DIRECTOR DETERMINATION
Amended Plat — Los Adobes, Lot 5
Dear Ms. Harriman,
BUILDING & PLANNING DEPARTMENT
This letter is provided to you as the owner of the above referenced lot within
Garfield County. The application submitted is a request to amend the plat for Los
Adobes Subdivision, Lot 5 to expand the building envelope. The Director
Determination is hereby issued, approving the request subject to the following
conditions:
1. That all representations of the Applicant, either within the application or stated
at the meeting before the Board, shall be considered conditions of approval.
2. That prior to scheduling the plat for Board of County Commissioner signature,
the applicant shall make the required changes itemized in a letter dated July
12, 2010.
3. Within 90 days of approval, the corrected Amended Final Plat shall be
submitted for final staff review, and upon final approval by the County the
mylar of the plat shall be printed and required signatures obtained by the
Applicant (Owner, mortgagee, taxes, title/attorney, applicant's surveyor).
Once submitted to the Planning Department the plat will be scheduled for
Board of County Commissioner signature and subsequent recording.
Recording fees shall be due and payable at that time

The Land Use Resolution requires notification to the Board of County
Commissioners for their review and potential call-up of the application for public

hearing. The Board has 10 days in which to request a public hearing on the
application after which time the mylar may be scheduled for Board signature.
The Board of County Commissioners may call-up the application for review
within 10 calendar days (on or prior to July 30, 2010). The timeframe
commences from the date of determination. The Amended Final Plat mylar
will be scheduled on the BOCC consent agenda for signature and
recording if no request for further consideration is received and once the
conditions of approval have been met.

I. DESCRIPTION OF THE PROPOSAL
The Applicant seeks to expand the platted building envelope on Lot 5 of Los Adobes
Subdivision. The expansion is requested due to the desire to construct two decks, one of
which will encroach upon the envelope by seven (7) feet and the second by ten (10) feet.
Staff has reviewed the Los Adobes Subdivision information and could not find areas of
hazard which would prohibit expansion of the envelope.

II. AUTHORITY
Section 5-306 of the Garfield County Unified Land Use Resolution of 2008, as amended,
allows amendments to final plats via administrative review. This process is reviewed by the
Director of Building and Planning who issues a determination on whether the application

complies with Code requirements. The Code does stipulate that an amendment may be
made to a recorded plat, if such amendment does not:
1) increase the number of subdivision Tots or dwelling units, or
2) result in the major relocation of a road or add new roads.
This request does not impact either of the above standards.
III. STAFF RECOMMENDATION
Approval of the building envelope amendment with the following conditions:
1. That all representations of the Applicant, either within the application or stated at the

RE: Amended Plat, Los Adobes Subdivision, Lot 5
Dear Lisa,
I have reviewed the proposed amended plat prepared by High Country Engineering and have
the following comments:
1. The plat notes must contain a statement regarding the applicability of the notes and
restrictions as shown on the Final Plat for Los Adobes, or the plat may simply include a
of the notes from the final plat.
2. The Los Adobes HOA signature block must be deleted.
3. The language in the lienholder's certificate varies from the required certificate language.
Please amend so that it is consistent with the required language.
4. The language in the title/attorney certificate varies from the required certificate language.
Please add in the language so that the applicant could utilize either a title company or an
attorney to complete this certificate.
Once these corrections are made to the plat please have your surveyor print a mylar of the plat.
You are responsible for obtaining the following signatures:
• Owner;
• Lienholder;
• Title / Attorney Certificate
• Surveyor;
• Certificate of Taxes Paid (treasurer)
