BOCC 02t02t09 FJ TYPE OF REVIEW APPLTCANT(S) LEGAL DESCRIPTION GENERAL LOCATION (Amended Final Plat Terri Patrick Lot 1 and Silt Heights Drive Right-of- Way of the Silt Heights Subdivision Tzway between Silt and Rifle on CR 259 north of l-70 I l \\I. DESCRIPTION OF THE PROPOSAL The Board of County Commissioners approved the Si[ Heights Final Plat on March 17, 2008 which is recorded with reception no.744652. During the initial construction process for the entrance of the Silt Heights Drive from CR 259, the contractor enlarged the actual road-way onto Lot 1 and beyond the scope of the design of the approved right-of-way. This was done to better accommodate the access point from the original approval. However, in order to legally accommodate this relocated road, the icant filed this Amended Final Plat applica the redesigned right-of-way which also slightly modified t[e bod II. STAFF COMMENTS / CONCERNS Staff has reviewed this application and found it to be in compliance with the standards in Section 6:10 of the Subdivision Regulations of 1984, as amended, This review included a review of the "As-Builts" by the County Project Engineer. III. AUTHORITY Section 6:1 0 of the Subdivision Regulationslffites that an amendment may be made to a recorded plat, if quqh amendment does no(_!)increase the number of subdivision lots or dwelling units, qf 2)jesult in the major relocation of a road or add new roads. This request will not result in ilther of the two aforementioned standards. [Please note, this application is being reviewed underthe Subdivision Regulations of 1984, as amended (also known as the "Old Code") because it was found to be technically complete by December 31, 2008 as required by the Board.l IV. STAFF RECOMMENDATION Staff recommends that the Board of County Commissioners approve this amended plat request with the following conditions: \\\ .1 Amended Final Plat BOCC - 02/02/09 Page 2 1. That all representations of the Applicant, either within the Application or stated at the meeting before the Board, shall be considered conditions of approval. 2. Within 90 days of approval, the Amended Final Plat shall be reviewed (paper copy), then signed and dated (mylar copy) by the County Surveyor, than signed and dated by the Chairman of the Board and recorded in the Clerk and Recorder's Office of Garfield County. The Amended Final Plat shall meet the minimum CRS standards for land survey plats, as required by Colorado state law, and approved by the County Surveyor and shall include, at a minimum, the information outlined in Section 5:22of the Gaffield County Subdivision Regulations. V. RECOMMENDED MOTION "l move to Approve the Amended Final PIat Application for Lot 1 and the Silt Heights Drive Right-of-Way of the Silt Heights Subdivision with the conditions set forth by Staff."
