HomeMy WebLinkAbout2.0 Staff Report BOCC 04.16.07BOCC - 04116107 MR PROJECT INFORMATION AND STAFF COMMENTS TYPE OF REVIEW Amended Plat (Public meeting) APPLICANT Fritz and Vanessa Anthes LOCATION The property is located west of the intersection of County Road 115 and Cattle Creek Road (CR 113) in the Missouri Heights area ZONING Planned Development (P/D) SURROUNDING ZONING Planned Development (P/D) and Planned unit Development (PUD) LOT SIZES Lot 4 (12019 sq. ft.) and Lot 5 (13298 sq. ft.) I. DESCRIPTION OF PROPOSAL The owners of Lot 4 and 5 of the Ranch at Roaring Fork LV, no. one (1) request the Board to approve the realignment of the common property line between the two (2) lots to coincide with the with the existing fence line. The proposed property boundary realignment will not affect the building envelopes on either 1ot. II. AUTHORITY Section 6:10 of the Subdivision regulations states that an amendment may be made to a recorded plat, if such amendment does not 1) increase the number of subdivision lots or dwelling units, or 2) result in the major relocation of a road or add new roads. This request will not result in either of the two aforementioned standards and Staff finds these standards are met. III. STAFF RECOMMENDATION The Applicant has provided all required documentation and has satisfied the applicable standards for a plat amendment. Therefore, the Planning Staff recommends that the Board of County Commissioners, pursuant to Section 6:10 of the Subdivision Regulations of 1984, as amended, approve this amended plat request with the following conditions: 1. Reestablishment of the side yard ten (10) ft wide easement for utility, drainage, irrigation between lots 4 and 5, Ranch at Roaring Fork 1V, no. one (1), to reflect the realignment of the common lot line 2. That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval. within 90 days of approval, the Amended Final plat shall be reviewed (paper copy), then signed and dated (mylar copy) by the County Surveyor, than signed and dated by the Chairman of the Board and recorded in tie Clerk and Recorder,s Office of Garfield County. The Amended Final Plat shall meet the minimum CRS standards for land survey plats, as required by colorado state law, and approved by the county Surveyor and shall include, at a minimum, theinformation outlined in Section 5:22 of the Garfield County Subdivision Regulations.
