MillStreet #102 Aspen, CO 81611 DIRECTOR DETERMINATION Reference: Amended Final Plat - Lot 1, lce Minor Subdivision Garfield County File Number FPM5504 Dear Mr. Nieley, This letter is provided to you as the representative for Richard Moolick, the owner of Lot 1, lce Minor Subdivision, and Applicant for a requested lot line adjustment. The review for this application is Administrative in nature and therefore requires a Director Determination on whether to approve, approve with conditions, or deny the request. A decision is hereby issued regarding the request to amend the common lot line between Lot 1, lce Minor Subdivision and the adjacent unplatted, metes and bounds parcel. The Director Determination is to approve the application subject to the following conditions: L. That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval. 2. That prior to scheduling the plat for Board of County Commissioner signature, the Applicant shallcomplete the following required plat changes: a) Any comments received by the County Surveyor (comments are still pending); b) Change the title of the plat: Second Amendment to the Final Plat Lot 1, lce Minor Subdivision 3. That prior to scheduling the plat for Board of County Commissioner signature, the applicant shall submit a mylar signed by all required entities except the Board of County Commissioners, Clerk & Recorder and County Surveyor. 4. That the Boundary Line adjustment for Tax Parce! Number 2395-011-00-145 must be recorded in conjunction with recordation of this Amended Plat. 5. Within 90 days of this determination the Amended Plat shall be shall be signed by the Chairman of the Board of County Commissioners and recorded in the office of the Garfield County Clerk and Recorder. Fax: (970) 384-3470 l--- The Land Use Resolution requires notification to the Board of County Commissioners for their review and potential calFup of the application for public hearing. The Board review is for a period of 10 days after which the mylar may be scheduled for signature if there is no request for call-up to a public hearing. The Board of County Commissionens may call-up the application for review within 1O calendar days from the date of determination (on or before September 6, 2010). The Amended Final Plat nrylar will be scheduhd on the BOCC consent agerda for signature ard recording if no request for further consideration is received and once the conditions of appronal have been met.
