GENERAL PROJECT DESCRIPTION RMS would like to purchase the "Equestrian Lot" in the AA PUD to construct a public charter school on the lot. Access to be provided by CR 1o0; water to be provided by an existing AAE HOA water system; waste water will be provided the existing Ranch at Roaring Fork Subdivision. Total student count is approximately 325 to 350 in ages that range from pre-school to grade 8. Lot size is approximately 15 acres and is relatively flat. In order to receive significant grant money from the State, the State has suggested the applicant seek a "regular" zoning designation instead of the current PUD designation in which the property is currently subject. The applicant would like to amend the Preshana PUD (recorded under Reception #405376, 521511, 559691, and 562197) to remove the Equestrian lot from the PUD and subsequently rezone the property Rural. The Director has determined that the PUD Amendment will be a Substantial Modification due to the scope of the request and will therefore require a new application and submittal of the required materials. II. REGULATORY PROVISIONS APPLICANT I5 REQUIRED TO ADDRESS Garfield County Unified Land Use Resolution Sections: Section 4-112 and Section 6-201 of the Unified Land Use Resolution of 2008, as amended. Ill. REVIEW PROCESS The process to accommodate these requests shall require an amended Final PUD (6-201) and a rezone (4-113) process pursuant to the ULUR 2008, as Amended. A. Pre -application Conference. B. Application Submittal. C. Determination of Completeness. D. Schedule Public Hearing, provide documentation regarding notice requirements. E. Additional Copies requested and sent to referral agencies. F. Evaluation by Director/Staff resulting in a Staff Report to the Planning Commission. G. Public Hearing before the Planning Commission, resulting in a recommendation for approval, approval with conditions or denial. H. Public Hearing before the BOCC, resulting in a final approval, approval with conditions or denial. I. Revision to Official Zoning Map. J. Recordation. IV. PUBLIC HEARINGS AND NOTICE Public Hearing notices shall be posted, mailed and published pursuant to Section 4-101.E. SUBMITTAL REQUIREMENTS Due to the nature and scope of this request, the Director has modified the application materials that will be required to be submitted. This Rezone request will require the following application materials, more fully described in Section 4-203: A. General Application Material B. Vicinity Map C. Rezoning Justification Report In addition, the PUD Amendment will require the following application materials, more fully described in Section 6-301. This list has a number of application materials that have been waived based on the decision of the Director due to the limited nature and scope of the proposed amendment. What follows is the list of submittals that are required: A. Written description of the Amendment B. Written justification on how the proposed amendment meets the PUD Approval Standards as listed in Section 6-202. C. Final PUD Plan L Site Plan ii. Internal street circulation and access plan iii. Covenants, Conditions, Restrictions iv. PUD Development Guide (with proposed revisions) VI. APPLICATION REVIEW FEES This application will be subject to the following fees and deposit requirements: Planning Review Fees: $ 300 PUD Amendment $45o Rezoning -- District Amendment Pius any additional Staff time charged at staff hourly rate of $40.50 Referral Agency Fees: $ (N/A) County Surveyor: $ioo per sheet Recordation: $ ii (-St page), $io each additional page Total Deposit: $750 General Application Processing Planner reviews case for completeness and sends to referral agencies for comments. Case planner contacts applicant and sets up a site visit. Staff reviews application to determine if it meets standards of review. Case planner makes a recommendation of approval, approval with conditions, or denial to the appropriate hearing body.
