D. there were present: · _...,Jo""hn,.._.M~art..,in,.,_ __________ ___, Commissioner Chainnan -"'L,iurv..,_· ~M.,c,.,C"'o'-"wn=------------'' Commissioner --'-T~re"'s,._i H'-""ou"-~p"-'t ___________ _,, Commissioner -""Mi""""'ch,.a,e,._l H-=ow"-"'ar"'d~----------' Assistant County Attorney _...,Je""an,....Al....,be,..n'"'"'· c.,.o'-------------' Clerk of the Board -"'E,.d.,Gr=ee""n.._ ___________ _, County Manager when the following proceedings, among others were had and done, to-wit: RESOLUTION NO. 2008-54 A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDITIONAL USE PERMIT FOR A HOME OCCUPATION TO CONDUCT THE SEWING OF PARACHUTES USED FOR BOATING WITHIN A PROPERTY DESCRIBED AS 1580 CHAIR BAR ROAD, SILT, GARFIELD COUNTY, COLORADO (CUP 1008) Parcel ID: 217916300653 WHEREAS, the Board of County Commissioners of Garfield County, Colorado (the Board), received an application for a Conditional Use Permit (CUP) for a Home Occupation from Linda and Donald Whilldin to conduct the sewing of parachutes used for boating within a property described as 1580 Chair Bar Road, Silt, Garfield County, Colorado and is also located within the Agricultural Residential Rural Density (ARRD) zone district; and WHEREAS, the Board held a public hearing on the 14th day of April, 2008, upon the question of whether the above described CUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said CUP; and WHEREAS, the Board, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following detennination of fact as listed below: I. That the hearing before the Board of County Commissioners was extensive and complete, that sufficient pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting; 3. That for the above stated and other reasons, the proposed Conditional Use Permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with Sections 3.02, 2.02.29, 5.03, and 9.02 of the Garfield County Zoning Resolution of 1978, as amended; NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Conditional Use Permit is hereby approved subject to compliance with all of the following specific conditions: I. That all representations made by the Applicant in the application, and at the public hearing before the Board of County Commissioners, shall be conditions of approval, unless altered by the Board of County Commissioners. 2. No retail or wholesale sales of any kind associated with the activities of the Home Occupation shall be allowed to take place at the property. 3. The Applicant shall obtain all necessary building and ISDS permits for any structures associated with the Home Occupation. 4. All operations of the Home Occupation shall be conducted within the accessory building (barn) as proposed. 5. The Home Occupation shall employ two (2) or fewer employees. 6. No signs advertising the Home Occupation may be placed anywhere on the subject property. 7. All outdoor lighting shall be directed downward and inward and shall not protrude outside the property boundaries. 8.
