Koss, Deputy , Clerk of the Board when the following 1 iocecdings, among others were had and done, to•wit: RESOLUTION NO. 81-37 A RESOLUTION CONCERNED WITH THE APPROVAL OF THE PRELIMINARY PLAT SUBMITTAL FOR PEACH VALLEY ACRES WHEREAS,dim Stevens has filed an application with the Planning Department of Garfield County for the approval of a Preliminary Plat in the Agricultural/Residential/ Rural Density Zone District; and WHEREAS, based on the material submitted by the applicant and the comments of the Garfield County Planning Department, this Board finds as follows: 1. That the Preliminary Plat conforms to Section 4.02 Preliminary Plat Requirements of the Garfield County Zoning Resolutions. 2. That the Preliminary Plat conforms to the requirements of the zone district which the development is in. 3.. That for the above stated and other reasons, the proposed Preliminary Plat appears to qualify for approval by this Board. NOW, THEREFORE, BE IT RESOLVED that the Preliminary Plat of Peach Valley Acres for the following described unincorporated area of Garfield County be approved: A parcel of land in the NEt,SWa of Section 1, Township 6 South, Range 92 West of the 6 1h Principal Meridian, of Garfield County, Colorado AND BE IT RESOLVED that the following conditions shall be placed upon this approval: 1 That the water rights and water system of Peach Valley Acres Subdivision be turned over to the Peach Valley Homeowners Association or some similar organization affiliated win Peach Valley Subdivision. 2. That the water rights shall remain with Peach Valley Su':division and can not be separated from the land. 3. That the recommendation for open space on lot tt8 by the Garfield County Planning and Zoning Commission be deleted as a requirement on the final plat. 4. That a 30 foot ROW be cedicated from the centerline of County Road #214, ie: this will result in the dedication of 8 feet of ROW on the final plat. 5. That notation be provided on the final plat and in the restrictive covenants indicating that unconventional sewer systems may be required on each lot ie: evapotranspiration systems or mound systems, and that the costs of these systems is considerably more than conventional sewer systems. 6. That the requirement of a fee in lieu of land be paid at final plat or prior to the release of the subdividers agreement.
