RE: Ponderosa Subdivision Final Plat Documents
Dear John,
In accordance with my letter to you dated April 28, I have had an opportunity to discuss with the
County Attorney, the documents relative to the aforementioned matter. This discussion has yielded
the following results and conclusions:
1] The internal driveway shown on the plat should be listed as a "road" not an access easement,
2] Mr. DeFord requests that the Subdivision Improvements Agreement (SIA) follow the format
of the enclosed SIA. The SIA must contain specific provisions for:
a. Statement that all subdivision improvements have been completed. This statement
must be certified by a licensed engineer;
b. Statement that since all improvements have been completed, no security is required;
c. Consent to vacate the plat.
3] Homeowner's Association by-laws and covenants must provide for enforcement of the
Individual Sewage Disposal System management plan.
These items should complete the submittal and allow us to present the documents to the Board of
County Cmissioners for their approval. If you have any questions, please contact this office.

RE: Ponderosa Subdivision - Final Plat
Dear Ken,
I have completed my initial review of the aforementioned file. Based on this review, I have
determined the file to be incomplete for the following reasons:
1. We must receive certification that ad valorem taxes have been paid;
2. The Subdivision Improvements Agreement (SIA) discusses the Developer's Performance, but
states specifically that there would be no improvements. This contradictory language should
be deleted;
3. I see no indication that a school site acquisition fee has been paid. The fee is $200 and must
be paid prior to final plat consideration by the Board of County Commissioners;
4. Has the Division of Water Resources issued a well permit for this spring? If so, please attach
a copy;
5. No individual sewage disposal system management plan has been submitted;
6. The road dedication language is not consistent with County policy. It should dedicate the
common driveway for public use;
7. What do you intend to do about the Homeowner's Association and its duties and powers of
enforcing use restrictions regarding the water supply and access?
These comments are descriptive of my review of the final plat documents. At this time, I have not
discussed these items with the County attorney, who may have further comments and require
additional information. After I have discussed these issues with the County Attorney, I will list any
additional requirements.
