Dear Mr. Pesnichak:
Thank you for your letter regarding your completeness review of the above referenced
application. The following addresses the numbered items in your February 19, 2016 letter.
1. In 2014, as authorized representative of Blue Heron Properties, LLC in its
application to amend the PUD plan for Ironbridge Phase II, Filings 1, 2 and 3, I arranged
for a mineral title search in order to comply with the mineral owner notice requirements
of the GCLUDC. The mineral title search revealed that title to the minerals underlying
the Ironbridge PUD lands, inclusive of the properties subject of the present application,
vested in James V. Rose in 1964 via the Mineral Deed recorded at Reception No. 225517.
Garfield County approved the PUD plan amendment via Resolution 2014-14.
For purposes of the present application, my Firm confirmed that James V. Rose or
his successors had not conveyed the mineral estate to any party subsequent to the date of
the 2014 Blue Heron Properties application, February 14, 2014, and is the current owner,
as of the date of the current application February 16, 2016.
2. Attached is a revised application which includes a new signature page for Aspen
Signature Homes of Ironbridge, LLC.
