Gentlemen: This will confirm that the County has approved the amended Los Amigos Planned Unit Development on October 19, 1981 subject to our meeting the requirements of the County Road Supervisor for improvements on County Road 114. Mr. Bowlby's concurrence as to the actual road work is reflected below by his signature. The physical, financial and timing details are set forth herein- after and shall constitute the obligation of the Los Amigos P.U.D. and its subsequent subdivisions for improvements on County Road 114, all of which have been reviewed by Mr. Bowlby. The improvements will be on the portion of the road from "Deadman's Curve" to the main P.U.D. access road. Improvements will consist of widening the travelled roadway to 24' with 2' shoulders (minimum 6" of aggregate base course and chip/seal surface), provision of drainage ditches along the roadway and cut slopes consistent with the excavated material, and removal of trees which interfere with sight distance. All improvements will be subject to design and filed approval by Leonard Bowlby. The improvements will be completed prior to final plat approval for the last Phase I filing, consistent with the P.U.D. application. We had driven and discussed that part of the road from the sharp curve (Deadman's Curve) to the entrance of the Los Amigos PUD. You had two concerns about the road. The first and most serious, and the one which would have the highest priority, is widening of the road and improvement of site distance for improved safety. The desired roadway is a 24' hard surface (chip and seal) with 2' shoulders and adequate drainage and sideslopes; we also discussed removal of trees on the one right hand curve (downhill side) which were within the sideslope area. The second concern was the short section of steep road just before the PUD entrance. The concern here is with the difficulty drivers experience during periods of snowfall, that is, it is not a normal safety concern. Visual observation in the field indicates that there was generally adequate site distance over the crest of the hill for stopping, but obviously not for passing. Although we did not discuss the specific improvements to be made, it would appear that reducing the grade to the County standard of 8% and providing the cross-section as stated above would be the logical criteria. Should I have not stated any of your observations correctly, please correct those in error so that I will be able to present this information accurately at the Commissioner's Meeting. I wish to advise you that Building Field Inspector, James McMurrey and Road Department Foreman reviewed the Los Amigos road chip and seal improvements. In the matter of Los Amigos Ranch subdivision #2 preliminary plat and the requirement for improvements to County Road 114: As I understand it, there is a cash figure in lieu of work to be done. I would much prefer that they be required to post a performance bond, and that they do the actual improvements under our supervision. All improvements will be subject to design standards and approval by Mr. Bowlby. The improvement engineering details will be submitted at the preliminary plat of the first phase. Improvements are scheduled to be completed prior to the final plat approval for the last Phase I filing, consistent with our P.U.D. application. Our estimated cost of such improvements is approximately $32,700.00. Pursuant to our discussions on November 23, 1981, this letter will serve as a commitment for Los Amigos Ranch P.U.D. to do the above enumerated improvements within the timing set forth. Pursuant to our discussions on that date, it was decided by the Commissioners that in the event the Commissioners desired that these improvements not be done, that Los Amigos Ranch would contribute the sum of $32,700.00 at the time of preliminary plat to a road improvement fund established by the County for County Road 114 on the basis of a cash in lieu of improvements program. Los Amigos Ranch, by this letter, agrees to this alternative and will deposit said monies if requested to do so by the Commissioners in lieu of completing the improvements enumerated hereinbefore.
