Ranch at Roaring Fork IV, Fil# 1, Lots 4 & 13
Hi Glenn. Per our conversation earlier today, I think it would be advisable for me to request an extension of time in order
to file the amended plat for the above property. As you know, the lienholders have been sent the plat, but a few other
documents need to be provided. Once all documents are received (in Illinois) it will be at least 2-3 weeks to process.
Then we will need scheduling time in order to obtain the final sign off from the BOCC. The Director's Decision is dated
November 25th, so I assume the 90 day window terminates on February 25.
Please let me know if this e-mail is sufficient for the extension, or whether I need to write a more formal letter.

Dear Sydney,
Upon the second review of the Ranch at Roaring Fork, IV, Filing No. 1, Lots 4 & 13 Amended Final Plat I
have prepared a list of comments or corrections to be made prior to approval for survey content and fonn.
1. "Deputy" needs to be added ahead of Garfield County Surveyor below signature line.
2. It is understood that surveyor acknowledges the vicinity map will be in place at time of mylar.
3. It is the recommendation of the County Surveyors office to remove the combined square footage
stated in the Legal Description on the second page.
4. Boundary line annotation should not have line work through it as reproduction will become
illegible.
5. The title of said Plat does not match on Page I and Page 2. It appears Page 2 needs to be updated as
the Surveyor's Certificate and the Dedication Certificates match Page 1.
Once these and all final comments from Building and planning have been completed, the Mylar may be
prepared for recording. The Mylar shall be delivered to the Building and Planning office with all private party
signatures no later than Monday the week prior to the next commissioner meeting day in order to make that
meeting.

Board of County Commissioners:
Attached is the Director's Decision Letter approving with conditions an Amended Subdivision Plat for Lots 4 and 13,
Ranch at Roaring Fork IV, Filing No. 1 (File No. FPAA-7718). The Application was submitted by Blair Elliot and Robert Van
Raden owners of the respective lots. The proposal is intended to correct the common lot line between the two lots to
accurately reflect existing improvements (fences and driveway) that have been in place for many years. The Application
represents that the amendment is the result of the property being "pinned" in error by the original surveyor.
Pursuant to the procedures outlined in the Land Use and Development Code the Director's Decision shall become final
only after the expiration of a ten day call up period, provided that the County does not receive a request for
reconsideration and the decision is not called up for review by the Board of County Commissioners.
The call up period for the decision shall end on December 5th. Please contact me, Tamra Allen, Planning Manager or
Fred Jarman, Director of Community Development if you have any questions regarding the Application or if you wish to
review the file.

Hi Mark: The Director of the Community Development Department has issued a decision of Approval with condition in
regard to the Ranch at Roaring Fork IV, Filing 1 Amended Plat application for Lots 4 and 13. I've attached the Director's
Decision letter and the staff report for your files. If you have any questions regarding the conditions of approval please
contact me and we'll try to address and answer any concerns.
The Board County Commissioner's has been notified of your approvals and the 10 day call up period will expire on
December 5th at which time your approvals wilt be in effect provided the County does not receive any requests for
reconsideration or call up.
As there are several adjustments to the plat please send us a final review draft prior to preparing a mylar. If you have
any questions regarding the plat and/or plat notes please feel free to contact us.
Thanks for your quick responses and follow-up on our review questions/issues. It has been good working with you on

I have received the Referral Form from your office regarding your File #FPAA-7718, Ranch at
Roaring Fork Phase IV Amended Plat, Lots 4 & 13 Filing 1, as well as the disc containing the
plat.
The Board of Directors has reviewed the lot line adjustment to address encroachments and
setback issues along the common lot line, and voted to approve the application at the August
2013 meeting, which has been reflected in the minutes. We also understand that during the
application process ownership of one of the lots changed, which does not affect the prior
approval by the Ranch at Roaring Fork Board of Directors.

Dear Marie
We have completed our initial review of the Application and supplemental
materials you provided regarding the Amended Plat Application for Lots 4 and 13
of the Ranch at Roaring Fork IV, Filing No.1. The Application was submitted on
behalf of Blair Elliot (owner of Lot 4) and Robert R. Van Raden Jr. (owner of Lot
13). The property addresses and Assessor Parcel Numbers are 0075
Stagecoach Circle (Parcel No . 2393-362-15-013) and 0041 Stagecoach Circle
(Parcel No. 2393-362-15-004).
This letter is to inform you that the application has been deemed Technically
Complete and scheduled for a decision by the Director of the Community
Development Department. Please understand that a determination of technical
completeness shall not be viewed as a recommendation of approval, finding of
an adequate application, or a finding of general compliance with any goal or
objective of the Garfield County Land Use and Development Code or the Garfield
County Comprehensive Plan 2030.
The Application will be reviewed by Staff and a report will be sent to you. The
date upon which the Director of the Community Development Department will
render a decision has been set for November 25, 2013.
Public notice at least 30 days prior to the Director's Decision is required by
written notice by certified mail, return receipt requested, to the owners of record
of all property adjacent to the property and within 200 ft. and the mineral owners
of record for the subject property. The Applicant shall be solely responsible for
the mailing of the notice . The Applicant shall present proof of the required notice
to the Community Development Department prior to the Director's Decision .
Details regarding the notice requirements are found in the Land Use and
Development Code in Table 4-103 and Section 4-103(8). Please review the
following notice requirements from Section 4-103(8).

Notice. The Applicant shall mail notice pursuant to section 4-
101. E., at least 30 days prior to the date of the Director's deci sion
and shall provide proof of adequate notice prior to any deci sion.
The notice shall include a Vicinity Map, the property's legal
description, a short narrative describing the current zoning and
proposed Land Use Change, the contact information for the
Community Development Department and the date that the Director
will make a decision.
I have enclosed an appropriate notice form for the Director's Deci sion consistent
with the code section noted above. This document is provided to you as a
courtesy. The Applicant must verify that all information in this document is
correct . It shall be the obligation of the Applicant to correct any deficiencies in
these documents such that proper notice in form and substance can be
established .
Included for your convenience is the following outline of the process from this
point.
1. Additional copies of the submittals should be provided by the
Applicant by October 25th .
2. Public Notice must be mailed by the Applicant 30 days prior to the
date set for the Director's Decision (mailing no later than October
25th). The Applicant will provide the proof of mailing (including
proof of mailing and certified return receipts) prior to the Director's
Decision .
3. Application referrals will be sent out on October 281h with comments
requested within 21 days .
4. Referral Comments are due back on November 18th at which time
the Staff Report will be finalized.
5. On November 25, 2013, the Director or the Community
Development Department will render a Decision to approve,
approve with conditions or deny the application .
6. The Board of County Commissioners will be provided notice of the
Director's decision and has 10 days to review the application and
request a public hearing.
7. If the "call up " time period expires without a request for a hearing,
the Planner will proceed with verification of completion of any
conditions of approval and required changes to the plat.
8. Once all conditions are met and the plat finalized, the plat is
prepared for submittal to the Board of County Commissioners for
signature and recording.
Please submit by October 25tti, one additional paper copy and two additional CD
copies of the application materials and any sqpplements/amendments. These
copies are required for the Application referrals.

Description of Request: The Applicant is requesting an Amended Plat to adjust the
common lot line between the two lots to address the location of

Glenn: I am bringing down the requited supplementary materials very shortly. Attached is a copy of the cover letter,
plus electronic copies of the plats (original, plus an amended plat for Lot 4-there have been no changes to Lot 13 over
the years}.
I did submit a copy of the lot layout of the area surrounding Lots 4 & 13 from the County GIS. However, the one I
wanted to provide with the parcel ID #'son it wouldn't print out for me. I did however provide a pdf version, but this
does not have the same information as the GIS live maps did. Sorry.

Dear Glenn:
Attached you will find the supplemental information for the above application noted in
your letter of October 1 oth. The information is as follows and contains three copies each
of the following:
1. A vicinity Map is attached. It will also be included on the Amended Final Plat
when that is ready for recordation.
2. An amended list of adjoining property owners within 200 ft of the subject
property. One property owner was omitted by mistake from the original submittal.
There were also two grammatical corrections made to the list.
3. Full size copies (24 x 36) of subdivision plats that involve Lots 4 and 13. The first
plat is the original subdivision plat for that filing of the Ranch at Roaring Fork.
That plat was recorded at Reception No. 274823 on October 12, 1976. The
second is an Amended Plat for Lots 4 & 5, recorded as Reception No. 725495 on
June 13, 2007. It appears there have been no changes to Lot 13 through the life
of the Ranch at Roaring Fork development. I will also send to you electronic
versions of these plats for your convenience and distribution.
4. A clarification of the waiver request from Section 4-202 of the County ULIR.

Dear Glenn:
Attached you will find the supplemental information for the above application noted in
your letter of October 10th. The information is as follows and contains three copies each
of the follo~ing:
1. A vicinity Map is attached. It will also be included on the Amended Final Plat
when that is ready for recordation .
2. An amended list of adjoining property owners within 200 ft of the subject
property. One property owner was omitted by mistake from the original submittal.
There were also two grammatical corrections made to the list.
3. Full size copies (24 x 36) of subdivision plats that involve Lots 4 and 13. The first
plat is the original subdivision pl at for that filing of the Ranch at Roaring Fork.
That plat was recorded at Reception No. 274823 on October 12, 1976. The
second is an Amended Plat for Lots 4 & 5, recorded as Reception No. 725495 on
June 13, 2007. It appears there have been no changes to Lot 13 through the life
of the Ranch at Roaring Fork development. I will also send to you electronic
versions of these plats for your convenience and distribution.
4. A clarification of the waiver request from Section 4.,202 of the County ULIR.

Clarification of Waiver of Submission Requirements related to Section
4-202 of the County LUDC
The waiver request according to Section 4-202 is from any requirement related to
submitting an Improvements Agreement or any additional civil engineering
submittal with the exception of the amended final by a licensed surveyor. As
noted in the land use application, the project size is small, there are no changes
being made on the ground or to the properties themselves, there are no
engineering issues associated with the application and no impacts are
anticipated.

Dear Marie:
We have reviewed the Application for an Amended Plat for Lots 4 and 13 of the Ranch
at Roaring Fork IV, Filing No.1, that you submitted on behalf of Blair Elliot (owner of Lot
4) and Robert R. Van Raden Jr. (owner of Lot 13). The property is located
approximately 3 miles east of Carbondale within the Ranch at Roaring Forte PD zoning.
The property's addresses and Assessor Parcel Numbers are 0075 Stagecoach Circle
(Parcel No. 2393-362-15-013) and 0041 Stagecoach Circle (Parcel No. 2393-362-15-
004).
Our completeness review included input from the County Attorney's Office and has
noted several items that need to be addressed prior to a determinati,on of technical
completeness. In accordance with the Garfield County Land Use and Development
Code, please respond to the following items:
1. The Application needs to include a vicinity map meeting the code standards.
2. Your submittal should clarify what submittal requirements you are requesting a
waiver from. It is anticipated that the waiver is in regard to submittal of an
Improvements Agreement.
3. Please review your list of adjoining property owners. Some owners shown on the
draft plat are not included on your written list.
4. A copy of the existing plat for the affected lots and the original subdivision plat
will also be most helpful. It should reflect any easements on the property.
Once the above information is addressed we can finalize our completeness review,
schedule a date for your Director's Decision and proceed with the public notice
requirements. Also, once determined to be complete, you will need to provide
additional copies of the submittal materials to send to referral agencies.
Please note that the Garfield County Land Use and Development Code requires that the
technical completeness issues be resolved within 60-days of the date of this letter,

otherwise the application will be deemed withdrawn unless a request for extension is
submitted and approved.

Board of Directors Meeting
MINUTES
August 5, 2013
Regular session at 4:00 pm
The Board members present for the meeting were Christie Jensen, Stewart Mcconaughy, Mike Gerber,
Gwen Ballard, Nancy Thorpe and Marcy Kneiper. Also attending the meeting were Ranch Manager,
Steve Coley, Homeowners, Peter Breitenstein, Stephanie Mcconaughy, Tom Vail and administrative
assistant, Michele Willey. Jeff Conklin, attorney from KarpNeuHanlon joined when the Board went into
Executive Session.
Christie Jensen called the meeting to order at 4:02 pm.
Election of Officers
Stewart Mcconaughy motioned for Christie Jensen to continue as President. Gwen Ballard seconded the
motion. Approved unanimously. Christie Jensen will continue as President.
Christie Jensen motioned for Stewart Mcconaughy to be Vice President. Marcy Kneiper seconded the
motion. Approved unanimously. Stewart Mcconaughy is the new Vice President.
Christie Jensen motioned for Gwen Ballard to continue as Treasurer. Stewart Mcconaughy seconded the
motion. Approved unanimously. Gwen Ballard will continue as Treasurer.
Gwen Ballard motioned for Marcy Kneiper to continue as Secretary. Stewart Mcconaughy seconded the
motion and it was approved unanimously. Marcy Kneiper will continue as Secretary.
Minutes
Approve draft minutes from July 1, 2013 -corrections were made regarding who made the
motion for each of the resolutions, as well as confirming who seconded. All in favor. The minutes
were approved.
Homeowner Issues, Mike Fordyce (Golf) -Mike Fordyce addressed the Board regarding golf course
fees. He fully supports the golf course and that it is a great amenity but also stated that those who USE
it should pay more or support "Pay to Play'' in some manner. He hopes that the Board and the Golf
Advisory Board will continue to work towards solving the issue.
Financial
• July financial review -Collections: Dave Clark and Ryan Grabler continue to have
outstanding balances. Steve will contact Ryan Grabler and let him know that the next step
would be to go to legal action.
With Gwen Ballard's help we now have a depreciation schedule of fixed assets for our tax
accountant.
• Cash disbursements -Some of the disbursements were: 11 Waterway notes were paid out;
a check to Todd Beckstead -auditor; John Bel\io-winter hay bill; Michele Willey for Annual
Meeting supplies; and Water Resource Consultants for a back bill just sent to us from 2012.
The monthly report comes from Steve Coley and the quarterly report comes from
Robertson & Marchetti Accounting. There were some questions on reclassifications that
were handled with Gwen Ballard's help. Stephanie Mcconaughy had a question about a
check disbursement for FlyWater. Jordan Shelton, who is a renter with a horse boarded
here has not paid the winter hay bill and is delinquent in payments. Removing the horse
from the Ranch is an option. A discussion continued on overdue balances and the length of
time that they should be outstanding. The 2006 Rules say that if a payment is 30 days late
there is a $25 charge. There is also a returned check fee and after 120 days an attorney is
required to send a letter to the homeowner. The attorney then may file a lawsuit. Mike
Gerber stated that CCIOA law must be adhered to by the RRF HOA.
• Audit progress -Gwen Ballard advised the Board that we are waiting for the accountant to
review the list of fixed assets and pass the list along to the auditor. The audit cannot be
completed until this is done.
• Fishing Badge sales, YTD total -Stephanie Mcconaughy gave a memo to the Board in favor
of the FlyWater contract. As of 08-05-13, fishing badge sales totaled $72,650, not counting
Day passes. Six day passes were also sold, totaling $350, bringing total revenues from
fishing permit sales to $73,000. In her 02-25-13 memo to the Board, she projected $72,875
in 2013 fishing permit revenues as part of an estimated fishing fund budget to justify work
on the New Stream to be completed by FlyWater in 2013. She was happy to see that we
have met our revenue target. FlyWater has submitted the necessary ACOE permit
application. There is a 60-day limit for ACOE action on the application. Assuming we receive
permit approval, we plan to begin the planned work sometime in September 2013.
• GAC YTD -The Golf course had a great July until the rainstorms impacted usage. If the
weather cooperates, we still should be on target for the year. Golf revenue the last five
days of July was reduced due to rain coupled with the construction on Highway 82.
Old Business
• Clark Notice of Violation, foreclosure update -Deferred to Executive Session
• Infiltration study progress, Mclaughlin -The sewer line at the east end of Stagecoach Lane
had a seam split and the area by the Nelson house had rocks in the sewer line that were as
large as the line itself. Cost estimates for the repair are pending and we will move forward
after further consultation with Mclaughlin.
• Stewart Mcconaughy made the following motion, seconded by Marcy Kneiper, and
unanimously approved:
The existing "Kiddie Park" playground equipment shall be retired and removed by the end
of calendar year 2013. Not later than November 15, 2013, the Association will order
from Bears Playgrounds, LLC, the new playground equipment described on Attachment A
hereto, for a cost not to exceed $10,000. In addition, and as a condition of such order, the
Association will obtain from Bears Playgrounds, LLC, a firm quotation, good until at least
January 31, 2014, for the additional playground equipment described on Attachment B
hereto, at a cost not to exceed $10,000. The Board will consider placing an order for the
Attachment B equipment at its January, 2014 regular meeting. The Association will obtain
from Bears Playgrounds a copy of its product liability insurance policy and if recommended

by the Association's insurance broker will obtain a certificate evidencing that the
Association is named on such policy as an additional insured. The Association also will
obtain appropriate assurance that all warranties and insurance coverage will not be
adversely affected if the playground equipment is installed and assembled on site by the
Association's personnel.
The playground equipment would be installed by staff in 2014.
Green Clean Pro for the ponds -Lake Colorow developed confluent algae blooms in May
and June. It was anticipated that a herbicide treatment would be required. The blooms
inexplicably receded and water is as clean and clear as it was in March.
Ranch Rules and Procedures drafts for Board review -The title "Rules" needs to be added
to the front cover of the Rules booklet as well as the date of July 1, 2013. The 12 pt font
size is the Board's choice and it is to be printed in a publication style font.
Fishing easement review -Regarding fishing easements, we need to review the property
lines relative to the ponds and streams. Mike Gerber will review his information from
previous meeting records addressing easements in relation to titled and recorded building
envelopes.
Rules violations notices -Steve Coley has helped many homeowners clean up their areas
but the RV lot has some eyesores. Quick emails have been sent out to violators and verbal
notices have also been given. The Ranch Manager will maintain a Log Book of violations,
notices given and Owner responses and commitments.
New Business
• Review condo exterior applications, Olson, Martin, Reynolds and Froelicher. The Board has
considered four requests from condominium owners to make changes in and around their
Units: two for changes within the Limited Common Elements associated with such Units,
and two for landscaping changes in the Common Areas adjoining such Units. The Board
declines to authorize individual owners to make changes within the Common Areas, but in
consultation with Ranch staff and Ranch contractors will consider Owner requests for
landscaping improvements to be made by the Association or its contractors, including due
consideration of the costs of any such work and how such costs might be funded. As to the
two requests for changes to Limited Common Elements, the Board notes Sections 6.9(m)
and 6.9(i) of the Ranch Declaration. The former provides in pertinent part that an Owner
shall not alter the 11 as built" condition of the Limited Common Elements without the prior
written consent and approval of the Association or its architectural committee. The latter
provides in pertinent part that the Association may adopt architectural and landscaping
controls permitting an owner to install fences, hedges, trees, walls, and other structures
within a Limited Common Element or Lot provided such controls are uniform and
non-discriminatory. The Board notes that Owners of Condominium Units have in the past
installed fences, walls and other structures within Limited Common Elements that are not
always architecturally consistent with the Units themselves or with other improvements,
and apparently in at least some cases without obtaining the required prior written consent
and approval. The Board believes that the Association should establish or update its rules
and procedures for consideration of installations within limited Common Elements, in order
to ensure that all such installations are harmonious and architecturally consistent, and also
to ensure that other Owners, and particularly neighboring Owners, receive advance notice
of any proposed installations and have an opportunity to comment to the Board or the
architectural committee. Pending the establishment or updating of such rules and
procedures, the Board will defer action on the two requests for ap·proval of changes within
the limited Common Elements.
• The Board has determined that the condo community needs to generate architectural
standards to address the number of applications coming in. Larry Martin has volunteered
to participate in this effort. Steve Coley was directed to solicit the condo community to
re-establish the Condo Advisory Committee.
• Anthes I Van Raden lot line adjustment. Approved .
• Committee Appointments. Deferred to September.
• 2014 Budget Process and Timeline. The budget process will start in September, for
submission to the community by December 1.
• Ranch Creek PUD discussion. Reviewed with Jeff Conklin in executive session
• Bob Holt {Bench for Mary). Discussion regarding the increased number of memorial
benches located in Open Space. The Board has determined that further placement of
benches will be discouraged, but tree planting with memorial plaques at the base is
welcome. Steve will add a mention regarding "memorial trees" in the Wrangler so that
people are aware of this move. Christie Jensen will speak with Bob Holt about his request
and the Board's decision.
• Chuck Froelicher (plantings). Discussion regarding plantings on Ranch Common Elements.
Individual owners are not to install or maintain plantings in common areas. The Condo
Advisory Committee will make recommendations to the Board for maintenance and
upgrades of plantings.
• Kevin Bruce (dog kennel application). Denied. Further discussion by the Board regarding
the animals in question notes in accordance with Section 6.9(d) of the Ranch Declaration
and Article V, Section E.1 of the Ranch Rules, and based on numerous complaints from
neighbors and others over a period of months and years, the Board determines that the two
dogs maintained by Kevin Bruce at his residence at 0188 Surrey Street are overly aggressive,
bark excessively, advance on others and constitute a nuisance to other Owners and their
guests. The Board hereby prohibits such animals from the Ranch. The Ranch Manager
shall advise Mr. Bruce that the animals must be promptly removed from the Ranch and not
allowed to return.
• Discussion of "Cars for sale" parked in Ranch parking lots -It appears that none of the cars
"for sale" in the parking lots have a valid registrations. It is not in the best interest of the
Ranch at Roaring Fork to have cars for sale parked in the parking lots. The Board will

consider at its September 9, 2013 regular meeting the following addition to Article X of the
Ranch Rules:
o F. Parking. Vehicles, trailers and other items owned by (i) Owners or Tenants, (ii) their
guests while visiting the Owner or Tenant, (iii) persons using the Ranch Golf Course, and
(iv) such others as may be specifically authorized by the Ranch Manager, may be parked
in the Common Recreation Reserve but only in areas designated for that purpose, and
only subject to such restrictions as may be posted in such parking areas (including
limitations on the hours of use, and including a prohibition against parking of vehicles,
trailers, or other items offered for sale).

Attached for your files and for your review is an application for an Amended Plat for Lots
4 and 13 of the Ranch at Roaring Fork IV, Filing No.1 . The Application requests a lot
line adjusbnent between the two lots to address encroachments and setback issues
along the common lot line between the lots. The adjustment will address fences, a
driveway, and a side yard setback non-conformity. The application has been submitted
by Blair Elliot (owner of Lot 4) and Robert R. Van Raden Jr. (owner of Lot 13). The
property is located approximately 3 miles east of Carbondale within the Ranch at
Roaring Fork PD zoning. The property's addresses and Assessor Parcel Numbers are
