Colorado, held in the Commissioners Meeting Room, Garfield County Plaza Building, in
Glenwood Springs, on Monday, the 18t day of April AD 2016, there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 02/1/
A RESOLUTION CONCERNED WITH DENIAL OF A REQUEST TO AMEND AN
APPROVED PRELIMINARY PLAN AND PLANNED UNIT DEVELOPMENT (PUD)
KNOWN AS RIVER EDGE COLORADO ON PROPERTY OWNED BY CARBONDALE
INVESTMENTS, LLC, LOCATED MID -WAY BETWEEN CARBONDALE AND
GLENWOOD SPRINGS ON THE WEST SIDE OF STATE HIGHWAY 82 AT CATTLE
CREEK, SECTION 7, TOWNSHIP 7 SOUTH, RANGE 88 WEST OF THE 6m P.M.,
GARFIELD COUNTY
PARCEL NOs. 239307300032 and 239307300033
Recitals
A. An application for an amendment to an approved Preliminary Plan and PUD was
submitted by Carbondale Investments, LLC on property located mid -way between Glenwood
Springs and Carbondale on the west side of Highway 82 at Cattle Creek which is approximately
73.237 acres (Parcel Number 239307300032) and 85.924 acres (Parcel Number 239307300033)
in size (the Property).

B. The Property is located within unincorporated Garfield County in the Planned Unit
Development (PUD) Zone District.
C. The application requests and an amendment to the existing Preliminary Plan and
PUD known as River Edge Colorado and memorialized under Resolutions 2011-84 and 2011-85.
The application file numbers are PDAA-02-15-8212 and PPAA-02-15-8214.
D. The Board opened a public hearing on April 18, 2016, for consideration of whether
the applications should be approved, approved with conditions, or denied. At the hearing, the
public and interested persons were given the opportunity to express their opinions regarding the
applications.
E. The Board closed the public hearing on April 18, 2016, to make a final decision.
F. The Board, on the basis of substantial competent evidence produced at the
aforementioned hearing, made the following determinations of fact:
1. That proper public notice was provided as required for the hearing before
the Board of County Commissioners.
2. That the hearing before the Board of County Commissioners was extensive
and complete, that all pertinent facts, matters and issues were submitted or could
be submitted and that all interested parties were heard at that meeting.
3. That the requests for an amendment to the Preliminary Plan and PUD are
NOT in the best interest of the health, safety, convenience, order, prosperity and
welfare of the citizens of Garfield County for reasons including, without limitation,
issues concerned with the proposed intersection design and location with State
Highway 82.

RESOLUTION
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that based on the determination of facts set forth above, the Preliminary Plan
and PUD Amendment Applications, PDAA-02-15-8212 and PPAA-02-15-8214, is denied.
