Authority. This application for a Building Permit must be signed by the Owner of the property, described above, or
an authorized agent. If the signature below is not that of the Owner, a separate letter of authority, signed by the
Owner, must be provided with this Application.
Legal Access. A Building Permit cannot be issued without proof of legal and adequate access to the property for
purposes of inspections by the Building Division.
Other Permits. Multiple separate permits may be required : (1) State Electrical Permit, (2) County OWTS Permit,
(3) another permit required for use on the property identified above, e.g . State or County Highway/ Road Access or
a State Wastewater Discharge Permit.
Void Permit. A Building Permit becomes null and void if the work authorized is not commenced within 180 days of
the date of issuance and if work is suspended or abandoned for a period of 180 days after commencement.

understand that the Building Division accepts the Application, along with the plans and specifications and other
data submitted by me or on my behalf (submittals), based upon my certification as to accuracy. Assuming
completeness of the submittals and approval of this Application, a Building Permit will be issued granting
permission to me, as Owner, to construct the structure(s) and facilities detailed on the submittals reviewed by the
Building Division. In consideration of the issuance of the Building Permit, I agree that I and my agents will comply
with provisions of any federal, state or local law regulating the work and the Garfield County Building Code, OWTS
regulations and applicable land use regulations (County Regulation(s)). I acknowledge that the Building Permit
may be suspended or revoked, upon notice from the County, if the location, construction or use of the structure(s)

GRADING PERMIT REQUIREMENTS
A permit is required for any excavation, grading, or earthwork construction including fills and embankments. A
grading permit does not permit the construction of retaining walls or other structures.
EXEMPTION FROM GRADING PERMIT:
• Agricultural Land: Grading, excavation and earthwork, including fills and embankments that are
constructed solely for agricultural purposes on lands that are farms or ranches.
• Small Projects: Grading that does not exceed 50 cu. yds of earthwork material or 6000 sq.ft. of graded
area as long as grading does not change drainage patterns with respect to adjacent properties.
• See Amended 2009 IBC Appendix J for other Exemptions.
TYPES OE GRADING PERMITS AND FEES:
• Major grading: over 20,000 sq. ft. or over 5000 cu.yds .......................... $400.00
• Minor grading: less than 20,000 sq. ft. and under 5000 cu. Yds ............. $100.00
PERMIT APPLICATION & SUBMITTAL REQUIREMENTS (1 copy required):
• Complete application (a one page from is available from the County)
Vicinity Map indicating section, township and range of site, proposed location of grading, and the site's
relation to surrounding roads, municipal boundaries, and water bodies.
• Site plan that shows the following within 100 feet of the proposed grading:
i. Existing and proposed contours (see exemption below for pipelines)
ii. Delineation of area to be disturbed by grading activities
iii. Existing structures
iv. Existing and proposed roads and driveway
v . Property boundaries , right-of-ways and easements
vi. Floo dplain s , intermittent streams , wetlands and other bodies of water
• Erosion Control Plan and Details. Plan shows the location of all erosion control measures.
• MAJOR GRADING PERMIT ONLY:
i . Reveqetation and Reclamation Plan. See attached requirements
ii. Fjnancial security for site reclamation. Please allow County to review reclamation cost estimate
before providing security.
iii. For major grading permits, the plans must be prepared and stamped by a qualified Colorado
Professional engineer.
• PIPELINES ONLY: The site plan does not need to show topographic contours if the installation of pipeline
will not result in changes to the surface grade.
• Approve State Stormwater Permit if area disturbed by grading is greater than one acre.
• Soils Report: A soils report may not be required if the maximum depth of cut or fill depth is less than 15 feet
and native slopes are less than 25%.
• Drainage Report: will be required if the County believes that grading may change drainage patterns with
regard to adjacent properties, wetlands/water bodies or slopes greater than 25%
• Grading Permit Fee: See fees above for amount. (Make Check payable to: Garfield County Treasurer).
PAYMENT IS REQUIRED AT SUBMITTAL.

Garfje!d County Vegetation & Sjte Bec!amatjon Beqyirements (Long-
Term Disturbed Areas, One Acre or More)
Overview: Grading Permits typical require the submission of;
A Site Specific Inventory and Map of county and State Listed Noxious Weeds.
• A Weed Management Plan.
• A Revegetation and Reclamation Plan.
A Cost Estimate
A Financial Security.
The purpose of the plan is to ensure that the development does not result in: (i) erosion and dust generation, (ii)
the propagation of noxious weeds, (iii) the excessive loss of wildlife habitat and food sources, and (iv) long-term
visual eyesores. The financial security allows the County to perform reclamation in the case that the developer
abandons the project or does not perform adequate reclamation.
Requjred Elements of Vegetatjon and Reclamation plan:
Section 1 -Soil Handling. Includes: (i) provisions for salvaging on-site topsoil, (ii) a timetable for
eliminating topsoil and/or aggregate piles, (iii) plan that provides for soil cover if any disturbances or
stockpiles sit exposed for a period of 90 days or more, and (iv) erosion control barriers and dust
suppression measures.
Section 2 -Weed Management Plan. Includes: (i) a site specific weed inventory along with a site plan
showing County Listed Noxious Weeds and Colorado Listed A & B Noxious Weeds (Contact Garfield
County Vegetation Management for updated list), (ii) weed management plan that addresses inventoried
weeds in a timely and effective manner. (Note: Garfield County may require the submittal for treatment
records.)
Section 3-Site Revegetation and Restoration. Includes: (i) plant material list (be specific, scientific and
common names require), (ii) planting schedule (to include timing, methods, and provisions for watering, if
applicable.)
Section 4 -Cost Estimate. Cost estimate is used to determine the amount of the financial security. Line
items within the cost estimate include: (i) mobilization, (ii) earthmoving, (iii) seed and planting, (iv) weed-
free mulch, erosion control, and dust suppression, (v) irrigation, and (vi) weed management. (Note: For
pipelines and projects in which existing grade is the same as final grade, a cost of $2,500/acre can used to
determine the financial security.)
Ejnancja! Securjtv: Bonds, letter of Credit valid for a minimum of 2 years or cash.
Coynty lnspectjon and Release of Fjnancjal Secyrjty: When grading has been completed and vegetation
reestablished, the developer (permit holder) phones County Vegetation Manager (970-945-1377 Ext. 4305) and
requests an inspection. Jf restoration is determined to be adequate, the county will inform the development and
release the financial security.

SECTIONJ101
GENERAL
I JIOl.I Scope. The provisions of this chapter apply to grading,
exca\'ation and earthwork construction. including !ills and
embankments. Where conflicts occur betwee n the technical
requirements of this chapter and the geotechnical report, the
geotechnical report shall govern.
JIO 1.2 Flood hazard areas. The provisions of this chapter shall
not apply to grading. excavation and eaithwork construction,
including fills and embankments, i11jloodways withinjlood ha:-
ard areas established in Section 1612.3 or in.flood ha:ard areas
\\here des ignf/ood elc\ations arc specified but noodways have
not been designated, unless it has been demonstrated through
hydrologic and hydraulic anal)scs performed in accordance

SECTION J 102
DEFINITIONS
JI02.I Definitions. For the purposes of this appendix chapter,
the terms, phrases and words listed in this section and their
deri\ ativcs shall ha\e the indicated meanings.
BENCH. A relatively level step C\Ca vated into earth material
on \\hich fill is to be placed.
COMPACTION. The densification of a fill by mechanical
means.
CUT. Sec Exca\ at io n .
DOWN DRAIN. A device for collecting watcr from a swalc or
ditch located on or above a slope. and safely dcli\'ering it to an
approved drainage facility
EROSION. The wearing away of the ground surface as a result
of the movement of \\ind, \\atcr or ice.
EXCAVATION. The remo\'al of earth material by rutificial
means, also re fen cd to a s a cut.
FILL. Deposition of earth materials by artificial means.
GRADE. The vertical location of the ground surface.
GRADE, EXISTING. The grade prior to grading.
GRADE. FINIS MED . The grade of the site at the condusio n
of all grading efforts.
GRADING. An exca\'ation or fill or combination thereof.

Exemption from the permit requirements of thi s appendix
shall not be deemed to grant authorization for an) work to be
done in any manner in violation of the provisions of this code or
any other Im\ s or ordinances of this jurisdiction.
SECTION J 104
PERMIT APPLICATION AND SUBMITTALS
JI 04.1 Submittal requirements. In addition to the provisions
of Section I 05.3 . the applicant shall state the estimated quanti-
ties of cxcav atiou and fill.
Jl04.2 Site plan requirements . lnaddition to th-·isions of
Section I 07.agrading plan:shall s how the existin c and fin-
ished grade in contour intcnals of sufficient clarity to indicate
the nature and extent of the work and show in detail that it com-
plies with the requirements of this code. The plans shall sho\\ the
e xisting grade on adjoining properties in sufficient detail to iden-
tify how grade changes will conform to the requirements of this
code.
APPENDIXJ
1104.3 Geolechnical report. A geotechnical report prepared
by a registered desig11 profcssio11al shall be provided. The
report shall contain at least the following:
I. The natnre and distribution of existing soils;
2. Conclusions and recommendations for grading proce-
dures;
3. Soil design criteria for any structnres or embankments
required to accomplish the proposed grading: and
4. Where necessary, slope stability studies, and recommen-
dations and conclusions regarding site geology.
Exception: A geotechnical repon is not required \\here the
building code official detennines that the nature of the work
npplied for is such that a repon is not necessary.
JI04.4 Liquefaction study. For sites with mapped mnximum
considered earthquake spectral response accelerations at short
periods (S,) greater than O.Sg as determined by Section 1613 , a
stndy of the liquefaction potential of the site shall be provided,
:ind the recommendations incorporated in the plans.
Exception: A liquefaction stndy is not required ''here the
building official determines from established local data that
the liquefaction potential is low.
SECTIONJ105
NSPECTIONS
JIOS.l General. Inspections shall be governed by Section 109
orthiscode.
JIOS .2 Special inspections. The special inspection require-
ments of Section 1704. 7 shall appl) lo work perfonned undera
grading permit where required by the building official.
SECTION J106
EXCAVATIONS
J 106.1 Maximnm slope. The slope of cut surfaces shall be no
steeper than is safe for the intended use, and shall be no steeper
than two units horizontal to one unit venical (SO-percent slope)
unless the owner or authorized agent furnishes a geotcchnical
reportjustifying a steeper slope.
Exceptions:
63S
I. A cut surface shall be permitted to be at a slope of l.S
units horizontal to one unit venical ( 6 7-percent slope)
provided that all of the following arc met:
I. I. It is not intended to suppon shuctures or sur-
charges.
12 Jtis adequately protected against erosion.
1.3. ltis no more than 8 feet (2438 mm) in height.
1.4. ltis approved by the building code official.
1.5. Ground water is not encountered.
2. A cut surface in bedrock shall be pennitted to be at a
Slope of one unit horizontal to one unit vertical
(100-perccnt slope).
SECTION J107
FILLS
JI07.I General. Unless otherwise recommended in the
gcotechnical report, lills sh;"Jll comply with the provisions of
this section.
JI07 2 Surface preparation. The ground surface shall be pre-
pared to receive lill by removing vegetation, topsoil and other
unsuitable materials, and scarifying the ground to provide a
bond with the fill materiul.
JI 07.3 Benching. Where existing grade is at a slope ste'--pcr than
live units horizontal to one unit 'ertic;"JI (20-percent slope) and
the depth of the fill exceeds S feet (I S24 mm) benching shall be
provided in nccorduncc with Figure J 107.3. A kc) shall be pro-
vided which is atieast I Ofcet (3048 mm) in width :md 2 feet (610
mm) in depth.
JI07.4 Fill material. Fill material shall not include organic,
frozen or other deleterious materials. No rock or similar irre-
ducible material greater than 12inehes (30S mm) in any dimen-
sion shnll be included in fills.

Jl07.5 Compaction. All fill material shall be compacted to 90
percent of maximum density as determined by ASTM D I SS7, I
Modified Proctor, in lifis not exceeding 12inches (30S mm) in I
depth.
J 107.6 Maximum slope. The slope of fill surfaces shall be no
steeper than is safe for the intended use. Fill slopes steeper than
two units horizontal to one unit venical (SO-percent slope) shall
be justi lied by a geotechnical repon or engineering data.
SECTIONJ106
SETBACKS
J 108 .1 General. Cut :ind Iii I slopes shall be set back from the
property lines in accordance with this section. Setback dimen-
sions shall be measured perpendicular to the propcny line and
shall be as shown in Figure JI 08.1, unless substantiating data is
submiuedjustifying reduced setbacks.
JI08.2 Tup of slope. The setback at the lop of a cut slope shall
not be less than that sho\\n in Figure JI08. I, or than is required
to accommodate any required int'--rceptor drains, whichever is
greater.
JI 08.3 Slope protection. Where required to protect adjacent
propeities at the toe of a slope from ad\ erse effects of the grad-
ing. additionul protection, appro\'ed by the building official.

3412.6 Evaluation process. The building owner shall cause the existing building to be
evaluated in accordance with the provisions of this section by a design professional( s)
licensed to practice in the State of Colorado. The evaluation process speci fied herein
shall be followed in its entirety to evaluate existing buildings. Table 3412.7 shall be
utilized for tabulating the results of the evaluation. References to other sections of this
code indicate that compliance with those sections is required in order to gain credit in
the evaluation herein outlined . In applying this section to a building with mixed
occupancies, where the separation between the mixed occupancies does not qualify for
any category indicated in Section 3412.6.16, the score for each occupancy shall be
determined and the lower score determined for each section of the evaluation process
shall apply to the entire building.
Where the separation between the mixed occupancies qualifies for any category
indicated in Section 34 I 2 .6 .16 , the score for each occupancy shall apply to each portion
of the building based on the occupancy of the space.

43. Section JI03.I is amended to read as follows:
J103.I Permits required. Except as exempted in Section JI03.2 , no grading shall be
performed without first having obtained a permit from the Garfield County Building and
Planning Department or designee. A grading permit does not include the construction
of retaining walls or other structures. Security deposits in a form and amount approved
by the Building Official or designee, based upon recommendations from the County
Vegetation Management Office and the county's designated engineer shall be
established prior to issuance of any major grading permits.
44. Section JI 03 .2 (I.) is amended to read as follows:
I. Grading, excavation and earthwork construction, including fills and embankments
that are constructed solely for agricultural purposes on lands that are farms or ranches.
45. Section JI03.2 is amended to add an 8th exemption from permit as follows :
8. Grading that does not exceed 50 cubic yards of earthwork material or 6000 square
feet of graded area whichever is greater.
