At a regular meeting of the Planning Commission for Garfield County, Colorado, held at the
Garfield County Plaza Building, 108 8th Street, in Glenwood Springs, Colorado, on Wednesday, the
24h day of October, 2012, there were present:

RESOLUTION NO. PC -2012&
A RESOLUTION TO MEMORIALIZE THE PLANNING COMMISSION'S DECISION ON A
LOCATION AND EXTENT APPL[CATION, PUSUANT TO C.R.S. § 30-28-110, FOR THE
ROSS MONTESSORI SCHOOL.

Recitals
A. Garfield County is a legal and political subdivision of the State of Colorado for which the
Board of County Commissioners is authorized to act.
B. Pursuant to law, the Board of County Commissioners of Garfield County has appointed the
Garfield County Planning Commission (the Commission).
C. The Ross Montessori School on behalf of Trend Investments, LLC has applied to the Plan-
ning Commission for a Location and Extent review of the proposed Ross Montessori School located
on parcel 239131217048 at 3275 County Road 100, Carbondale, Colorado, more specifically Aspen
Equestrian Estates Subdivision, Equestrian Lot of 15.2 acres. The proposal includes improvements
itemized and graphically depicted in attached Exhibit A
D. Pursuant to Section 4-1 10 of the Garfield County Unified Land Use Resolution of 2008, as
amended (ULUR), and C.R.S. § 30-28-110(1)(a) the Planning Commission is required to review the

location and extent of the proposed improvements to determine whether the those improvements are
in general conformance with the County's Comprehensive Plan.
E. The Application for Location and Extent Review is being reviewed pursuant to Section 4-
110 of the Garfield County Unified Land Use Regulations of 2008 because of the construction and
use of an institute charter school on the subject property is exempt from the provisions of the Aspen
Equestrian Estates Subdivision PUD, pursuant to CRS 22-32-124(1.5)(a) & (b).
F. In accordance with state law, the Nanning Commission has adopted a comprehensive plan,
currently Comprehensive Plan, 2030, as amended.

G. The Planning Commission opened a public hearing on October 24, 2012 upon the question g o
of whether the proposal is in general conformance with the Comprehensive Plan. t w

1. The Planning Commission, on the basis of substantial competent evidence produced at the %Nag
aforementioned hearing, has made the following determinations of fact: 80
1. That proper public notice was provided as required for the hearing before the Planning rkw
Commission. io
2. That the hearing before the Planning Commission was extensive and complete, that all a
pertinent facts, matters and issues were submitted or could be submitted and that all in- w a
terested parties were heard at that hearing. m°C-"
H. The Planning Commission closed the public hearing on October 24, 2012 to make a deci-
sion on the request.
3. That for the above stated and other reasons, the Land Use Change Permit for a Location
and Extent is in the best interest of the health, safety, and welfare of the citizens of Gar-
field County.
4. That the application is in general conformance with the Comprehensive Plan 2030, as
amended.
5. That the application is in conformance with Section 4-110 of the Garfield County Uni-
fied Land Use Resolution of 2008, as amended.
RESOLUTION
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of Garfield County, as
follows:
A. The foregoing Recitals are incorporated by this reference as part of the resolution.
B. The location and extent request for the Ross Montessori School is approved.
