WARRANTYDEED
For good consideration, AIRPORT LAND PARTNERS LIMITED, a Colorado limited
partnership ("Grantor"), whose address is 312 Airport Business Center, Suite A, City olAspen,
County of Pitkin, State of Colorado, does hereby sell, deed and convey to the GARFIELD
COUNTY BOARD OF COUNTY COMMISSIONERS ("Crantee"), all the real property
situate, Iying, and being in the County of Garfield, and State of Colorado, as described on
Exhibit "A," attached hereto and incorporated by this relerence (tho "Properly").
TOCETHER with all and singular the hereditaments and appurtenances thereto
belonging, or in anywise appertaining, and the reversion and revisions, remainder and
remainders, rents, issues, and profits thereof, and all the estate, right, title, interest, claim, and
demand whatsoever of Orantor, either in larv or equity, of, in, and to the above bargained
premises, with the hereditaments and appurtenances.
GRANTOR, for itself and its heirs, hereby covenants with Grantee, its heirs, and assigns,
that Crantor is lawfully seized in fee simple of the above-described premises; that it has a good
right to convey, that the premises are fee from all encumbrances, that Grantor and its heirs, and
all persons acquiring any interest in the property granted, through or for Grantor, will, on
demand of Grantee, or its heirs or assigns, and at the expense of Grantee, its heirs or assigns,
execute an instrument necessary ofthe further assurance ofthe title to the premises that may be
reasonably required, reserving unto crantor all oil, gas, and other minerals, title to which has not
been severed or otherwise separated, and subject to easements, exceptions and reservations in
place.

bargained premises in the quiet and peaceable possession of Grantees and Grantees, heirs,
successors, and assigns, against all and every person or persons lawfully claiming the whole or

Affidavit in accordance with the Garfield county Land Use and Development code.

6) We hereby represent that the boundary line adjustments, made reference to herein, will
not cause the loss of access by road or to utilities to any of the properties involved, except
as access to the properties to be added to the Airport may be limited or denied jn
accordance with the Airport Master Plan.
7) We. hereby represent that the boundary line adjustment being made will not result in any
of the parcels or tots involved being less than the minimum lolsize in their applicable zoni
district allowed as a result of the boundary line adjustment or create any non-conforming
setbacks for any existing structures,

Clerk and Recorder.

WHEREAS, a Petition for Disconnection was filed with the City in August 2015 by the
Board of County Commissioners of Garfield County, Colorado, the sole owner of the territory
hereinafter described ('jOwner" or the "County''), excluding sheets and alleys; and
WHEREAS, the County's acquisition of certain real property adjacent to the Garfield
County Airport and thb Garfield County Road and Bridge Facility comprises territory owned by
the County but in the City's jurisdiction and to be used in conjunction with property in the
County' s jurisdiction, creating undesirable mixed jurisdiction; and
WHEREAS, C.R.S. $31-12-501, et seq., sets forth the procedure required to disconnect a
tract of land within and adjacent to the boundary of a city; and
WHEREAS, the Rifle City Council does hereby find and determine approval of the
Petition for Disconnection of said territory to be in the City's best interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COLTNCIL OF THE CITY
OF RIFLE, COLORADO, THAT:
l. The foregoing recitals are incorporated herein as if set forth in full.
2. That the tracts of land described in the Petition for Disconnection and further
described as Airport Parcel A, Airport Parcel B, Airport Parcel C and Boot Parcel A on the Land
Survey Plat attached hereto as Exhibit A is hereby disconnected from the boundary of the City of
Rifle in accordancewith C.R.S. $31-12-501.
3. The Rifle City Clerk is hereby directed as follows:
a. To file one copy of this ordinance along with the Land Survey Plat in the offrce of
the City Clerk of the City of Rifle.
b. To certifu and file two 2 copies of this ordinance and the Land Survey Plat with
. the Clerk and Recorder of the County of Garfield, State of Colorado.
c. To request the Clerk and Recorder of Garfield County to file one certified copy of
this ordinance and the Land Survey Plat with the Division of Local Government of the
Departunart of Local Affairs State of Colorado.

4. The Planning Director of the City of Rifle is hereby directed to amend the Official
Map of the City of Rifle to reflect the boundary changes adopted pursuant to this ordinance.
5. That ifany section subsection sentence clause phrase or portion ofthis ordinance
is for any reason held invalid or unconstitutional in a court of competent jurisdiction such portion
shall be deemed a separate distinct and independent provision and shall not affect the validity of
the remaining portions thereof

The Board of County Commissioners purchased property adjacent to the Garfield County Airport that was
located within the jurisdiction of the City of Rifle. A de-annexation process occurred and the site is now
in unincorporated Garfield County, therefore county zoning is required to be applied to the parcel.
This request is to zone the site within
the adjacent Airport lndustrial PUD
as Commercial/Airport Services (C/A
S) which would allow the property to
revert to that zoning designation
assigned to the site prior to the
annexation of the property to the
City of Rifle. The Airport lndustrial
PUD documents from 20L1 indicate
that the site is contained within the
CAIS zone of the PUD.
ln order to add this property to the
Official Zoning Map, a request must
be made for zoning the parcel.
Community Development is acting
on behalf of the Board of County
Commissioners to accomplish the
act of assigning zoning to the property and adding that designation to the zoning map.

Adjacent uses includes the Garfield County Airport to the north of the site and industrially zoned property
to the south. Adjacent zoning includes Public Airport and Planned Unit Development.
The 2013 Land Use and Development Code, as amended (LUDC) contains regulations regarding rezoning
of property within the County in Section 4-113. This zoning action must be reviewed by the Planning
Commission for recommendation and a decision issued by the Board of County Commissioners.
4-113. REZONING.
A.Overview.
Applications for rezoning shall be reviewed and a recommendation made by the
Planning Commission, and decided by the BOCC.
Rezoning may be initiated by the BOCC, the Planning Commission, the Director,
or the owner of the subject property.
The rezoning request may be processed concurrently with a Land Use Change
application and review process.
B. Review Process.
Applications for rezoning shall be processed according to Table 4-!O2, Common Review
Procedures and Required Notice.
C. Review Criteria.
An application for rezoning shall demonstrate with substantialevidence that an error exists in the
Official Zone District Map, or meet the following criteria:

The proposed rezoning would result in a logical and orderly development pattern
and would not constitute spot zoning;
The area to which the proposed rezoning would apply has changed or is changing
to such a degree that it is in the public interest to encourage a new use or density

The Garfield County Comprehensive Plan designates the area as Commercial, Light lndustrial, Regional
Employment Center and Urban Growth Area. The proposed zoning is consistent with these designations.
1. That proper public notice was provided as required for the hearing before the Planning
Commission.
2. That the hearing before the Planning Commission was extensive and complete, that all pertinent
facts, matters and issues were submitted or could be submitted and that all interested parties
were heard at that meeting.
3. That for the above stated and other reasons the request to rezone the property is in the best
interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield
County.
4. That the application has met the requirements of the Garfield County 2013 Land Use and
Development Code, as amended.
