All of the above properties are homes that were constructed several years ago in Canyon View Village in Battlement Mesa, Colorado. These homes are now in need of new shingles. Canyon View Village is an HOA community. As is common «ith many HOA communities, the Canyon View Homeowners Association, Inc., is solely responsible for the repair or replacement of the roofs. This is covered in Article VIII, "Exterior Maintenance", Paragraph 1 of the Declaration of Covenants, Conditions, and Restrictions of Canyon View which was filed with the County Clerk on August 25, 1993. This section states, in part: "...the Association shall provide, to the extent and with such frequency as determined by the Executive Board in its discretion from time to time: landscape maintenance on the exterior of the Units (to the extent that such Landscaping was installed by or at the direction of the Declarant in its development and construction of the Common Interest Community); exterior maintenance on the structures on each Unit, including paint, repair, replacement and care of roofs, gutters, downspouts, exterior building surfaces, and walks, but excluding exterior doors (except painting), window screens, and windows or other glass surfaces; maintenance, reasonable repair (but not replacement) and servicing of evaporative coolers; and removal of snow and ice on the front walks and sidewalks." These roofs are being replaced at the expense and direction of the Canyon View Homeowners Association Board of Directors and the undersigned, as Association Manager of Canyon View Homeowners Association, is directly in charge of directing this work.
