Re: Application for Amended Final Plat
To Garfield County Planning Department,
This is an application to modify a building envelope per the Amended Final Plat Review (re: 5-305
Garfield County Land Use and Development Code).
Karla Miller, is the owner of Lot 7, in the Roaring Fork Preserve Subdivision. Karla is asking for approval
for an Amended Plat proposal. The reason for the proposal is the reconfiguration of the existing building
envelope on Lot 7. The main driving force behind this request is the desire to construct a barn that will
serve the property without creating an additional drive way. You will find a 'proposed barn' location
drawn on the amended plat drawing.
Lot 7 has two envelopes, and is one of the four lots in the Roaring Fork Preserve, designated to have an
ADU (see final plat note #10). As the lot was developed, the ADU was built first by the original owner,
and was later purchased by Karla Miller. Karla's desire is to keep the northern building envelope (which
is to remain unchanged) free for the location of a future main house with the landscaping/driveway
areas associated with it. We are proposing to use the reconfigured southern envelope as the location of
the existing ADU, and the new horse barn. By doing this we can keep the existing driveway, with no
further curb cuts, as it is. This layout will be the most appropriate way to access both of these buildings.
Also, given the location of mature trees and vegetation on the property it is also an aesthetically more
desirable location for a ranch type 'out building' or barn. In this application we have included the
original CCRs and Easements (recorded 5/31/2002) and the First Amendment to the CCRs, dated
6/29/2006. In item #2 of the amended CCR document, it appears to allow barns to be built outside of
building envelopes, if allowed by the Garfield County. However, in our discussion with the county we
were told that it would require an amended plat to accomplish this. Our goal is to follow the easiest and
most direct process that allows Karla Miller to build a barn in this more appropriate location.

The proposal shows a reconfiguration of the existing building envelope which keeps the original size
(40,399 S.F.) with adjusted boundaries which will provide space to build a new barn to the North West
of the existing dwelling. In our evaluation of the logic behind the original configuration of this particular
building envelope, we can see no geographical, physical or hazard related reason for not including the
area to the North West, as we are proposing. In fact we believe it would be a good solution that would
not have a negative impact on the subdivision or any neighboring lots. This change has been discussed
and reviewed with the Roaring Fork Preserve homeowners association. In our discussions with the
board, we have arrived at the same conclusions that the barn would be inappropriate if located in the
grass meadow to the East, and is much more suited in the new proposed location. A letter from the
association is part of this submittal package. Thank you for your consideration in this matter.

Note: According to the Garfield County Assessor's office there are no separate mineral rights
ownership associated with this property. This application will not increase the number of lots. This
application does not result in a major relocation of a road and does not add any new roads. There will be
no changes to the existing drainage patterns, and will not affect the utility services to any other lots. The
purpose of the Amended Final Plat application is only to modify a building envelope and does not
correct any previous technical errors.
