RE: Directors Determination for an amendment to the Final Plat for the Mineota
Estates, Filing 1, Lots 17, 18, and 19 (FPAA-6718)
Dear Cassia,
This letter is provided as notification that your request, on behalf of The Dixon Water
Foundation, The Discovery Foundation, and Jan Clayton Trust dated 12/17/04, for a
Director's Determination for an amendment to an approved Final Plat for the Mineota
Estates Subdivision to include the Dixon 160 Parcel with the Mineota Estates, Filing 1,
Lots 17, 18, and 19. The resulting acreage of these amended lots shall be 61.496 acres,
62.866 acres, and 82.709 acres, respectively. This application has been reviewed and
the Director has approved the application subject to the following conditions:
1. That all representations of the Applicant shall be considered conditions of approval
unless amended herein.
2. That prior to scheduling the Final Plat for Board of County Commissioner signature,
the Applicant shall complete the following required plat changes:
a) A monument shall be placed along the boundary line between Lots 18-A and 19-
A according to C.R.S. 38-51-105.1(c);
b) Add the approved final plat notes of the subdivision to the plat or reference as a
plat note that the final plat notes are still applicable and shall be adhered to;
c) Add a "Site Data Summary" that indicates the acreage of each amended lot and
total acreage of these lots;
d) Add "Deputy" to the Clerk and Recorders Certificate under the "By:" signature
line;
e) Under the signature line of the Surveyor's Certificate, add the name and address
of the surveyor and add the name of the subdivision in the underlined portion of
the first paragraph; and,
f) Verify the correct names of the Applicants, make versions if necessary.
3. As per Section 5-306 Amended/Corrected Subdivision Final or Exemption Plat, "An
Amendment or a correction may be made to a recorded Final Plat or Exemption Plat

if such amendment does not increase the number of subdivision lots or Exemption
Lots, result in a major relocation of a road or add one or more new roads " . The
access/private road shown on lots 17 and 18 is considered a road and not allowed to
be added through this review process. Amend the plat as follows:
a) Remove the access/private road from the plat;
b) Remove Plat Note # 2;
c) Revise Certificate of Dedication and Ownership certificate form on the plat
that presently reads "The owner(s) do(es) hereby dedicate and set apart all of
the streets and roads as shown on the accompanying plat to the use of the
Mineota Estates Homeowners Association, with the exception of the road
depicted on the plat running south of Seneca Drive which shall be for the
exclusive use of Parcels 17-A, 18-A, and 19-A,"
With the following language:
"The owners do hereby dedicate and set apart all of the streets and roads as
shown on the accompanying plat to the Mineota Estates Homeowners
Association for the use of the members and guests thereof, subject to the
right of all emergency vehicles to make use of such streets and roads under
all reasonable circumstance, and hereby dedicates to the public utilities...."
4. That prior to scheduling the plat for Board of County Commissioner signature, the
Applicant shall submit a mylar signed by all required entities except the Board of
County Commissioners, Clerk & Recorder and County Surveyor.
5. Within 90 days of this determination the Amended Plat shall be shall be signed by
the Chairman of the Board of County Commissioners and recorded in the office of
the Garfield County Clerk and Recorder. The Plat shall meet the minimum CRS
standards for land survey plats, as required by Colorado State Law, and approved by
the County Surveyor.
The ULUR requires notification to the Board of County Commissioners for their review
and potential call-up of the application for public hearing. The Board review is for a
period of 10 calendar days after which the mylar may be scheduled for signature if there
is no request for call-up to a public hearing. The call-up period shall expire on May 6,
2011. The Amended Final Plat will be scheduled on the Board of County
Commissioner's consent agenda after expiration of the call-up period and once the
conditions of approval have been met.
