I. BACKGROUND
The Board approved the preliminary plan for the May Fly Bend Subdivision in June 2002 which is
memorialized in Resolution 2002-51. The subdivision consists of a 40 acre property subdivided into
5 residential lots ranging from 3 — 4 acres in size located just outside Carbondale on County Road.
The Board signed the final plat and Subdivision Improvements Agreement (SIA) on September 9,
2002.
II. DESCRIPTION OF THE PROPOSAL
The Applicant requests the Board approve a modification to plat note No. 10 on the final plat. More
specifically, the first sentence of plat note #10 reads Building finished floors shall be designed a
minimum of 18" above natural grade. This was not an explicit condition of approval required by
the Board nor was it required by Staff during the public hearing process. It appears Sopris
Engineering added this language to the note in order to improve drainage of the building site.
Further, none of the lots in the subdivision are within the FEMA 100 year -flood plain.
The Applicant correctly points out that Section 2.02.09 ("building height") of the Zoning Resolution
of 1878, as amended, refers to measuring building height from "the undisturbed or natural ground
surface," and in this case, when these two stipulations are conjoined, the maximum allowable
building height is interpreted to be 23.5 feet (vs. 25 feet allowed by 2.02.09). This was not the intent
of the original plat note.
The Applicant requests the Board strike the first sentence of plat note 10, since the remaining
language of that plat note requires that a site-specific drainage plan be developed by a registered
professional engineer in the State of Colorado. Further, the Applicant proposes additional language
to the plat note to insure the intended drainage objectives are met. As a result, the new plat note No.
10 would read as follows:

minimum of one foot in ten feet in landscape areas, or three inches in ten feet for concrete or

asphalt areas. No basements will be allowed due to the presence of high ground water. At building
permit, a site specific study shall be conducted for individual lot development, foundation design,
grading, drainage and any scour mitigation from a registered professional engineer in the state of
Colorado.
III. STAFF RECOMMENDATION
The Applicant has provided all required documentation and has satisfied the applicable standards for
a plat amendment in that no new roads are created and no new lots are created as a result of the
request. Further, this is a correction to a plat note that was not required by Staff of the Board and
does not violate the approvals or regulations of Garfield County. Therefore, Staff recommends the
Board of County Commissioners, pursuant to Section 6:10 of the Subdivision Regulations of 1984,
as amended, approve this corrected plat request with the following condition:
1. That all representations of the Applicant, either within the application or stated at the meeting
before the Board, shall be considered conditions of approval.
