State government. 9. Pipeline Installation. The pipeline shall be installed to industry and BLM "Gold Book" standards. The buried pipeline(s) shall he covered with at least 4 feet of ground material. The centerline of the ROW and the exterior limits shalt be clearly flagged prior to any construction activity. A 10 - inch diameter ilex -steel water line shall be installed into the buried trench prior to covering with soil and reclaiming unless otherwise approved by the Authorized Officer. 10. Reclamation, The goals, objectives, timelines, treasures, and monitoring methods for final reclamation of oil and gas disturbances are described in Appendix I (Surface Reclamation) of the 1998 Draft Supplemental EIS (DSEIS). Specific measures to follow during interim and temporary (pre - interim) reclamation are described below_ a. Reclamation Plans. In areas that have low reclamation potential or are especially challenging to restore, reclamation plans will be required prior to APD approval. The plan shall contain the following components: detailed reclamation plats, which include contours and indicate irregular rather than smooth contours as appropriate for visual and ecological benefit; timeline for drilling completion, interim reclamation earthwork, and seeding; soil test results and/or a soil profile description; amendments to be used; soil treatment techniques such as roughening, pocking, and terracing; erosion control techniques such as hydromulch, blankets/matting, and wattles; and visual anitigations if in a sensitive VRM area. b. Deadline for Interim Reclamation Earthwork and Seeding. Interim reclamation to reduce a well pad to the maximum size needed for production, including earthwork and seeding of the interim reclaimed areas, shall be completed within 6 months following completion of the Iast well planned for the pad. Reclamation, including seeding, of temporarily disturbed areas along roads, pipelines, and topsoil piles and berms, shall be currrpleted within 30 days following completion of construct ion. If requested by the project lead NRS for a specific pad or group of pads, the operator shall contact the NRS by telephone or email approximately 72 hours before reclamation and reseeding begin. This will allow the NRS to schedule a pre -reclamation field visit if needed to ensure that all parties are in agreement and provide time for adjustments to the plan before work is initiated. The deadlines for seeding described above arc subject to extension upon approval of the BLM based on season, timing limitations, or other constraints on a case-by-case basis. If the ALM approves an extension for seeding, the operator may be required to stabilize the reclaimed surfaces using hydromulch, erosion matting, or other method until seeding is implemented. c. Topsoil Stripping. Storage, and Replacement. All topsoil shall be stripped following removal of vegetation during construction of well pads, pipelines, roads, or other surface facilities. In areas of thin soil, a minimum of the upper 6 inches of sirrficial material shall be stripped. The stripped topsoil shall be stored separately from subsoil or other excavated material and replaced prior to final seedbed preparation. Seedbed Preparation. For cut -and -fill slopes, initial seedbed preparation shall consist of backfilling and recontouring to achieve the configuration specified in the reclarnation plan. For compacted areas, initial seedbed preparation shall include ripping to a minimum. depth of 18 inches, with a maximum furrow spacing of 2 feet. Where practicable, ripping shall be conducted in two passes at perpendicular directions. Following final contouring, the backiilled or ripped surfaces shall be covered evenly with topsoil. Final seedbed preparation shall consist of scarifying (raking or harrowing) the spread topsoil prior to seeding. If more than one seaso13 has elapsed between final seedbed preparation and seeding, and if the area is to be broadcast -seeded or hydroseeded, this step shall be repeated no more than 1 day prior to seeding to break up any crust that has formed. Seedbed preparation is not required for topsoil storage piles or other areas of temporary seeding. Requests for use of soil amendments, including basic product information, steal l be submitted to the BLM for approval, e. Seed Mixes. A seed mix consistent with BLM standards in terms of species and seeding rate for the specific habitat type shall be used on all BLM lands affected by the project (see Attachments I and 2 of the letter provided to operators dated May 1, 2008). Note that temporary seeding no longer allows the use of sterile hybrid non-native species. For private surfaces, the menu -based seed mixes are recommended, but the surface landowner has ultimate authority over the seed mix to be used in reclamation. The seed shall contain no noxious, prohibited, or restricted weed seeds and shall contain nn more than 0.5 percent by weight of other weed seeds. Seed may contain up to 2.0 percent of `other crop„ seed by weight, including the seed of other agronomic cops and native plants; however, a lower percentage of ether crop seed is recommended. Seed tags or other official documentation shall be submitted to BLM at least 14 days before the date of proposed seeding tot acceptance. Seed that does not meet the above criteria shall not be applied to public lands. f. Seeding Procedures. Seeding shall be conducted no more than 24 hours following completion of final seedbed preparation. g. Where practicable, seed shall be installed by drill -seeding to a depth of 0.25 to 0.5 inch. Where drill -seeding is impracticable, seed may be installed by broadcast -seeding at twice the drill -seeding rate, followed by raking or harrowing to provide 0.25 to 0.5 inch of soil cover or by hydroseeding and hydrontulching. Hydroseeding and hydromulching shall be conducted in two separate applications to ensure adequate contact of seeds with the soil. If interim revegetation is unsuccessful, the operator shall implement subsequent reseedings until interim reclamation standards are rnet. Muleh. Mulch shall be applied within 24 hours following completion of seeding. Mulch may consist of either hydromulch or of certified weed -free straw or certified weed -free native grass hay crimped into the soil. Erosion Control. Cut -and -fill slopes shall be protected against erosion with the use of water bars, lateral furrows, or other measures approved by the BIM. Cut -and -fill slopes along drainages or in areas with high erosion potential shall also be protected from erosion using hydrornulch designed specifically for erosion control or biodegradable blankets/matting, hales, or wattles of weed -free straw or weed -free native grass hay. A well -anchored fabric silt fence shall also be placed at the toe of cut -and -fill slopes along drainages or to protect other sensitive areas from deposition of soils eroded off the slopes. Additional BMPs shall be employed as necessary to reduce soil erosion and offsite transport of sediments. j Site Protection. The pad shall be fenced to BIM standards to exclude livestock grazing for the first two growing seasons or until seeded species are firmly established, whichever comes tater. The seeded species will be considered firmly established when at least 50 percent of the new plants are producing seed. The BLM will approve the type of fencing. Monitoring. The operator shall conduct annual monitoring surveys of all sites categorized as "operator reclamation in progress" and shall submit an annual monitoring report of these sites to the BLM by December 31 of each year. The monitoring program shall use the four Reclamation Categories defined in Appendix I of the 1998 ISEIS to assess progress toward reclamation objectives. The annual report shall document whether attainment of reclamation objectives appears likely. If one or more objectives appear unlikely to be achieved, the report shall identify appropriate corrective actions. Upon review and approval of the report by the RIM, the operator shall be responsible for implementing the corrective actions or other measures specified by the BLM. I ] . Weed Control, The operator shall regularly monitor and promptly control noxious weeds or other undesirable plant species as set forth in the Glenwood Springs Field Office Noxious and Invasive Wed Management Plan for Oil and Gas Operators, dated March 2007. A Pesticide Use Proposal (PUP) must be approved by the BLM prior to the use of herbicides. Annual weed monitoring reports shall be submitted to BLM by December 1. 12. Migratory Birds. It shall be the responsibility of the operator to comply with the Migratory Bird Treaty Act (MBTA) with respect to "take" of migratory bird species. Under the MBTA, "take" means to pursue, hunt, shoot, wound, kill, trap, capture, or collect, or to attempt to engage in any such conduct. The operator shall prevent use by migratory birds of any pit containing fluids associated with oil or gas operations, including but not limited to reserve pits, produced water pits, frac-water pits, cuttings trenches (if covered by water/fluid), and evaporation pits. Fluids in these pits may pose a risk to migratory birds (e.g., waterfowl, shorebirds, wading birds, songbirds, and raptors) as a result of ingestion, absorption through the skin, or interference with buoyancy and temperature regulation, Regardless of the method used, it shall be in place within 24 hours following the placement of fluids into a pit. Because of high toxicity to birds, oil slicks and oil sheens should immediately be skimmed off the surface of any pit that is not netted. The most effective way to eliminate risk to migratory birds is prompt drainage, closure, and reclamat ion of pits, which is strongly encouraged. All mortality or injury to species protected by the MBTA shall be reported immediately to the BLM project lead and to the USFWS representative in the BLM Field Office at 970-876-9051 (Creed Clayton) and visit http://www.fws.gov/mountain:prairie/contaminantsioilpits.h tin. All persons associated with operations under this authorization shall be informed that any objects or sites of paleontological or scientific value, such as vertebrate or scientifically important invertebrate fossils, shall not be damaged, destroyed, removed, moved, or disturbed. If in connection with operations under this authorization any of the above resources are encountered the operator shall immediately suspend all activities in the immediate vicinity of the discovery that might further disturb such materials and notify the BLM authorized officer of the findings. The discovery must be protected until notified to proceed by the BLM authorized officer. Where feasible, the operator shall suspend ground -disturbing activities at the discovery site and immediately notify the BLM authorized officer of any finds. 'The I3LM authorized officer will, as soon as feasible, have a KM -permitted paleontologist check out the fold and record and collect it if warranted. If ground -disturbing activities cannot be immediately suspended, the operator shall work around or set the discovery aside in a safe place to he accessed by the 13T.Mperrnitted paleontologist. 14. Cultural Education/Discovery. All persons in the area who are associated with this project shall be informed that if anyone is found disturbing historic, archaeological, or scientific resources, including collecting artifacts, the person or persons will be subject to prosecution. Pursuant to 43 CFR 10.4(g), the BLMauthorized officer shall be notified by telephone, with written confirmation, immediately upon the discovery of human remains, funerary items, sacred objects, or objects of cultural patrimony. Further, pursuant to 43 CFR 10.4 (c) and (d), activities shalt stop in the vicinity of the discovery, and the discovery shall be protected for 30 days or until notified by the BLM authorized officer to proceed. If in connection with operations under this contract, the operator, its contractors, their subcontractors, or the employees of arty of them discovers, encounters, or becomes aware of any objects or sites of cultural value or scientific interest such es historic ruins or prehistoric ruins, graves or grave markers, fossils, or artifacts, the operator shall immediately suspend all operations in the vicinity of the cultural resource and shall notify the BLM authorized officer of the findings (16 USC 470h-3, 36 CFR 800.112). Operations may resume at the discovery site upon receipt of written instructions and authorization by the BLM authorized officer. Approval to proceed will be based upon evaluation of the resource. Evaluation shall be by a qualified professional selected by the BLM authorized officer from a Federal agency insofar as practicable. When not practicable, the operator shall bear the cost of the services of a non -Federal professional. Within five working days, the B LM authorized officer will inform the operator as to: + whether the materials appear eligible for the National Register of Historic Places + what mitigation treasures the holder will likely have to undertake before the site can be used (assuming that in-situ preservation is not necessary) • the timefrarne for the BLM authorized officer to complete an expedited review under 36 CFR 800.1 1, or any agreements in lieu thereof, to confirm through the SHPO State Historic Preservation Officer that the findings of the BLM authorized officer are correct and that mitigation is appropriate, The operator may relocate activities to avoid the expense of mitigation and delays associated with this process, as long as the new area has been appropriately cleared of resources and the exposed materials are recorded and stabilized. Otherwise, the operator shall be responsible for mitigation costs. Upon verification from the 13LM authorized officer that the required mitigation has been completed, the operator wilt be allowed to resume construction. Antiquities, historic ruins, prehistoric ruins, and other cultural or paleontological objects of scientific interest that are outside the authorization boundaries but potentially affected, either directly or indirectly, by the proposed action shall also be included in this evaluation or mitigation. impacts that occur to such resources as a result of the authorized activities shall be mitigated at the operator's cost, including the cost of consultation with Native American groups. Any person who, without a permit, injures, destroys, excavates, appropriates or removes any historic or prehistoric ruin, artifact, object of antiquity, Native American remains, Native American cultural item, or archaeological resources on public lands is subject to arrest and penalty of law (16 USC 433, 16 USC 470, 18 USC 641, 18 USC 1170, and 18 USC 1361). 15. Raptor Nesting. To ensure compliance with the Migratory Bud Treaty Act (MBTA) with respect to nesting raptors, the operator should cchedute cnnstrtiction or drilling activities to begin outside the raptor nesting season (February 1 to August 15) if practicable. If initiation of construction, drilling, or completion activities during this period cannot he avoided, the operator is responsible for complying with the MBTA, which prohibits the "take" of birds or active nests (those containing eggs or young), including nest failure caused by noise and human activity. 16. Road Maintenance. Roads shall be crowned, ditched, surfaced, drained with culverts and/or water dips, and constructed to BLM Gold Book standards. Initial gravel application shall be a minimum of 6 inches. The operator shall provide timely year-round road maintenance and cleanup on the access roads. A regular schedule for maintenance shall include, but not be limited to, blading, ditch and culvert cleaning, road surface replacement, and dust abatement. When rutting within the traveled way becomes greater than 6 inches, blading and/or gravelling shall be conducted as approved by the authorized officer. 17. Big Game Winter Range Tuning Limitation. To minimize impacts to wintering big game, no construction, drilling or completion activities shall occur during a Timing Limitation (TL) period from December 1 to April 30 per lease stipulation and Grass Mesa GAP EA. To further reduce impacts to wintering big game, remote sensing should be used for production monitoring, and unavoidable monitoring or maintenance activities should be conducted between 9 a.m. and 3 p.m., to the extent practicable. These additional recommendations apply to the period from December 1 to April 30. 18. Birds of Conservation Concern. Pursuant to SI.M instruction Memorandum 2008-050, all surface - disturbing activities are prohibited from May 1 to July 1 to reduce impacts to Birds of Conservation Concern (BCC). An exception to this COA will be granted if nesting surveys conducted no more than one week prior to surface -disturbing activities indicate that no BCC species are nesting within 30 meters (100 feet) of the area to be disturbed. Nesting shall be deemed to be occurring if a territorial (singing) male is present within the distance specified above. Nesting surveys shall include an audial survey for diagnostic vocalizations in conjunction with a visual survey for adults and nests. Surveys shall be conducted by a qualified breeding bird surveyor between sunrise and 10:00 AM under favorable conditions for detecting and identifying a BCC species. This provision does not apply to ongoing construction, drilling, or completion activities that are initiated prior to May 1 and continue into the 60 -day period at the saute location. Topsoil shall also be windrowed, segregated and stored along pipelines and roads fat later spreading across the disturbed corridor during final reclamation. Topsoil berms shall be promptly seeded to maintain soil microbe health, reduce erosion, and prevent weed establishment. 20. Hydrostatic Pipeline Testing After testing of newly installed pipelines, water used in pressure testing of the lines shall be disposed at a State -approved facility or reused for drilling and/or completion operations. 21. Visual Resources. After the pipelines are buried and backfilled, after the corridor is reshaped to the natural contours and drainages, and after the site has been broadcast seeded, any stockpiled boulders shall be set onto the corridor randomly, but in a manner that appears natural. BLM may direct that boulders and any cleared tree debris be placed in particular manner or location to augment the overall visual appearance of the site reclamation. 22. Drainage Crossings and Culverts. Construction activities at perennial, intermittent, and ephemeral drainage crossings (e.g. burying pipelines, installing culverts) shall be timed to avoid high flow conditions. Construction that disturbs any flowing stream shall utilize either a piped stream diversion or a cofferdam and pump to divert flow around the disturbed area. Pipelines installed beneath streaut crossings shall be buried at a minimum depth of 4 feet below the channel substrate to avoid exposure by channel scour and degradation. Following burial, the channel grade and substrate composition shall be returned to pre -construction conditions. 23. Bald and Golden Eagles. Il shall be the responsibility of the operator to comply with the Bald and Golden Eagle Protection Act (Eagle Act) with respect to "take" of either eagle species. Under the Eagle Act, "take" includes to pursue, shoot, shoot at, poison, wound. kill, capture, trap, collect, molest and disturb. "Disturb" means to agitate or bother a bald or golden eagle to a degree that causes, or is likely to cause, based on the best scientific information available, (1) injury to an eagle; (2) a decrease in its productivity by substantially interfering with normal breeding, feeding, or sheltering behavior; or (3) nest abandonment by substantially interfering with normal breeding, feeding, or sheltering behavior. Avoidance of eagle nest sites, particularly during the nesting season, is the primary and preferred method to avoid a take. Any oil or gas construction, drilling, or completion activities planned within 0.5 mile of a bald or golden eagle nest, or other associated activities greater than 0.5 miles from a nest that may disturb eagles, should be coordinated with the BLM project lead and BLM wildlife biologist and the USFWS representative in the BLM Field Office (970-875-9051).. 24. Jurisdictional Waters of the U.S. The operator shall obtains appropriate permits from the U.S. Army Corps of Engineers (USACE) prior to discharging fill material into waters of the U.S. in accordance with Section 404 of the Clean Water Act. Waters of the U.S. are defined in 33 CFR Section 328.3 and may include wetlands as well as perennial, intermittent, and ephemeral streams. Permanent impacts to waters of the U.S. may require mitigation. Contact the USACE Colorado West Regulatory Branch at 970-243-1199 ext. 17 (Travis Morse).
