MEMORANDUM

RE: SONIA SIMON AMENDED PLAT REQUEST
Enclosed is a copy of a request from Sonia Simon to do an amended plat for two pieces of
property, adjacent to each other. Ms. Simon received conditional approval of an exemption
request in October, to split a 40 acre tract into four (4) parcels of approximately 30, 3+, 3+ and
3+ acres each. Ms. Simon also owns an adjoining piece of property, that was a part of the Peach
Valley Orchard subdivision recorded in 1909. This tract of land is divided into 16 ten (10) acre
lots. The proposal is to do a plat amendment to combine the exemption lots and subdivision lots
onto one amended plat.
Section 6:10 of the Subdivision Regulations states that "an amendment may be made to a
recorded plat, if such amendment does not increase the number of subdivision lots or dwelling
units, result in the major relocation of a road or add roads." The proposed application does not
increase the number of lots or dwelling units The proposal does relocate the roads in a manner
very different from the original plat.
Staff notes that this type of amendment is not required to be submitted to any review agencies for
comment and review. Nor is there any additional documentation required to determine if the
lots are good buildable sites with adequate domestic water. This is the type of information that
comes from the regular subdivision review process. The proposed roads are not subject to
meeting the same road standards that would have to addressed as a part of the subdivision
process. Staff would recommend that the proposed amended plat be subject to the subdivision
review process, to allow for adequate input from the normal review agencies.

On behalf of my clients Donald L. McGirr and Patricia J. McGirr who live at
0666 County Road 250, Silt, CO 816542 and Kathy Senor and Monte Senor who live at
0330 County Road 250, Silt, CO 81652, we have been notified that David Hicks has
withdrawn his attempt to do an Amended Plat for the Peach Valley Orchard
Subdivision and an Amended Plat for the Simon Subdivision Exemption Plat and
therefore we will not appear at the hearing scheduled for April 19, 1999 at 11:00 A.M.
We do hereby request that if Mr. Hicks tries to have the commissioners approve
the Amended Plats in the future that my clients and I are notified so we can appear to
discuss this issue.
