The Council of Better Business Bureaus, Inc. ranks land sales abuses high in the most prevalent deceptive commercial practices. Colorado officials recently cracked down on land development firms, andmany have had to curtail their activities. Misrepresenting current and potential value, utilities, facilities, the completion date, and generally making capricious oral promises. There is simply no substitute for seeing the land itself. However, federal law says that if you make an on-site inspection, you may be forfeiting your right to rescind any contract during the legal 48-hour cooling -off period; so don't sign even the most routine papers without a thorough examination. Also, investigate the developer. What has he done? For whom? What is his financial and ethical status? In its (report) HUD warns, "This report is not a recommendation or endorsement of the offering herein by the office of Interstate Land Sales Registration nor has that office made an inspection of the property, nor passed upon the accuracy or adequacy of this report or any promotional or advertising material used by the seller." re ar in rea ' ro ert ? Only a few firms, including ours, Valley Improvement & Development Corporation, an associate of Valley Farms Inc. Not through the mail. We are primarily a farming and ranching enterprise, and we have not opened up our land to the private buyer before. On the main stream of the Colorado River, Interstate 70 and the Denver and Rio Grande Western Railway — about an hour from Aspen and Vail. 11. Why are subdividing your l d? Although we have been ranching and farming the property for years, the cost of the land is now too great for this use. 12. Why do you think it is aood estate buy"g Because we are going to sell these large (some 20 acres) estates directly, without padding, without undue promotion, and without frills or fanfare, and we will transfer the savings to the buyer. 13. What protects my property after l buY r The development will be highly restricted. Our covenants are most stringent and protective to the buyer, which incidentally increases property values and assures architectural design consistent with the natural surroundings. 14. No chickens in the front y and ? Not even horses, although there is a stable on the property where horses can be kept. Also, there are facilities for storage of boats, snowmobiles, jeeps, horse trailers and the like. 15. What about recreational facilities There are none contemplated although there will be a common area to grow vegetables, access to the beautiful Colorado River, and green belts. Another ski resort is under consideration 20 miles away. 16. Will my property be warded`' Yes. By a full-time security guard or automatic security gates. 17. When I build, who will handle construction. We can help you select from the many qualified builders in this area. 18. What about resale? We do not recommend purchasing for resale, but property values here are certain to increase substantially. 19. Why shouldn't I buy in Aspen, Vail, or Steamboat? The grossly inflated land prices and the lack of privacy created by the crush of people there has caused a rush to the country. Here, you can "have your cake and eat it, too." 20. If I am unhappy, can I back out? Yes. By federal law you can cancel within the forty-eight hour cooling - off period. Further, under our contract you have a year to back out, or 72 hours after you have inspected the property, whichever comes first. 21. How can I get more detailed information. R. 1, Box 5D Carbondale, Colorado RE: MS -1, Bacteriological Water Sampling Dear Mr. Dixon: This letter is to acknowledge a telephone conversation between you and myself on July 7, 1972 concerning a report from this Department on a water sample submitted by Mr. Roy McPherson dated 6-30-72 but actually collected on July 1, 1972. The instant problem revolves around an entry on the laboratory report deprecating the test results because of the indicated time lag in running the sample. The report nevertheless indicated the sample to be safe, which should be accepted as the hest available information. In checking with our laboratory, I find that the stamped statement would not have been placed on your copy of the lab report if the date of July 1, 1972 had been on the form for the date of collection. Scientists feel that inordinate delay in running samples impairs the accuracy of the tests. In any event, the public water supply you are proposing will be disinfected and the sample is considered well within the range for satisfactory treatment by disinfection. For whatever weight the local officials may give the results of the single test, I would recommend that they not consider the results sent to you adversely. These wells are approximately within 1-',00 feet cf each other. The wells range in depth from 70 to 90 feet depending on terrain and in the case of the 12 inch well. and 8 inch well, which we can accurately measure, the static level is 30 feet. There is a pump in the third well prever`.ing us from accurately mea- suring the depth but as it is in the same pool, we are reasonably certain that the static level is the same. Prior to the purchase of these properties by Valley Farms, Inc. two of these wells were used on a daily basis for watering sheep and domestic purposes. It is the estimate of Mr. Bobby McPherson and his brother Kenneth McPherson that they were pumping in excess of one/ second foot per minute, from the larger well and of course, the domes- tic well was used constantly. This deep well pump (larger well) was removed, shortened and reused to pump three/second feet of Colorado River water on to the Mesa where our need for water was greatest. Three weeks ago we ordered a new submersible pump and paid in advance for underground power. As of this writing, Holy Cross, although they have promised us that the power would be available by Monday, July 3rd, they have notret their commitent . In summary, T Roger M.
