We are the owners of the following real properties in the unincorporated area of Garfield
County:

the attached Exhibit "A" incorporated herein by this reference.
Prooertv owner #2: Parcel N umber 2177 -247-OG 47 6 ("Road and Bridge").
We are desirous of adjusting the boundary lines of our parcels and/or lots and sign this
Affidavit in accordance with the Garfield County Land Use and Development code.
Property # 1 wishes to convey land to Property #2. Said land being conveyed is described
in Exhibit "8" and as depicted on the Boundary Line Plat in Exhibit "C" which are attached
hereto and incorporated herein by reference. -Exhibit."C" is separately recorded

We hereby represent that no new parcels or lots will be created and therefore, that
Garf ield County will not be required to issue any building permits, other than what it would
be required to issue for the already existing parcels or lots.

AN QRDINANCE OF THE CITY OF RIFLE. COLORADO APPROVING THE
DISCONNECTION OF - CERTAIN TERzuTORIES ADJOINING THE
GARFIELD COIINTY REGIONAL AIRPORT AND THE GARFIELD
COUNTY ROAD AND BRIDGE FACILITY.
WHEREAS, a Petition for Disconnection was filed with the City in August 2015 by the
Board of County Commissioners of Garfield County, Colorado, the sole owner of the territory
hereinafter described ('rOwner" or the "County''), excluding sfueets and alleys; and
WHEREAS, the County's acquisition of certain real property adjacent to the Garfield
County Airport and th'e Garfield County Road and Bridge Facility comprises territory owned by
the County but in the City's jurisdiction and to be used in conjunction with property in the
County's jurisdicti on, creating undesirabl e mixed juri sdicti on; and
WHEREAS, C.R.S. $31-12-50i, et seq., sets forth the procedure required to disconnect a
tract of land within and adjacent to the boundary of a city; and
WHEREAS, the Rifle City Council does hereby find and determine approval of the
Petition for Disconnection of said tenitory to be in the City's best interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COI-INCIL OF THE CITY
OF RtrLE, COLORADO, THAT:
l. The foregoing recitals are incorporated herein as if set forth in full.
2. That the hacts of land described in the Petition for Disconnection and further
described as Airport Parcel A, Airport Parcel B, Airport Parcel C and Boot Parcel A on the Land
Survey Plat attached hereto as Exhibit A is hereby disconnected from the boundary of the City of
Rifle in accordance with C.R.S. $31-12-501.
3. The Rifle City Clerk is hereby directed as follows:
a- To file one copy of this ordinance along with the Land Survey Plat in the office of
the City Clerk of the City of Rifle.
b. To certifu and file two 2 copies of this ordinance and the [and Survey Plat with
. the Clerk and Recorder of the County of Garfield, State of Colorado.
c. To request the Clerk and Recorder of Garfield County to file one certified copy of
this ordinance and the Land Survey Plat with the Division of Local Govemment of the
Deparknent of Local Affairs State of Colorado.

4. The Planning Director of the City of Rifle is hereby directed to arnend the Official

shall be deerned a separate distinct and independent provision and shall not affect the validity of
the remaining portions thereof

Adjacent uses includes Road & Bridge facility to the northeast of the site and industrially zoned property
to the west. Adjacent zoning includes City of Rifle and Planned Unit Development.
The 2013 Land Use and Development Code, as amended (LUDC) contains regulations regarding rezoning
of property within the County in Section 4-113. This zoning action must be reviewed by the Planning
Commission for recommendation and a decision issued by the Board of County Commissioners.
4-113. HEZONING.
A. Overview.
1. Applications for rezoning shall be reviewed and a recommendation made by the
Planning Commission, and decided by the BOCC.
2. Rezoning may be initiated by the BOCC, the Planning Commission, the Director,
or the owner of the subject property.
3. The rezoning request may be processed concurrently with a Land Use Change
application and review process.
B. Review Process.
Applications for rezoning shall be processed

An application for rezoning shall demonstrate with substantial evidence that an error exists in the
OfficialZone District Map, or meet the following criteria:

to such a degree that it is in the public interest to encourage a new use or density
in the area;
3. The proposed rezoning addresses a demonstrated community need with respect

and in compliance with any applicable intergovernmental agreement.
The Board of County Commissioners has requested that the subject site be zoned to Airport lndustrial

Employment Center and Urban Growth Area. The proposed zoning is consistent with these designations,
as shown on the map below.
