After I t alked with you about the three permits, W e discovered that the permit for C.R . 304 wa s not
necessary, due to the fact that the bore is past where the county road ends . It is a private road, and
private property, where they want to bore.

Per our conversation, Road and Bridge has no i ss ue with what Encana has proposed in
th is permit, but I would like for Encana to app ly for a new permit about 30 days
before starting this project so there is not so much gap between the permit process

Hi Molly -I am in receipt of your letter dated March 23, 2011, regarding the Director's Determination as it relates to
Encana's High Mesa Discharge Pipeline (PDPA-6713 . This email is advising that Encana will adhere to the conditions
outlined in the letter. I am providing attachments for a couple COA requests , as well as specifically addressing 14 , 15,
17 & 18 below:
14 . Prior to the issuance of Land Use Change Permit, a resurvey of raptor nests shall be completed and
submitted to Garfield County Planning Department for review .
As indicated in an earlier email, the survey has been scheduled and the resurvey will be submitted to Garfield County
upon completion, for review.
15. Prior to pipeline construction, the Applicant shall obtain three Utility Installation Permits (two for CR 306
and one for CR 304) from Garfield County Roads and Bridge Department and submit these permits to the
Garfield County Planning Department.
Two (2) Utility Permits were submitted on 03/30/11 to the Road & Bridge Dept. Once approved, I will forward to on to
you. As indicated in my 03/31/11 email, it was confirmed by Wyatt Keesbery of Rd. & Bridge that the road crossing on
304 by landowner, Klebold did not require a Utility Permit.
17 . Update the Emergency Response Plan so that Chris Bornholdt is shown as the Emergency Manager.
The page was updated to reflect Chris Bornholdt as the Emergency Manager.
18. Prior to the issuance of the Land Use Change Permit, the Applicant shall provide proof of notice to
property owners within 200 feet of the pipeline route that are not affected surface owners.
Attached are proof of notice; via certified, return mail receipts.

On November 3, 2010 , Barney Hammond, Bob Anderson, and I met with
you and Darby McClean at the following described property owned by
Larry Klebold:

Garfield County, Colorado
The reason for the meeting was to discuss the two pipelines Encana plans
to build across Klebold's property. During that meeting, it was agreed
upon that the two Encana pipelines will lie between the existing edge of
disturbance and Noble's permanent right-of-way . In addition , we all
agreed that in order for Encana to safely construct the pipelines between
the Noble pipeline and the existing disturbance, Encana will need to
temporarily use the surface of Noble's permanent right-of-way space.
However, Encana will not install any portion of the pipelines within
Noble's permanent right-of-way space, and Encana will only use the
surface area ofNoble's permanent right-of-way during construction.
Encana will notify Noble two weeks prior to starting construction of the
pipelines . Noble may have a representative present during the
construction of the pipelines. Any surface damages arising from Encana's
use of Noble's right-of-way will be repaired and reclaimed at the same
time as the Encana right-of-way.

1. Any oversized material (larger than 10 inches fn diameter) that is not utilized io backflll wlU be removed
from site by Applicant. Further, Applicant wJll remove any frozen material from site.
2. When a paved or chipped surface Is cut, lt Is to be replaced with a minimum oflluee (3) inch hot mix
aQpbalt patch . A tempon.ry patch with cold mix asphalt would be allowed, which would be replaced with
hot mix asphalt when the weather or availability ofm11terials allows the work to be completed. An asphalt
or chipped surface cut would requ ire tho rood to be atralght c.ut and aquared by means ofa pilvomcnl \:utter
or taw. A chipped surface cut will require a seal 'oat of tho patch that will be full wldth or half width of
roadway when trenches run with the road. For trenches e.'ross the road, the edges of the seal coat wJU
overlap the exlstlng edge . All Seal coal! wlll overlap edg~ by a two·foot minimum to insure adequate seal
over the undisturbed portion of tho roadway ln the vicinity oftbe excavation . Asphalt hot mix or cold
patches will be completed in a maxlmum of five working days, weather pennittln •.

I am writing this letter regarding the Encana Oil and Gas (USA) Inc. application for a Pipeline
Development Plan Review for a 16-inch natural gas pipeline . At this time the application does
not include all required information per Garfield County Regulations. The appl ica tion is
therefore deemed technically incomplete and the Planning Department will not process this
application any further until the following information , listed below, has been provided to the
satisfaction of this office. Please address the following items and submit three copies of the
modified information to this office so that we may continue the review of this application .

C. Ownership
• Encana Ownership Documents -The Deed included shows ownership by TBI
Production Company, but the Merger document shows a merger between Encana Oil
and Gas (USA) Inc. and TBI Pipeline Company . The County needs to see some
documentation that TBI Production Company is the same as TBI Pipeline Company, or
that Encana merged with TBI Production Company .
• Larry and Karen Klebold -The Pipeline and Right -of-Way Grant permits no more than
two pipelines, but it appears that Encana already has two existing pipelines on the
Klebold property (an existing 20" pipeline and an existing 6" pipeline). Please explain
how two additional pipelines can be permitted .
• linda Jones -The County has the same question as with the Klebolds . The Right-of-
Way (ROW) Easement is lim ited to two pipelines; but there already appears to be an
existing 6 " Encana pipeline . How are an additional two pipelines going to be allowed?
• Larry Knox-The County has the same question as with the Klebolds . On the Site Plan ,
it looks like there are already three Encana pipelines in the SW1/4 NE1/4 , Sec. 3, T8S,
R96W, but only two pipelines are permitted per the ROW Easement.
