WHEREAS, the Board of County Commissioners of Garfield County, Colorado, and the Airport Land Partners, Ltd. made application for the approval of an amendment to the Garfield County Airport Industrial Park Planned Unit Development Plan and zone district text, and WHEREAS, Garfield County Planning Commission held a public meeting on Wednesdaythe l lh of July, 2001 upon the question ofwhether the above described PUD Plan and zone district text amendments should be granted or denied, at which meeting the public and interested persons were given the opportunity to express their opinions concerning the approval of said PtlD Plan and zone district text amendments; and WHEREAS, the Board held a public hearing on Monday, the 20ft day of August, 2001 upon the question ofwhether the above described PUD Plan and zone district text amendments should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the approval of said PUD Plan and zone district text amendment ; and .41,| , (, lrll ,u) rilil liilr ilililrilil![il]lllt ilr llill illrill 587826 O9/O3/2OO[ 03:53P B12E3 P722 n RLSDORF 2 ot 6 R O.OO D O.OO GRRFIELD C0UNTY C0 WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. That the application is in compliance with the Garfield County ZorungResolution of 7978, as amended. For the above stated and other reasons, the proposed use, upon compliance with all conditions of approval, will be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. and; WHEREAS the Board has made the following determination of findings as listed below. The Garfield County Planning Commission reviewed the Application and recommended approval of the Application under certain conditions on July 1 l, 2001. The Board of County Commissioners established a date for public hearing on the Application for the PUD, which commenced on August 20,2001. Pursuant to evidence produced at the public hearing on this Application, the Board finds: The property owners adjacent to the property that is the subject of this Application received notification of the date, time, and location ofthe above- referenced public hearing by certified mail, sent at least fifteen (15) days prior to the commencement of the hearing. Notification of the public hearing was published in a newspaper of general circulation at least thirty (30) days prior to the commencement ofthe hearing. The substance of the mailed and published notification substantially informed interested parties of the subject matter and the location of the requested modification to the existing zoning. The Board of County Commissioners has jurisdiction to conduct the public hearing on the Application and render a decision thereon. The requested PUD Plan and zone district text amendments do not affect in a substantially adverse manner either the enjoyment of land abutting upon or t. aL. J. 4. l. 2. The hearing before the Board of County Commissioners was extensive and complete; all pertinent facts, matters, and issues were submitted; and all interested parties were heard at the hearing. All uses by right, conditional uses, minimum lot areas, minimum lot coverage, minimum set-backs, maximum height of buildings, and all other use and occupancy restrictions applicable to this PUD zone district text amendment are hereby approved by the Board of County Commissioners as set forth in the zone text attached hereto and incorporated herein as Exhibit A and the PUD Plan amendment attached hereto and incorporated herein as Exhibit B. NOW, TI{EREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfreld County, Colorado, that the Garfield County Airport Industrial Park PUD Plan is hereby approved. Public Administration facilities/buildings, Road & Bridge Administration, Operations and Storage facilities, Corrections facilities, Community corrections facilities, Publicly Owned Communications facilities, Public Utilities, Single Family and Multi-family housing for persons employed in any of the previous uses by right. Supplemental Standards: Any outside storage of vehicles or materials sourth of the Public Service Company easement will be allowed as a use by right. Any outside storage of vehicles or materials north of the Public Service easement shall be subject to the screening requirements of the City of Rifle. Privately run Community Corrections facilities shall: 1. lmplement one of the following three (3) alternatives: a. A County sheriffs presence within the facility; or b. A Sheriff Substation located on the Property; or c. The County or the operator of the facility will reimburse the City annually in advance, for the annual gross pay associated with the lowest paid police offtcer on the City of Rifle Police force. 2. Public or private transportation shall be provided for all work-release inmates. Objectionable Uses: Any use not listed as a permitted use. Minimum Lot Area: 20,000 sq. ft. Maximum Lot Coverage: More than one building may be put on a lot, provided not more than 90 percent of the lot is covered. Minimum Setback.
