When reviewing a plan and it's discovered that required information has not been provided by the applicant, this will result in the delay of the permit issuance and in proceeding with building construction. The owner or contractor shall be required to provide this information before the plan review can proceed. Other plans that are in line for review may be given attention before the new information may be reviewed after it has been provided to the Building Department. Please review this document to determine if you have enough information to design your project and provide adequate information to facilitate a plan review. Also, please consider using a design professional for assistance in your design and a construction professional for construction of your project. Any project with more than ten (10) occupants requires the plans to be sealed by a Colorado Registered Design Professional. To provide for a more understandable plan and in order to determine compliance with the building, plumbing and mechanical codes, applicants are requested to review the following checklist prior to and during design. Plans to be included for a Building Permit must be on draft paper at least lS"x 24"" and drawn to scale. I Plans must include a floor plan, a concrete footing and foundation plan, elevations all sides with decks, balcony steps, hand rails and guard rails, windows and doors, including the finish grade and original grade line. A section showing in detail, from the bottom of the footing to the top of the roof, including re-bar, anchor bolts, pressure treated plates, floor joists, wall studs and spacing, insulation, sheeting, house-rap, (which is required), siding or any approved building material. Engineered foundations may be required. Check with the Building Department. A window schedule. A door schedule. A floor framing plan, a roofing framing plan, roof must be designed to withstand a 40 pound per square foot up to 7,000 feet in elevation, a 90 M.P.H. windspeed, wind exposure B or C, and a 36 inch frost depth. All sheets need to be identified by number and indexed. All of the above requirements must be met or your plans will be returned. All plans submitted must be incompliance with the 2003 IBC, IPC, IMC and IFGC. Applicants are required to indicate appropriately and to submit completed checklist at time of application for a permit: 1. Is a site plan included that identifies the location of the proposed structure, additions or other buildings, setback easements, and utility easements showing distances to the property lines from each comer of the proposed structure prepared by a licensed surveyor and has the surveyors signature and professional stamp on the drawing? Slopes of 30% or more on properties must be show on site plan. (NOTE: Section 106.2) Any site plan for the placement of any portion of a structure within 50 ft. of a property line and not within a previously surveyed building envelope on a subdivision final plat shall be prepared by a licensed surveyor and have the surveyors signature and professional stamp on the drawing. Any structure to be built within a building envelope of a lot shown on a recorded subdivision plat, shall include a copy of the building envelope as it is shown on the finaZat with the proposed structure located within the envelope. LEASEHOLD PROPERTY DESCRIPTION Lessor, for and in consideration hereinafter specified to be kept and of the covenants and agreements performed by Lessee, its successors and assigns, has demised and leased and does hereby demise and lease to the Lessee, its successors and assigns, all of the real property situated in the County of Garfield and State of Colorado described in Exhibit "A" attached to and incorporated into this lease agreement by reference, together with a nonexclusive easement for ingress and egress to Lessee's facilities, which right of ingress and egress shall entitle Lessee, its employees, agents or invitees, to at all times, during the term of the lease, have a free and uninterrupted nonexclusive right of access to the leasehold premises over and across Lessor's property; and should such nonexclusive right of access be in any way abridged or interrupted, Lessee shall have the right to enforce this access right, if necessary, by court order; or in the alternative, Lessee shall have the option to forthwith terminate this lease, 1 In which case all obligations and liabilities upon each of the panies hereto shall cease and terminate. II. LEASEHOLD TERM. RENTAL. POSSESSION AND EXTENSION Lessee agrees w pay Lessor, at such places as shall be designated by the Lessor from time to time in writing, annual rent of the greater of Jla or of the gross revenues from all business conducted sm. or connected with Lessee's occupancy of the Property each calendar year. Gross revenues shall me an the amount of gross rents actually collected and received by Lessee from any subleases arising out of Lessee's operations on the Property. Rents shall become due and payable on January fifteenth (15th) on each year for the prior years rent. Lessee shall submit to lessor with each rent payment a statement of gross revenues received for that preceding year. In addition to the foregoing, lessee shall submit to lessor, within sixty ( 60) days following the end of each calendar year, a written unaudited statement of gross rents for the preceding year, signed by the Lessee. ·Provided, however, that on every anniversary date which is a multiple of Five (5) years of this Lease the minimum rental amount shall be increased ("Rental Increase") by an amount equal to 15% of the Rent in effect at the end of the previous period. Rent for any fractional period at the beginning or at the end of the Term or Renewal Term shall be prorated. Unless otherwise notified in writing, rent shall be payable to Lessor at 51 7 8 County Road 335, New Castle, CO 81647. The term of this lease shall be for 25 years commencing on the First day of January, 2002 or upon the start of construction of Lessee's Facilities whichever occurs first. The Lessee shall have the right to extend this Lease for three (3) additional five (5) year terms by giving Lessor written notice of Lessee's intention to do so at least six months prior to the end of the then current term. This lease is conditional upon Lessee obtaining construction approval from Garfield County Authorities. If said approval is not granted by the thirty-first (31) day of December, 2001 or if at an earlier date it is deemed unobtainable or unfeasible, at the sole discretion of Lessee, then this lease agreement shall terminate upon written notice to Lessor. 2 Lessee will pay Lessor Two Hundred Dollars ($200.00) to be applied to first years rents for time, not to exceed 120 days from the execution date of this agreement, to perform due diligence as to the feasibility of the tower location. Lessor shall permit Lessee during this time period, free ingress and egress to the Property by Lessee and its employees, agents and contractors to conduct structural strength analyses, subsurface boring. tests, radio frequency tests and such other tests, investigations and similar activities as Lessee,,may deem nrcessary, at the sole cost of Lessee. Lessee and its employees, agents, and contractors' shall have the right to bring the necessary vehicles and equipment onto the Property and the Surrounding Property to conduct such test, investigations and similar activities. Lessee shall indemnify and hold Lessor harmless against any loss or damage for personal injury and physical damage to the Property, Lessors Surrounding property or the property of third parties resulting from any such test, investigations and similar activities. If site is determined by Lessee to be unfeasible, Lessor will retain the Two Hundred Dollars ($200.00) and neither party will have any further obligation. Lessee operating thereto. IlL USES OF PREMISES shall use the Property for the purpose a Multiple-User Communication Facility Lessee has the right to erect, maintain of maintaining and and uses incidental and operate on the premises radio communications facilities, including without limitation utility lines, transmission lines, air conditioned equipment shelter(s), electronic equipment, radio transmitting and receiving antennas and supporting equipment and structures thereto ("Lessee Facilities"). In connection therewith, Lessee has the right to do all work necessary to prepare, maintain and alter the Premises for Lessee's business operations and to install transmission lines connecting the antennas to the transmitters and receivers. All of Lessee's construction and installation work shall be performed at Lessee's sole cost and expense and in a good and workmanlike manner. Title to the Lessee Facilities shall be held by Lessee. All of the Lessee Facilities shall remain Lessee's personal pro percy and are not fixtures. Lessee has the right to remove all Lessee Facilities at 3 its sole expense on or before the expiration or earlier termination of this Agreement; provided, Lessee rent payment are not in default and Lessee repairs any damage to the Premises caused by such removal and restores the premises to a condition similar to that prior to the installation of such Improvements. Lessee shall have the right to make such repans, modifications and improvements to its property located on leasehold premises, as Lessee, in its sole discretion, deems desirable. Lessee shall have the right at any time following the full execution of this Agreement to enter appropriate engmeering borings, other reasonably Facilities. upon the Propetty for the purpose of making and boundary surveys, inspections, soil test necessary tests and constructing the Lessee IV. GENERAL PROVISIONS A. TAXES. Lessor agrees to be responsible for the payment of real property taxes and special assessments on the leasehold property, as they shall become due. Lessee agrees that it shall be responsible for the payment of any personal property or ad valorem taxes which may be levied against the improvements placed upon the leasehold premises by the Lessee. B. INTERFERENCE. The Lessee will not, during the term of this Lease or any extension thereof, allow installation of any equipment that would interfere with the existing equipment at the site used for the reception and · transmission of communication signals. The Lessee will be allowed to add or modify equipment within the Leasehold Premises used in the reception and transmission of communication signals so long as those additions or modifications do not interfere with any other equipment, or transmission of signal, or reception of signal, that is in use on land now owned by the lessor, at the time the changes or modifications are installed. In addition the Lessor will not, during the term of this Lease or any extension thereof, allow installation of any equipment that interferes with the equipment as installed at the Lessee's Facility at the time the changes or modifications are installed. In either case the installation of new equipment by either 4 Lessor or Lessee shall be in such a manner as not to interfere with any other currently operating communication equipment located within the property controlled by the Lessor or Lessee. C. UTILlTIES AND CONDlTlONS. Lessee shall be responsible for the payment of all charges for utilities, and Lessee does hereby agree to indemnify and to save and hold harmless Lessor as to any liability for payment for utilities. This lease is expressly conditioned upon the avail ability to Lessee of sufficient electric 'power to maintain and operate any translator station located upon the premises, and should Lessee at any time be unable to obtain such electric power at reasonable costs during the term of this lease, or any extended term hereof, Lessee shall have the option to continue the lease or to forthwith terminate the lease, in which case all respective obligations and liabilities hereunder shall cease. D. RISK OF HARM OR LOSS. Lessee further agrees that the risk of loss with respect to any improvements, materials or equipment which it places upon the leasehold premises, shall be solely at the risk of Lessee, and Lessee agrees that it shall maintain its own insurance with respect to all improvements upon the leasehold premises including general liability coverage with a minimum limit of two million dollars ($2,000,000) and a minimum umbrella coverage of ten million dollars ($10,000,000). Lessee shall indemnify and hold Lessor harmless against any claim of liability or loss from personal injury or property damage resulting from or arising out of the use and occupancy of the Property by the Lessee, its servants, employees, or agents, excepting, however, such claims or damages as rna y be due to or caused solely by the acts of the Lessor, its servants or agents. A certification of liability insurance shall be provided to Lessor annually. E. DAMAGE OR DESTRUCTION. Lessor agrees that if the improvements placed upon the premises shall at any time during the term of this lease, or any extended term hereof, be destroyed by fire or other unavoidable casualty, to the extent of more than fifty percent (50%) of replacement replace such value, Lessee shall have the option to rebuild, repair or improvements at its' own expense, and to either continue to 5 lease, or to forth\\'ith terminate the least, in which case all respective obligations and liabilities hereunder shall cease. F. FCCAND FA<\ APPROVAL. This lease is further conditioned upon Lessee, at all times during the term hereof, or any extended term hereof, having a valid permit from the Federal Communications Commission (FCC) and if appropriate the Federal Aviation Administration (FAA) allowing Lessee to carry on its use and operation of the facilities on the leasehold premises and in the event that Lessee should at any time Jose its right to use said premises because of action taken by the FCC or FAA, this lease, at the option of Lessee and upon a ninety (90) day written notice to the Lessor, shall terminate. The provisions of Article III of this lease concerning Lessee's option to remove its improvements shall apply. G. ASSIGNMENT AND PARTIES BOUND. Lessor agrees that Lessee may assign this lease, without Lessor's consent, to any business organization affiliated with Lessee, or to any business organization with or into which Lessee may merge. Lessee may not assign this lease to any other person or business organization without the prior written consent of Lessor, which consent is not to be unreasonably withheld. No assignment shall be affective unless all rents have been paid to date of assignment. This ]ease shall be binding upon and inure to the benefit of the respective heirs, legal representatives, successors and assigns of each of the parties hereto. Tenant may freely sublease all or any part of the Property, including, but not limited to, ground space and tower space, and said subleases may use the easements for ingress, egress, regress and utilities. H. ACCESS. In the event that the Department of Wildlife or its successor terminates the traditional right to use the current access, the Lessor will provide a secondary access. This secondary access will be established rapidly and with no unreasonable delay on land owned by or in the control of Burning Mountain Land and Cattle, L.L.C. or its partners. 6 Lessor and Lessee agree that this lease has been made, entered into and delivered in the State of Colorado and that this lease shall be construed and enforced in accordance with the laws of the State of Colorado. Cleartalk 1600 Ute Avenue Grand Junction, Colorado 81506 Project No. 01-1313 May 23,2001 CONCLUSIONS The proposed tower should be founded on a rigid mat foundation (pad and pier) placed on the natural soils designed for an allowable soil-bearing pressure of 4,500 psf. The allowable soil-bearing pressure may be increased to 5,800 psf for transient live (wind) loads. Design and construction details pertaining to soil-relaTed feaTures of the project are presented in the text of the report. Scope of Study This report presents the results of a soil and foundation investigation for a proposed 125- foot three legged telecommunications tower locate'd at the Extension Cord site in Garfield County, Colorado. The report presents the subsurface conditions encountered at the site, recommended foundation type, allowable soil-bearing pressures, o.nd design and construction details. Field and Laboratoey Investigation One test pit was excavated at the approximate location (Figure 1 ). The test pit was located in the field by Cleartalk, Inc. The test pit was excavated with a backhoe to a terminal depth of 7.0 feet. An engineering technician logged the excavation. Composite samples were collected by the technician at depths specified by the geotechnical engineer. The samples were transported to the laboratory and examined by the geotechnical engineer. Laboratory tests, including moisture content, Atterberg limits, and percent passing the No. 200 sieve were performed on the samples. The result of the laboratory testing program is shown on the Test Pit Log (Figure 2) and Summary of Laboratory Testing (Table 1 ). Site Conditions The proposed tower site is located in the SW Y;, SE Y., Section 31, Townsltip 5S, Range 90 Win Garfield County, Colorado (see Figure 1). The site is situated on a steeply sloping ridge known as the Grand Hogback, which is comprised of sandstone and shale of the Mancos and Dakota Formations of cretaceous age. The site is scattered with gravel and boulder-size sandstone. The vegetation consists of native pinyon trees and sagebrush. The condition of the site at the time of the subsurface investigation is shown on the enclosed photographs. Subsurface Conditions Subsurface conditions as determined by the test pit consist of a clayey topsoil layer overlying silty clay to a depth of 6.5 feet. Below this depth, weathered cretaceous shale (claystones) was found to 7.0 feet. Refusal to excavation while using a backhoe was encountered at this depth. No groundwater was encountered in the test pit when the pit was dug. Red Mesa Consulting, Inc. Cleartolk Extension Cord Site Projoct No. 01-1313 . .--. These materials are medium moist and are moderately plastic; consequently these soils exhibit low to moderate swell characteristics upon wetting. The upper clays are stiff to very stiff with the consistency increasing with depth, The weathered shale (claystones) is hard to very hard. Proposed Construction We Wlderstand the proposed tower will be approximately 125 feet in height and will be a three-legged structure. The base reactions for the tower are as follows: Axial do'Mlload = 3 2 kips Horizontal shear = 25 kips Overturning moment = 2,500 kip-feet If loadings are significantly different from those described above, we should be notified to re-evaluate the recommendations contained in this report Foundation Recommendations Considering the subsurface conditions encountered in the test pit and the design loadings, we recommend the tower be supported by a rigid mat foundation. The following design and construction details should be observed for the rigid mat foundation system. (1) The rigid mat (pad and pier) should be placed on the natural soils at a minimum depth of 5 feet below the eKisting ground surface. (2) The mat should be designed for an allowable soil-bearing pressure of 4,500 psf (dead load only). (3) The soil-bearing pressure may be increased to 5,800 psffor live loads due to wind. ( 4) Uplift forces should be resisted by the weight of the rnat and compacted backfill over the mat. For design calculations, the unit weight of compacted backfill shall be taken as I 00 pcf. (5) We recommend that a Type II cement or a comparable sulfate-resistant cement be used in concrete exposed to the natural soils. Construction Considerations The excavation for the foWldation can be performed with conventional excavating equipment. Care should be taken when excavating the last few inches of excavation so as not to disturb the bearing stratum. All loose material should be removed from the bottom of the ex:cavation to the satisfaction of the geotechnical engineer. Surface Drainage The following drainage precautions should be observed during construction and maintained at all times: "' 2 Red Mesa Consulting, Inc. (2) Backfill around the foundation should be moistened and compacted to at least 95 percent standard Proctor dry density (ASTM D-698) within ± 2 percent of optimum moisture content. (3) The ground surlace surrounding the exterior of the footings should be sloped to drain away from the footings in all directions. Miscellaneous This report has been prepared in accordance with generally accepted soil and foundation engineering practices in this area for the use of the client for design and construction purposes. The conclusions and recommendations submitted in this report are based upon results reported by our geotechnical laboratory and from infon:nation obtained from the test pit excavation. The nature and extent of variations in the subsurface may not become evident until the foundation is excavated. If during construction, soil or groundwater conditions appear to be different from those described herein, this office should be advised at once so that re- evaluation of the recommendations may be made.
