Dear Mr. McGregor,
This office is in receipt of Kent Jones' application for a five lot residential subdivision
on a 51 acre parcel near Carbondale. There is an existing residence and well on the parcel.
We understand that the water supply is to be the existing well, with Permit Number
158846, senring lot 1. The remaining four lots are to be served by new inhouse use wells
operating under a replacement plan using water provided by the Basalt Water Conservancy
District. Mr. Jones has contracted with the District for a total of 1.3 acre-feet annually to
augrnent these four new wells.
Under this proposal the well with Permit Number 158846 will continue to be the
only well on the 51 acres issued under Section 37-92-602(3) O) (ll), C.R.S., and this well
may continue to be used for fire protection, ordinary household purposes inside up to tluee
single family dwellings, the watering of domestic animals and irrigation of not more than
one acre of home lawn or garden.

irrigation or other uses allowed. The District's contract must be kept current and renewed
annually. The State Engineet's Office concurs with the District in that a Homeowne/s
Association must be established. If Mr. Jones decides to sell a lot without forming an
fusociation, a separate contract with the District will be required for each well. Each of
the well permit applications submitted to this office will be subject to statutory review
pursuant to Section 37-90-1.37(2), C.R.S., which requires that any new well permitted
under this section be located at least 600 feet from any existing permitted well.

The plat shows a pond on the proposed lot 4. The water supply for this pond has
not been identified. We recommend that prior to sale of lot 4, the applicant provide to the
county and to the Water Commissioner, a written statement identifying the water supply
for the pond and the intended operation of the pond.
If the conditions above are met, then this office has no objection to approval of the
final plat for the Goose Creek Subdivision. Should you have questions, please contact John
Schurer of this office.

Mr. Kent Jones has a contract with the Basalt Water Conservancy District for 1 .3 acre
feet annually. lt is my understanding that you have a copy of Mr. Jones', contract.
The contract allows Mr. Jones or a later assignee to augment the water diversions for
a four lot residential subdivision located near Carbondale in Area A of the District.
The District operates under a Substitute Water Supply PIan approved by the State
Engineer. The plan is designed to protect other water rights by releasing water from
nueOi Reservoir to augment otherwise out-of-priority diversions. The plan is
administered by the State Engineer's office and the Basalt Water Conservancy District
reports annually on al! contractees.
A water augmentation plan which includes many of the District's contractees is
pending in Case No. 87CW155. The proposed well(s) for the four lot subdivision are
not inciuded in this case but can be included in a subsequent case unless the owners
elect to obtain an individua! augmentation plan.
We believe that the Substitute Water Supply Plan provides a legal water supply for the
subdivision and ultimately a decreed water augmentation plan can be obtained.

The following comments are in response to the various items submitted as a portion of the
Final Plan application.
Final Plat
Section 5:22 . Requires the identification of all roads by specihc nilmes.
Section 5:24 (A) Requires that any mineral owners or mortgagees be identified on the plat.
Also, the power of attorney for Angelo Gulino should be recorded in
conjunction with the Final Plat.
Section 5:24 (#l) The attorney's certihcate differs from the required certihcate as shown in
the back of the Regulations.
Construction Drawings/Certification Letter
- The construction plans are not marked "Approved for Construction" as required.
- Certification letter is adequate.
Suhdivision Imfrrovements Agreement
- The two (2) separate agreements (tax and other) should be integrated, either wholly or
by reference.

Article II #3
Hite's role should be deflrned in accordance with the definition of "subdivider."
This dollar a:nount does not comply with the amount cited in the Belau letter. No
Security, or draft thereof, has been received to date.
All parties named in the agreement should be bound to make all payments. These funds
should be paid prior to the approval of the Final Plat.
As per the required dedication statement, the proposed interior subdivision road is
public, not private.
Also the Subdivision Improvements Agreement does not address the transfer of water rights.
Section 5.31 (B)Requires a provision for vacation of the plat by the BOCC. This should
be included in the Subdivision Improvements Agreement.
Protective Covenants
Article II #1 Any comrnercial or business use shall be subject to the applicable regulations of
the Garfield County zorungResolution. Mobile homes may be allowed on a
temporary basis subject to compliance with County zoning, building code and
sanitation regulations.
The proposed roadway shall be a public roadway. Maintenance standards
should be specified. There is no provision for enforcement to each lot. Usually,
a Homeowner's Association is responsible for maintenance of all improvements
within the subdivision. Also, there is no reference to maintenance and
ownership of drainage improvements.
Article III #l The language "whenever possible" needs to be eliminated. Also, language should
be included to state that all construction within a 100 year floodplain is
prohibited unless it is in conformance with Section 6: Floodplain Regulations
of the Zorung Resolution.

Article IV # I A lot line adjustment requires a modil'rcation of the subdivision plat as described
in Section 6 of the Subdivision Regulations.
The issue of transfer of water rights is not addressed in the covenants. This should be included.
I would also note that letter from the Division of Water Resources (enclosed) and the Basalt
Water Conservancy District both require that a Homeowner's Association be established. How
do you plan to address this issue?
The issue of ISDS maintenance is not addressed. There should be some provision to enforce
maintenance and compliance with County and State regulations.
