COLORADO APPROVING THE DISCONNECTION OF CERTAIN TERRITORTES ADJOINING THE GARFIELD COTINTY REGIONAL AIRPORT AND THE GARFIELD COI.]NTY ROAD AND BRIDGE FACILITY. WHEREAS, a Petition for Disconnection was filed with the City in August 2015 by the Board of County Commissioners of Garfield County, Colorado, the sole owner of the territory hereinafter described ('rOwner" or the "County''), excluding sfueets and alleys; and WHEREAS, the County's acquisition of certain real property adjacent to the Garfield County Airport and th'e Garfield County Road and Bridge Facility comprises territory owned by the County but in the City's jurisdiction and to be used in conjunction with property in the County's jurisdiction, creating undesirable mixed jurisdiction; and WHEREAS, C.R.S. $31-12-501, et seq., sets forth the procedure required to disconnect a tract of land within and adjacent to the boundary of a city; and WHEREAS, the Rifle City Council does hereby find and determine approval of the Petition for Disconnection of said territory to be in the City's best interest. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COTINCIL OF THE CITY OF RIFLE, COLORADO, THAT: 1. The foregoing recitals are incorporated herein as if set forth in full. 2. That the hacts of land described in the Petition for Disconnection and further described as Airport Parcel A, Airport Parcel B, Airport Parcel C and Boot Parcel A on the Land Survey Plat attached hereto as Exhibit A is hereby disconnected from the boundary of the City of Rifle in accordance with C.R.S. $31-12-501. 3. PROJECT INFORMATION AND STAFF COMMENTS DESCRIPTION OF THE PROPOSAL llPage Board of CountY Commissioners March 7,20L6 Garfield County Airport Parcel B - ZDAA8400 Adjacent uses includes the Garfield County Airport to the north of the site and industrially zoned property to the south. Adjacent zoning includes Public Airport and Planned Unit Development. The 2013 Land Use and Development Code, as amended (LUDC) contains regulations regarding rezoning of property within the County in Section 4-t13. This zoning action must be reviewed by the Planning Commission for recommendation and a decision issued by the Board of County Commissioners. 4.113. REZONING. A. Overview. 1. Applications for rezoning shall be reviewed and a recommendation made by the Planning Commission, and decided by the BOCC. 2. Rezoning may be initiated by the BOCC, the Planning Commission, the Dlrector, . or the owner of the subject property. 3. The rezoning request may be processed concurrently with a Land Use Change application and review Process. B. Review Process. Appfications for rezoning shall be processed according to Table 4-102, Common Review Procedures and Required Notice. C. Review Criteria. An application for rezoning shall demonstrate with substantial evidence that an error exists in the Official Zone District Map, or meet the following criteria: 1. The proposed rezoning would result in a logical and orderly development pattern and would not constitute spot zoning; 2. The area to which the proposed rezoning would apply has changed or is changing to such a degree that it is in the public interest to encourage a new use or density in the area; 3. The proposed rezoning addresses a demonstrated community need with respect to facilities, services, or housing; and 4. The proposed rezoning is in general conformance with the Comprehensive Plan and in compliance with any applicable intergovernmental agreement.
