ACKNOWLEDGMENT OF SATISFACTION OF SUBDIVISION IMPROVEMENTS
AGREEMENT
KNOW ALL MEN BY THESE PRESENTS that:
WHEREAS, Hawk Ridge, Ltd. (hereinafter "Hawk Ridge"), entered into a
Subdivision Improvements Agreement dated July 25, 1983, recorded in Book
631, at Page 121 as Reception No. 344086 of the Garfield County records on
July 25, 1983, for the improvement of the Hawk Ridge Subdivision
(hereinafter "Hawk Ridge"), and;
WHEREAS, the obligations of Hawk Ridge have been satisfied in full and
Hawk Ridge has requested the Board of County Commissioners of Garfield
County, Colorado (hereinafter "Board"), release Hawk Ridge from any
further obligation contained in the aforesaid Subdivision Improvement
Agreement.
NOW THEREFORE, at the request of Hawk Ridge and in consideration of
the premises, the Board hereby acknowledges the satisfaction of the
Subdivision Improvements Agreement entered into by Hawk Ridge and the
Board of County Commissioners of Garfield County, Colorado, for the Hawk
Ridge Subdivision, in the amount of $45,206.50

Leonard Bowlby has inspected the roads and found them to be acceptable
except for same minor settling at one utility crossing and cleanup of
some rock on the shoulder. These deficiencies have been corrected.

AGREEMENT
KNOW ALL MEN BY THESE PRESENTS that:
WHEREAS, Hawk Ridge, Ltd. (hereinafter "Hawk Ridge"), entered into a
Subdivision Improvements Agreement dated July 25, 1983, recorded in Book
631, at Page 121 as Reception No. 344086 of the Garfield County records on
July 25, 1983, for the improvement of the Hawk Ridge Subdivision
(hereinafter "The Property"), and;
WHEREAS, the obligations of Hawk Ridge have been satisfied in part and
Hawk Ridge has consented and agreed that the Board of County Commissioners
of Garfield County, Colorado (hereinafter "Board"), shall retain and hold
the sum of $45,206.50, which sum shall be security for performance of
items No. 15, 19, 20 and 23 listed on the Hawk Ridge Subdivision Final
Cost Estimates recorded in Book 631 at Page 125 as Reception No. 344086 of
the Garfield County Records of July 25, 1983.
NOW THEREFORE, at the request of Hawk Ridge and in consideration of
the premises and the prior receipt of the aforesaid sum, the Board hereby
acknowledges the partial satisfaction of the Subdivision Improvements
Agreement entered into by Hawk Ridge and the Board of County Commissioners
of Garfield County, Colorado, for the Hawk Ridge Subdivision, in the
amount of $104,774.50.

At the Feb. 14, 1990 Board of Directors meeting it was
approved for Jim & Jackie Daliman to transfer approximately
18,000 sq/ft from Lot 1 to Lot 7. This represents a strip of land
running north/south, approximately 30' x 592' to be added to the
east boundary of lot 7.

Dear Board Members:
My wife and I presently own Lots 1 and 7 in Hawk Ridge
Subdivision off of County Road 103 in Garfield County. Our
house, barn, and an outbuilding are all situated on Lot 7
but the access road to one of our outbuildings is presently
situated on Lot 1.
We now have a firm contract to sell Lot 1 if we can retain
said access road to our improvements on Lot 7. We therefore
request to amend the plat for Hawk Ridge Subdivision to
accommodate the boundary line adjustment proposed.
Previously, Lot 1 was .7 acre larger than Lot 7. With the
boundary line adjustment both lots will be approximately 6.5
acres each so we feel the impact on the subdivision would be
negligible.
We have presented our proposal to the Hawk Ridge Homeowners
Association Board and have received no objections.
We hope you will consider and approve our request.

Diligence:

for the Hawk Ridge Development, which is :served by plans for
Augmentation decreed January 17, 1983, in Care No. 82CW;6
and on August 2, 1983 in Case No, 82CW45.
During the diligence period (nov. 1982 through Nov. 1986)
the applicants:

test on the water line installed in the Hawk Ridge Subdivision and have
found that the materials and installation conform to the plans and
specifications prepared by our office and approved by the Colorado
Department of Health. The following items have been completed:

Please note that we have rechecked distances and found that the fire
hydrant at the southeast end of Orchard Lane is adequate to provide
fire protection to Lots 14,15,16,17, thus eliminating the need for the
hydrant at the beginning of Orchard Lane (Shown as F.H. #6 on General
Water System Plan). Ron Leach, the Carbondale Fire Chief, has been to
the site and approved this change.

This letter will confirm our telephone conversations regarding
this matter.
Resolution 82-255 concerning the preliminary plan of Hawk Ridge
Subdivision was recorded as Reception No. 333055 of the Garfield
County records. Resolution 83-289 regarding the final plat of
Hawk Ridge Subdivision was recorded as Reception No. 345429 of
the Garfield County records. In addition, a Subdivision Improve-
ments Agreement regarding Hawk Ridge Subdivision was recorded as
Reception No. 344068.
You have advised me that the Subdivision Improvement Agreement
regarding Hawk Ridge Subdivision includes all of the terms and
conditions of the resolutions dealing with the preliminary plan
and final plat of Hawk Ridge Subdivision. The Garfield County
Commissioners acknowledged satisfaction of the Subdivision
Improvements Agreement in a written document dated August 27,
1984. You have advised me that because the Subdivision Improve-
ment Agreement incorporates the requirements set forth in the
resolutions concerning the preliminary plan and final plat of
Hawk Ridge Subdivision, the Acknowledgement of Satisfaction of
the Subdivision Improvement Agreement by the County Commissioners
constitutes acknowledgement of completion of all public improve-
ments required by the terms and conditions of the resolutions
regarding preliminary plan and final plat referred to above.

is correct. The Acknowledgement of Satisfaction of the Subdivi-

NOW THEREFORE, at the request of Hawk Ridge and in consideration of the
premises and the prior receipt of the aforesaid sum, the Board hereby
acknowledges the partial satisfaction of the Subdivision Im•rovements
Agreement entered into by Hawk Ridge and the Board of County Co ssioners of
Garfield County, Colorado, for the Hawk Ridge Subdivision, in t e amourjt of
