Both lots are slightly larger than a % acre
in size.

Roaring Fork
I. DESCRIPTION OF PROPOSAL -REQUEST
The Applicant is requesting an Amended Final Plat for Lots 4 and 13 to correct
inconsistencies between the surveyed property line and existing improvements associated
with fences and driveway locations. The improvements have been in place for many years
and both lot owners desire to correct the lot line. The Applicant represents that the reason
for the encroachments is that the property was originally "pinned" in error by a surveyor.
The adjustment will result in each owner's fences and driveway improvements being
located entirely on their own lot.
The existing and proposed lots sizes are all slightly larger than % acre consistent with the
original platting for the subdivision. Lot 13 was originally platted at 0.25 acres and will
increase slightly to 11,446 sq. ft. or 0.262 acres. Lot 4 was subject to a previous amended
plat and will decrease from its amended size of 12,019 sq.ft. by approximately 363 sq.ft. to

become 11 ,656 sq.ft. or 0 .267 acres. Lot 4 was originally platted at 0.26 acres.
No changes to the existing access, utilities, or drainage are proposed by the amended plat
and no nonconforming conditions will result from the lot line adjustment. The Ranch at
Roaring Fork Homeowners Association has provided a letter indicating support for the
request along with minutes from their meeting discussing the proposal. The Applicant
requested a waiver from the submittal requirements for an Improvements Agreement. The
request was determined appropriate for the Application as no new improvements are
proposed or required.
II. AUTHORITY -APPLICABLE REGULATIONS
The Amended Final Plat Application is being processed in accordance with Section 5-305,
Amended Final Plat Review and Tables 5-103 Common Review procedures. Section 4-
103 and 4-101 address details of the review procedures.
The Application has been determined to be complete including a waiver requests
addressing the fact that an Improvements Agreement is not warranted for the Plat
Amendment Request. Public notice was required forthe Director's Decision in accordance
with Sections 4-103 and 4-101. The Applicant has provided evidence of completion of the
required notice for the Directors Decision.
Ill. STAFF ANALYSIS
1. The Applicant's draft plat needs to be updated with current certificates and signature
blocks for both lots. The Application was referred to the County Surveyor and his technical
comments (see attached) will need to be addressed in the final draft of the amended plat.
2 . No conflicts with the existing underlying zoning or covenants have been noted. The
lot line adjustment will correct a minor side yard setback nonconformity and create a 10 ft.
side yard setback for Lot 13.
3. No changes to existing easements, utility locations, or access are proposed as part
of the amended plat process. Easement locations shall remain unchanged from the
previous platting. The apparent delineation of an easement along the original common lot
line shall be removed to be consistent with the original platting.
4. A plat note indicating the purpose of the amended plat has already been included on
the draft plat. An additional plat note indicating that all previous plat notes on the original
plat and the Lot 4 & 5 Amended Plat (including notes addressing easements) shall remain
in force and effect.
5 . Review of the amended plat by the County Attorney's Office will be conducted prior
to presentation of the plat for signatures. All concerns of the County Attorney's Office
including signature blocks and plat notes shall be addressed by the Applicant.

6. Some improvement location information may be removed from the final mylar of the
amended plat based on direction from the County Surveyor's Office.
7 . . No public comments from adjacent property owners were received by the
Community Development Department in response to the public notice.
8. The Applicant's proposal meets the Review Criteria contained in Section 5-305 (C)
as the Application does not increase the number of lots, does not result in the relocation of
any roads or creation of new roads, and will correct technical surveying errors.
IV. SUGGESTED FINDING AND RECOMMENDATION
Staff supports a finding that the Amended Final Plat Application for Lots 4 and 13 of the
Ranch at Roaring Fork IV, Filing No. 1 meets the requirements and standards of the
Garfield County Land Use and Development Code as amended and is recommended for
Administrative Approval by the Director of the Community Development Department
subject to the following conditions of approval.
1. That all representations of the Applicant contained in the Application submittals shall
be conditions of approval unless specifically amended or modified by the conditions
contained herein.
2. All requirements from the County Surveyor shall be met prior to submittal of the plat
for final execution.
3. The Plat shall be subject to final review and approval by the County Attorney's
Office and Community Development Department prior to submittal of the plat for final
execution . All standard plat certificates and signature blocks shall be included on the final
plat including but not limited to Certificates of Taxes Paid, Lien Holders Certificates if there
are lien holders, and Title Certificates for each of the two lots.
4. A plat note shall also be included on the amended plat reading as follows:
The plat notes from the Final Plat Ranch at Roaring Fork IV Filing No. 1,
recorded at Reception No. 27 4823 and the Amended Final Plat of Lots 4 and
5, Ranch at Roaring Fork IV Filing No. 1, recorded at Reception No. 725495
remain in full force and effect to the Lots contained in this Amended Plat.
5. The Applicant shall provide a title report or commitment for both lots prior to
submittal of the plat for final execution. The title report shall confirm ownership of the
property and any lien holders that will also be required to sign the plat.
6. The proposed plat shall be updated and edited as follows prior to submittal for final
review by the County:

a. The new lot line shall be labeled on the amended plat and the delineation of 10 ft.
areas on either side of the original lot line shall be removed.
b. The easement plat note shall be removed from the amended plat. It is addressed
by reference to the prev ious recorded plats .
c . The final mylar version of the plat may have some of the improvements information
removed subject to direction from the County Surveyor.
7 . The Applicant shall provide an updated letter from the Homeowners Association
indicating their approval of the requested lot line adjustment as shown on the draft
amended plat.

Dear Sydney,
Upon review of the Ranch at Roaring Fork, IV, Filing No . 1, Lots 4 & 13 Amended Final Plat I have prepared
a list of comments or corrections to be made prior to approval for survey content and form.
1. The Basis of Bearings Statement is missing and needs to describe monuments used .
2 . "Deputy" needs to be added ahead of Garfield County Surveyor below signature line.
3. Prior Plat recording information should be added to dedications .
4. It is understood that surveyor acknowledges the vicinity map will be in place at time of mylar.
5. A statement describing the units of measure use to prepare this Plat.
6. Curve data supplied appears to be that of prior Platting and needs to be updated to proposed
conditions.
Once these and all final comments from Building and planning have been completed, the Mylar may be
prepared for recording. The Mylar shall be delivered to the Building and Planning office with all private party
signatures no later than Monday the week prior to the next commissioner meeting day in order to make that
meeting.
