Residential Well Permit Application - Toler Well (52376-F) This well is in place an being used for the Toler residence. 3. Amended Contract with West Divide for 1 cfs. The attachments to the amended contract include an engineering report in the format requested. 4. Waiver of Rights for the well listed as. William and Nancy Sabel. This property has sold and the new owner has signed the waiver. 5. The other well, Langegger, is outside the 600 ft. radius as shown on the attached Figure 1. 6. Dear Thom: This is WestWater's report of a wetland evaluation performed at your property near Silt, Colorado on July 25, 2007. BACKGROUND Your request for a wetland evaluation was in response to a requirement in a Garfield County Building and Planning Department letter of May 16, 2007: 4. A Section 404 Permit for the day use access road crossing of the Colorado River and the development of the trout pond shall be obtained if the proposed use involves some component of the dredge or fill material and then shall be presented to the Garfield County Building and Planning Department prior to the issuance of the Special Use Permit if necessary. The proposed project, as understood by WestWater biologists includes: (1) use of an existing road crossing of the Last Chance Ditch (LCD), (2) construction of a bridge spanning the LCD to access a day use area and proposed gazebo in the northwest corner of the property, and (3) installation of a culvert in an existing irrigation ditch to allow access on to the LCD bridge. No other project components were examined. WestWater was retained to provide an opinion as to the presence of Army Corps of Engineers (COE) jurisdictional wetlands, and need for an Army Corps of Engineers (COE) 404 permit related to the bridge and culvert. WestWater has performed wetland evaluations and delineations for many years in western Colorado, and has established a very good working relationship with the COE Grand Junction office. METHODS WestWater biologists performed initial wetland evaluation of the subject area on July 25, 2007. Potential wetland areas were identified utilizing the three parameter method (vegetation, soils and hydrologic indicators) in accordance with Interim Arid West Regional supplement to the Corps of Engineers Wetland Delineation Manual, December 2006. The evaluation included WestWater Engineering Page 1 of 5 July 30, 2007 observations of dominant wetland indicator plant species and soil borings (20± inches deep) for observation of hydrologic and soils characteristics. Wetland areas in this report are referred to by WestWater as "potential wetlands". Only the COE can confirm wetland areas and boundary lines based on a complete wetland delineation and submittal of a request for Jurisdictional Determination to COE by the project proponent. RESULTS Figure 1 depicts the areas examined by WestWater and Photos 1 and 2 are typical project area views (attached). (1) The existing road crosses the LCD and potential fringe wetlands on both sides of the channel. At the road crossing the banks of the LCD are not as steep as the rest of the ditch and fringe wetlands are 8-10 feet wide from the waters edge. Dominant wetland vegetation indicator species consist of: Phalaris arundinacea (Reed canarygrass), Equisetum spp. (horse tail), and Elaeangnus angustifolia (Russian olive). Wetland soils were saturated and showed redoximorphic features with in the first 12 inches. (2) The LCD has a potential wetland fringe extending up both sides of the bank to the upland terrace. Bank slopes are at an approx. 1:1 slope and the upland terrace is approximately 5 feet. above the ordinary high water mark (see Figure 1 and Photo 1). Fringe wetlands range from 4-6 feet wide from the waters edge. Vegetation, soil, and hydrological findings were consistent with the road crossing area. On the top edge of the bank wetland soil indicators were at 20 inches and faded as distance from the ditch increased. The transition in soil indicators was the primary means of estimating the wetland boundary. (3) The irrigation ditch providing the existing pond with water is controlled by a head gate located across CR 311 from the southern most entrance to the property. From the head gate, the ditch flows under CR 311 across the upland terrace of the property into the existing pond, and continues out of the pond into the LCD as irrigation return flow. The ditch is has a narrow (2 feet wide) wetland fringe on both sides, wetland vegetation is dominated by Scirpus pungens (three -square bulrush) and Scirpus acutus (hard stem bulrush) (Photo 2). Wetland soils were saturated and showed redoximorphic features with in the first 12 inches. The ditch appears to have been entirely constructed in uplands. COE Jurisdictional Issues (1) The existing day use road that crosses the LCD requires no permit as long as no fill activity of any kind takes place within the boundaries of wetland fringe or below the Ordinary High Water mark (OHW) of the Waters of the US (WOUS). WOUS generally includes rivers, streams, lakes and related wetlands. (2) The proposed bridge spanning the LCD requires no permit as long as wetland areas are not disturbed during construction. Abutments must be placed outside of the wetland and in upland. No fill (even temporarily) can be placed within the wetlands or the OHW mark of the Relatively Permanent Waters (RPW). Relatively Permanent Waters of the US refer to waters that are un- navigable but are adjacent to waters of the US and flow for at least 3 months of the year. WestWater Engineering Page 2 of 5 July 30, 2007 (3) The irrigation ditch providing the existing pond with water is located on the upland terrace. In addition, the proponent can control the flow via a head gate and the flow can be entirely shut off. Based on this, we believe that the irrigation ditch is likely to be considered non - jurisdictional by COE, even thought all three wetland parameters are present. Therefore the placement of a culvert in the irrigation ditch would not require a permit. Pump test for the Wigger Well which is the supply well for the three one bedroom cabins and the two bedroom cabin for Phase 1. Using a peak demand of 1275 gallons per day (850 for the three proposed cabins and laundry plus 450 for the two bedroom cabin), the well pumping rate is 0.89 gallons per minute. The well tested at a rate of 7 gallons per minute. 2. The package sent to the Army Corps of Engineers regarding the use of the existing pond and the day use crossing. As stated in the letter, it is my opinion that no 404 permit is needed as no fill is going into the waters of the United States. I met with Mark Gilfillan yesterday regarding our findings. Mark indicated that it would be months before he could look at it as reports concluding that no permit is needed are the lowest priority. Maybe you could give Mark a call to see if he would give a verbal no permit or see if a letter between the Army Corps of Engineers and the Tolers committing the Tolers to comply with the Corps findings if a permit is needed would work. A brief description of the phases follows below. • Phase 1 - Build 3 - 1 bedroom cabins for rental, convert existing Wigger cabin to a 2 bedroom rental; create day use area, and use existing pond for fishing. • Phase 2 - Establish small convenience store for guests and provide boat rentals for guests. • Phase 3 - Build lodge and restaurant. Lodge would have a capacity of 48 guests. A more detailed project report is attached for your reference. The Garfield County Commissioners approved the Special Use Permit with conditions in 2004. One of the conditions was obtaining a 404 permit, if needed, for the day use area crossing and the existing pond. The existing pond is fed by an irrigation ditch that has a diversion point in front of the Toler property. Water flows in and out of the pond via the irrigation ditch. Fish that are in the pond are indigenous to the Colorado River. No changes are proposed to the existing pond or water delivery system. The pond is located in the southwest corner of the property. Please refer to the attached site plan, Sheet 1, for the location. The crossing for the day use area is labeled as "Day Use Access Road" on the Site Plan. The Tolers propose to build a bridge with abutments that are beyond the diversion canal banks. There is an existing log foot bridge where the day use road would go. See attached picture. The log foot bridge is 26 feet long including the section that is on the bank. The proposed bridge design shows a distance of 34 feet between the bridge abutments which places them several feet behind the bank. See attached bridge design, Sheet S-1. It is my opinion that a 404 permit is not needed for either use as no fill is being placed in waters of the United States. Do you concur with this assessment?
