The proposed rezoning lies within district " 1b", City/Subdivision with central water and
sewer. This designation is based on City water and the West Glenwood Sanitation
distriot sewer.
DESCRIPTION OF THE PROI'OSAL:
A. Site Description: The property straddles Mitchell Creek, with thgrryajority of
the property on the easL sicle of the creek. (See map & request O1{pfhe site
topography slopes into the oreek bottom with slopes ranging from 5olo to over
40%. With the majority ol'the property being steeper slopes. The native
vegetation consists primarily of grasses, sage brush and oak brush on the gentler
slopes and pinon and juniper vegetation on the steeper slopes.

t listory oltlre Proposal:'fhe Mitchell Creek PUD was approved in 1982, with
a total of 29 dwelling units and in two phases. The hrst phase consisted of 22
clwelling units on a cul-de-sac accessing direotly onto C.R. 130 (Donegan Rd.).
'I'he second phase consisLed olseven (7) dwelling units that accessed onto C.R.
132 (Mitchell Creek Rd.). T'he lirst {-rling of the PUD was final platted in 1982,
and the second filing wits platted in l9tt7. Another owner of the second filing
had the property platted to a single lot within the PUD, rather than plat the
seven lots approved al" the Prelinrinary Plan.
MAJQR ISSTTES & CONCIIITN$.
A. Z<trrirtg: Sinco this is a re(luest to "rerlroveorrelease" ttre provisions of the
Mitchell Creek PUD, the recprest is subject to the lollowing findings contained
in Section 4.12.03 ol'the Garlleld County Zoning Resolution:

the PUD to rnaintain and enforce those provisions at law or in equity,

County, lbllowing a public hearing called and held in accordanoe with
renroval or release is oonsistent with the effrcient development and

a special benefit upon any person.
'I'lte properl"y owners in tlre Filing I of the Mitchell Creek PUD have been
reclttested to support the proposecl rezoning. Their consent is necessary to meet
tlle above note criteria regarding their rights will not being affecLecl. Acljoining
property owners and owners of property across Lhe street should not see and
detrinrental all-ect, since the rezoning to A/R/R does not oreate separate interests
beyond those thttt ah'eitdy exist ancl is lhe same zoning in place lor all other
property in thearea. Any subdivision aotion wor-rld besubjmt to lull subclivision
re view and the associatecl noticing recluirements whicli woulcl give neighbors the
opportunity to conrntent on any proposal.
Anotlter zoning issue is the recluiren.renl. thaL a PUD have at least 257.r open
space. Iriling I has a total ol 15.0 acres of open space and 8.112 acres of single
lirnrily lots ancl roadway. 'fhe open spaoe area is 63,y, of the hrst filing, thus
the reduction ol- the open space area contained in the sec;on<l hling area will not
create a conflict with the IrtJD requirements.

B. Suhdivision Regulations - On September 13, 1995, the Planning Commission
reviewed a Sketch Plan lor the proposed redivision of the property into three
lots. Enclosed for your review is the Staffcomments and Planning Commission
comments made at the meeting and a letter-fron the Glenwood Springs
Department of Enrergenoy services on pages ?A.f 24 -23
TV. PROPOSED FINDINGS
L That the application submitted met the requirements ol' Section I 0 of the
Garfield County zoning Resolution of 1978, as amended.
That the public hearing belore the Board of County Commissioners was
extensive and complete and that all pertinent facts, matters and issues
were submitted, and that all interested parties were heard at the meeting.
That the proposed PUD removal does not affect the rights of the
residents, oc;cupants and owners of the PUD to maintain and enforce
those provisions at law or in equity.
That the proposed PUD modihcations are consistent with the efficient
development and preservation of the entire PUD and does not affect in
a substantially adverse manner either the enjoyment of land abutting
upon or across a street from the PUD, or the publio interest and is not
granted solely to confer a special benellt upon any person.
IV.RECOMMENDA'IION
The Planning Commission recommended APPROVAL of the proposed zone district
amendment flrom Planned Unit Development to A grioultural/Residenlial/Rural Density
on August 9, 1995.
