DESCRIPTION OF THE PROPOSAL The Applicant is requesting approval from the Board of County Commissioners to amend the Goose Creek Final Plat to 1) straighten the lot line separating Lots 3 and 5 (hereinafter the "Property") and 2) relocate the access point to Lot 5. The property is located on Blue Heron Lane (a private access easement off of County Road 100 Catherine Store Road) just east of Carbondale. Lot 3 will contain approximately 8.99 acres and Lot 5 will contain approximately 13.02 acres. At present, the access for Lot 5 is provided via a 30' private access easement which begins from Blue Heron Lane and meanders through the Goose Creek Subdivision providing access to Lots 2, 3, 4, and 5. As mentioned above, this plat amendment request includes providing a new access point into Lot 5 and eliminating the present access from Lot 3 as described above. Instead, the Applicant proposes to relocate the access to Lot 5 via a 20' pnvate access easement across an adjacent property to the west of Lot 5 owned by a third party who intends to purchase Lot 5 from the Applicant. It should be noted, the third party owns Parcels "D" and "A" of the Robbins Exemption (adjoining the subject Lot 5) and Lots "1A" and o'18" of the Goose Creek Subdivision. Staff has provided a map of the proposed private access easement that shows the adjoining parcels (owned by the third party) where the easement will cross to Lot 5 from the end of Blue Heron Lane. The proposed private access easement would begin from Blue Heron Lane, cross the third party's Parcels D and A and ending at Lot 5. II. REGULATORY AUTHORITY Section 6:10 of the Subdivision regulations states that an amendment may be made to a recorded plat, if such amendment does not 1) increase the number of subdivision lots or dwelling units, or 2) result in the major relocation of a road or add new roads. This request will not increase the number of subdivision lots or dwelling units and will only result in the addition of a private driveway (access easement) from a Blue Heron Lane (which is a private road that is connected to CR 100 ("Catherine Store Road") a public county road. Based on this information, Staff finds these standards are met. A copy of this application was referred to the Town of Carbondale; however, no comments were received. STAFF RECOMMENDATION The Applicant has provided all required documentation and has satisfied the applicable standards for a plat amendment. Therefore, recommends that the Board of County Commissioners, pursuant to Section 6: 10 of the Subdivision Regulations of 1984, as amended, approve this amended plat request with the following conditions: 1. That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval; 2. The Plat shall show that the original 10 foot gravel drive into Lot 5 from Lot 3 is eliminated. 3. Within 90 days of approval, the Amended Final Plat shall be reviewed (paper copy), then signed and dated (mylar copy) by the County Surveyor, than signed and dated by the Chairman of the Board and recorded in the Clerk and Recorder's Office of Garfield County. The Amended Final Plat shall meet the minimum CRS standards for land survey plats, as required by Colorado state law, and approved by the County Surveyor and shall include, at a minimum, the information outlined in Section 5:22 of the Garfield County Subdivision Regulations. IV. EXHIBITS The following exhibits are provided for further review and contemplation: a. Draft Amended Final Plat of the Goose Creek Subdivision; b. Goose Creek Subdivision Final Plat showing current access through the property; c. Vicinity Map for the Goose Creek Subdivision showing access from CR100; and d. Map of the proposed private access easement across Parcels D and A of the Robbins Subdivision Exemption (owned by the third party).
