1. BACKGROUND AND DESCRPTION OF THE PROPOSAL
The applicant is requesting to combine Tots 7 & 18 (each lot is 5,000 sq. ft.) into one lot.
This request will meet the required minimum lot size and setbacks for the underlying zone.
Additionally, the request will help facilitate separation requirements for a septic system.
The minimum lot size in the CL (Commercial Limited) zone is 7, 500 sq. ft. For this lot the
setbacks are as follows:
• Front: 25'
• Rear; 7,5' Commercial, 25' Residential
• Side: 10' or Y2 the principle building height — whichever is greater
Staff Comments
The proposal is relocating two or Less property lines common to two properties, allowing the
board to approve the request at a public meeting. The applicant's request will help
eliminate two non -conforming lots. The proposed amended plat will conform to all
applicable dimensional requirements of the CL zone with respect to lot size and setbacks.
Additionally, the larger lot will facilitate the use of an ISDS.
2. AUTHORITY
§6:10 of the Subdivision regulations states that an amendment may be made to a recorded
plat, if such amendment does not 1) increase the number of subdivision lots or dwelling
units, or 2) result in the major relocation of a road or add new roads. This request will not
result in either of the two aforementioned standards and Staff finds these standards are
met.
3. STAFF RECOMMENDATION
The Applicant has provided all required documentation and has satisfied the applicable
standards for a plat amendment. Therefore, Staff recommends the Board of County
Commissioners, pursuant to §6:10 of the Subdivision Regulations of 1984, as amended,
approve this amended plat request with the following conditions:
1. That all representations of the Applicant, either within the application or stated at the
meeting before the Board, shall be considered conditions of approval.
2. All plat notes from the original Final Plat of the Travelers Highlands Subdivision shall be
shown or referenced on this amended plat.
3. Within 90 days of approval, the Amended Final Plat shall be reviewed (paper copy),
then signed and dated (mylar copy) by the County Surveyor, then signed and dated by
the Chairman of the Board and recorded in the Clerk and Recorder's Office of Garfield
County. The Amended Final Plat shall meet the minimum CRS standards for land
survey plats, as required by Colorado state law, and approved by the County Surveyor
and shall include, at a minimum, the information outlined in Section 5:22 of the Garfield
County Subdivision Regulations.
