We are the owners of the following real properties in the unincorporated area of Garfield
County:
Propertv Owner #1: Parcel Number 2t77-243-00-398 as more particularly described in
the attached Exhibit "A" incorporated hereln by this reference.
Propertv Owner #2: Parcel Number 2\77-L34-OO-205 ("Airport").
We are desirous of adjusting the boundary lines of our parcels and/or lots and sign this
Affidavit in accordance with the Garfield County Land Use and Development Code.
Property # 1 wishes to convey land to Property #2. Said land being conveyed is described
in Exhibit "8" and as depicted on the Boundary Line Plat in Exhibit "C" which are attached
hereto and incorporated herein by reference. Exhibit "C" is separately recorded
simultaneously herewith as Reception Number Fbbll6 in the Garfield County
Clerk and Recorder's records.
We hereby represent that no new parcels or lots will be created and therefore, that
Garfield County will not be required to issue any building permits, other than what it would
be required to issue for the already existing parcels or lots.
We hereby represent that none of the parcels or lots involved in this boundary line
adjustment are part of a previously platted subdivision of record although they are part of
land zoned "PUD" and "Public Airport" in Garfield County. lf one of the lots to be amended
is a lot in a previously recorded subdivision, then a Final PIat Amendment is required which
is more fully defined in article 5 of the Garfield County Land Use and Development Code.
We hereby represent that the boundary line adjustments, made reference to herein, will
not cause the loss of access by road or to utilities to any of the properties involved, except
as access to the properties to be added to the Airport may be limited or denied in
accordance with the Airport Master Plan.
We hereby represent that the boundary line adjustment being made will not result in any
of the parcels or lots involved being less than the minimum lot size in their applicable zone
district allowed as a result of the boundary line adjustment or create any non-conforming
setbacks for any existing structures.
We hereby represent that a copy of the Affidavit will be recorded with the Garfield County
Clerk and Recorder.
A copy of the recorded Affidavit Re: Lot Line Adjustment will be provided to the Garfield

AN ORDINANCE OF THE CITY OF RIFLE. COLORADO APPROVING THE
DISCONNECTION OF - CERTAIN TERRITORIES ADJOINING THE
GARFIELD COUNTY REGIONAL AIRPORT AND THE GARFIELD
COUNTY ROAD AND BRIDGE FACILITY.
WHEREAS, a Petition for Disconnection was filed with the City in August 2015 by the
Board of County Commissioners of Garfield County, Colorado, the sole owner of the territory
hereinafter described (*owner" or the "county''), excluding streets and alleys; and
WHEREAS, the County's acquisition of certain real property adjacent to the Garfield
County Airport and thb Garfield County Road and Bridge Facility comprises tenitory owned by
the County but in the City's jurisdiction and to be used in conjunction with property in the
County's jurisdi ction, creating undesirable mixed jurisdi ction; and
WHEREAS, C.R.S. $31-12-501, et seq., sets forth the procedure required to disconnect a
tract of land within and adjacent to the boundary of a city; and
WHEREAS, the Rifle City Council does hereby find and determine approval of the
Petition for Disconnection of said territory to be in the city's best interest,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COTINCIL OF THE CITY
OF RIFLE, COLORADO, THAT:
l. The foregoing recitals are incorporated herein as if set forth in full.
2. That the tacts of land described in the Petition for Disconnection and flrther
described as Airport Parcel A, Airport Parcel B, Airport Parcel C and Boot Parcel A on the Land
Survey Plat attached hereto as Exhibit A is hereby disconnected from the boundary of the City of
Rifle in accordance with C.R.S. g3l-12-501
3. The Rifle City Clerk is hereby directed as follows:
a. To file one copy of this ordinance along with the Land Survey Plat in the office of
the City Clerk of the City of Rifle.
b. To certify and file two 2 copies of this ordinance and the Land Survey Plat with
. the Clerk and Recorder of the County of Garfield, State of Colorado.
c. To request the Clerk and Recorder of Garfield County to file one certified copy of
this ordinance and the Land Survey Plat with the Division of Local Government of the
Deparknent of l,ocal Affairs State of Colorado.

The Board of County Commissioners purchased property adjacent to the Garfield County Airport that was
located within the jurisdiction of the City of Rifle. A de-annexation process occurred and the site is now
in unincorporated Garfield County, therefore county zoning is required to be applied to the parcel.
This request is to zone the site within
the adjacent Airport lndustrial PUD
as Com mercia I/Airport Services (C/A
S) which would allow the property to
revert to that zoning designation
assigned to the site prior to the
annexation of the property to the
City of Rifle. The Airport lndustrial
PUD documents
ln order to add this property to the
Official Zoning Map, a request must
be made for zoning the parcel.
Community Development is acting
on behalf of the Board of County
Commissioners to accomplish the
act of assigning zoning to the
property and adding that

Adjacent uses includes the Garfield County Airport to the north of the site and industrially zoned property
to the south. Adjacent zoning includes City of Rifle, Public Airport and Planned Unit Development.
The 2013 Land Use and Development Code, as amended (LUDC) contains regulations regarding rezoning
of property within the County in Section 4-113. This zoning action must be reviewed by the Planning
Commission for recommendation and a decision issued by the Board of County Commissioners.
4-113. REZONING.
A. Overview.
1. Applications for rezoning shall be reviewed and a recommendation made by the
Planning Commission, and decided by the BOCC.
2. Rezoning may be initiated by the BOCC, the Planning Commission, the Director,
or the owner of the subject property.
3. The rezoning request may be processed concurrently with a Land Use Change
application and review process.
B. Review Process.
Applications for rezoning shall be processed

C. Review Criteria.

An application for rezoning shall demonstrate with substantial evidence that an error exists in the
Official Zone District Map, or meet the following criteria:
1. The proposed rezoning would result in a logical and orderly development pattern
and would not constitute spot zoning;
2. The area to which the proposed rezoning would apply has changed or is changing
to such a degree that it is in the public interest to encourage a new use or density
in the area;
3. The proposed rezoning addresses a demonstrated community need with respect
to facilities, services, or housing; and
4. The proposed rezoning is in general conformance with the Comprehensive Plan
and in compliance with any applicable intergovernmental agreement.

The Garfield County Comprehensive Plan designates the area as Commercial, Light lndustrial, Regional
Employment Center and Urban Growth Area. The proposed zoning is consistent with these designations.
1. That proper public notice was provided as required for the hearing before the Planning
Commission.
2. That the hearing before the Planning Commission was extensive and complete, that all pertinent
facts, matters and issues were submitted or could be submitted and that all interested parties
were heard at that meeting.
3. That for the above stated and other reasons the request to rezone the property is in the best
interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield
County.
That the application has met the requirements of the Garfield County 2013 Land Use and
Development Code, as amended.
That the application is in general conformance with Garfield County Comprehensive Plan 2030.
