In the creation of the Robinson Exemption and more specifically Parcel Five and Parcel Two an overlap occurred encroaching onto Parcel A. This Amended Final Plat will address the Issues between Parcel Five and Parcel A. Possibly a quit claim deed could resolve the Parcel 2 overlap without bringing that landowner into the amended plat process. Ed and Sheila Allen (Parcel 5) and Cecil Phillips (Parcel A) have agreed to a boundary line adjustment between their properties using an existing fence line as the new boundary line. This adjustment will give Cecil and additional 2.84 acres of existing pasture land. An amended plat will represent the boundary line changes to Parcel 5 of the Robinson SB-35 Exemption as well as to Parcel A of Resolution No. 81-50. In addition, the plat will serve to resolve deeded overlap issues between Parcel 5 and Parcel A and add in a previously quit claimed strip of land along the westerly boundaries of both parcels. GENERAL PROJECT DESCRIPTION The Applicant is planning to request an Amended Exemption Plat to allow for the conveyance of property from the Allen's lot to their neighbor to the north the Philips. The proposal would reduce the Allen's lot size from 8.6 acres to 5.8 acres, conveying 2.8 acres to their neighbor. The Philips property will increase from 2.1 acres to approximately 4.9 acres. The Allen property is Lot #5 of the Robinson Exemption and the Philips property is described in Resolution 81-50 of the Board of County Commissioners (approving a Subdivision Exemption for Rallo and Joanne Meeks) as Parcel A. No Subdivision Exemption plat was apparently filed or required for the Meek's exemption . The Robinson Exemption was a re-subdivision of the original Tract C of the Meeks Exemption approval. The net effect of the Applicant's request would be an "Amended Subdivision Exemption Plat for Lot #5 of the Robinson Exemption and an amended description for Parcel A of the Meeks Exemption". Some additional research of plats, surveys, and recording information will likely be required along with direction from the County Attorney's Office and County Surveyor's Office in order to finalize the exact format of the amended plat and legal descriptions. Update: Including the two properties on one amended plat is a preferred format for an amended plat application. Both property owners will need to be applicants, however, authorizations to represent can be provided between owners. The Applicant's surveyor also indicated that other minor boundary line adjustments or corrections affecting the properties could also be shown on the amended plat. The Applicant has represented that the area being conveyed is in agriculture and the new lot line configuration will not impact any existing improvements including homes, driveways, utilities, and fences. Submittal materials will need to include adequate improvement survey documentation to ensure that no non-conforming conditions result from the lot line adjustment. The Amended plat process may also require clarification of other survey corrections or adjustments including but not limited to the boundary line adjustment (Book 755 Page 274) along the west property line shown on the draft plat provided by the Applicant's surveyor. AND JOANNE MEEKS WHEREAS, Rallo H. and Joanne Meeks have petitioned the Board of County Connnissioners of Garfield County, Colorado, for an exemption from the definition·1of the terms "subdivis±on" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a)-(d), as amended, and the Subdivision Regulations of Garfield Coqnty Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of.a 42 acre tract described as follows: In document #217641 filed in the Office of Clerk and Recorder of Garfield County; Colorado, into 3 tracts of approximately 2, 3, and 37 acres each, more or less, which proposed divided tracts are more particularly described as follows: Tract A: A parcel of land lying in the SW~SE~ of Section 19 and in the. (in the State of Colorado and County of Garfield); and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, ARticle 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the impact created does not warrant a full subdivision review, and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reason- able probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivison" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a)-(d), as amended; NOW, THEREFORE, BE IT RESOLVED that the division of the above described tracts "A", "B", and "C", from the above described 42 acre tract is hereby exempted from such definitions and said tract maybe divided into tracts "A", "B", and "C" all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid subdivi- sion statutes and regulations; provided, however, that this exemption is granted on the condition and with the express understanding and agreement of the Petitioners that no further exemptions be allowed on said tracts "A", "B", and "C", and that a copy on the instrument or instruments of conveyance when recorded shall be filed with this Resolution.
