The Town of New Castle's water treatment plant is located outside the Town limits in unincorporated Garfield County. The Town plans to expand the plant and has requested that the County waive any building permit fees, plan check fees, inspection fees, and other related fees normally charged by the County for the construction of the plant expansion. The County has agreed to waive all these fees. Additionally, the Town and the County have agreed that the Town will act as the County's agent and issue a building permit for the expansion pursuant to the Uniform Building Code and other Uniform Codes adopted by the County (but not modifications to such Codes that may have been adopted). The Town will ensure that the plant expansion was constructed in conformance with those codes (except for the Electrical Code for with the State handles inspections) and the approved plans and will issue a certificate of occupancy in the County's name as appropriate. In short, the County will utilize the Town as an agent of the County to permit, issue a certificate of occupancy, supervise and inspect all aspects of the current construction relating to expansion of the New Castle water treatment plant. In consideration, the Town will indemnify and hold the County harmless from any and all claims, including reasonable attorney fees and costs, that may occur as a result of the negligence of the Town's officials or employees in performing their role as anent for the County as outlined in this letter agrcenuent. The set of drawings, attached, indicate the scope of the proposed project for the expansion of the New Castle water treatment plant. As you may recall, the New Castle water treatment plant is located in Elk Creek Subdivision approximately one mile northwest of the Town limits. The parcel is described in Book 32 at Page 503, in the Clerk & Recorder's records. The parcel is ± one acre. The proposed expansion will occur in an easterly direction of the existing plant building, maintaining the length of the plant building and adding a 40 -foot building footprint. It is the intent of this letter to request, since the Building Permit review process is technically in the jurisdiction of Garfield County, that the Town of New Castle Building Inspector provide the necessary building plan review and inspections for this project. We intend to send this project to bid on February 12, with construction beginning either the third of fourth week of February. We anticipate completion of the project in mid to late April. If you concur with the Town's request to provide its own in-house building plan review and inspection, I have provided a signature line for you to provide that authorization. Otherwise, if this is a problem, we would appreciate having the opportunity to sit down with you to discuss this matter further. As you may recall, the New Castle water treatment plant is located in Elk Creek Subdivision approximately one mile northwest of the Town limits. The parcel is described in Book 32 at Page 503, in the Clerk & Recorder's records. The parcel is ± one acre. The proposed expansion will occur in an easterly direction of the existing plant building, maintaining the length of the plant building and adding a 40 -foot building footprint. It is the intent of this letter to request, since the Building Permit review process is technically in the jurisdiction of Garfield County, that the Town of New Castle Building Inspector provide the necessary building plan review and inspections for this project. We intend to send this project to bid on February 12, with construction beginning either the third of fourth week of February. We anticipate completion of the project in mid to late April. If you concur with the Town's request to provide its own in-house building plan review and inspection, I have provided a signature line for you to provide that authorization. Otherwise, if this is a problem, we would appreciate having the opportunity to sit down with you to discuss this matter further.
