CGS LAND USE 'REVIEWS
Geological studies are required by Colorado counties for all subdivisions of unincorpo-
rated land into parcels of less than 35 acres, understate statute C.R.S. 30-28401 et seq.
(Senate Bill 35, 1972). Some Colorado municipality require geological studies for sub-
division of incorporated land. In addition, local governments are empowered to regu-
late development activities in hazardous or mineral -resource areas under C.R.S. 24-65.1-
101 et seq. (House Bill 1041, 1974) and C.R.S. 34-1-301 et seq. (House Bill 1529, 1973),
respectively,
Local -government agencies submit proposed subdivision applications and supporting
technical reports to the Colorado Geological Survey ".,.for evaluation of those geologic
factors which would have significant impact on the proposed use of the land," in accor-
dance with State statutes. The CGS reviews the submitted documents and serves as a
technical advisor to local -government planning agencies during the planning process.
Since 1984, the CGS has been required by law to recover the full direct cost of perform-
ing such reviews.
The adequate knowledge of a site's geology is essential for any development project. It
is needed at the start of the project in order to plan, design, and construct a safe devel-
opment. Proper planning for geological conditions can help developers and future
owners/users reduce unnecessary maintenance and/or repair costs.

This letter is in response to a request from Mr James Mayhan to review hie existing individual Septic
Disposal System at 0684 County Road 126 in the Four Mile Creek drainage.
EnGosed is the repeipt for meteHpls sold to M. Maynan from Copeland Concrete and the Percolation
Test results as reported by CTL/Thompson Inc. Also -enclosed are two ISDS Design Calculation sheets
from Jerome Gants& & Associates. Inc.
It is our understanding that the existing septic system in question currently serves a two bedtuom, single-
family residence. The system is composed of a 1250 gailon concrete septic tank and a leach area
composed of 24 Standard 'Infiltrator units.
Using the information provided to .is the required leaching area is 636.40 sq ft. Taking a forty percent
reduction for a bed leach fieid design. the required area is 381.84 sq ft requiring 26 'infiltrator units
These numbers are based on g recommended percolation rate of 50 minim.
Reviewing the Percolation test results provided by CTI/Thompson Inc., the recommended percolation
rate is roundel up from the average of the four percolation teat results. The actual average percolation
rate is 47 minim. As shown on the second ISOS Design Calculation shoat if you use a 49 min/ln
percolation rate the required number of 'Infiltrator units is 24.
Rased on the seta received in our office and the assumption ttat the system was installed according to all
other applicable Garfield County !SDS regulations. it is our opinion that the existing ISMS as inlea/led is
adequate to serve a two bedroom single-family residence

is 37 to 39 degrees F, and the average frost -free period
is 50 to 70 days.
Typically, the surface layer is light brownish gray silty
clay loam about 6 inches thick. The next layer is clay
about 9 inches thick. The substratum is clay about 18
inches thick over shale. The depth to calcareous shale
ranges from 20 to 40 inches. The sail is calcareous
throughout.
Included in this unit are small areas of Forsey,
Cochetopa, Antrobus, Anvik, Skylick, and Sligting soils.
Included areas make up about 15 percent of the total
acreage.
Permeability is slow in the lyers soil. Available water
capacity is low. The effective rooting depth is 20 to 40
inches. Runoff is rapid, and the hazard of water erosion
is moderate to severe on the sleeper slopes.
This unit is used as rangeland, watershed, or wildlife
habitat. The potential plant community is mainly Thurber
fescue, Idaho fescue, and needlegrasses. Other plants
that characterize this site are slender wheatgrass,
nodding brome, and silver sagebrush. The average
annual production of air-dry vegetation is about 2,500
pounds per acre. if the range condition deteriorates,
silver sagebrush and Kentucky bluegrass increase in
abundance.
This unit is poorly suited to homesite development.
The main limitations are the shrink -swell potential and
the slope.
This map unit is in capability subclass Vlle,
nonirrigated. It is in the Subalpine Loam range site.
63—Jerry loam, 12 to 25 percent slopes. This deep,
well drained sail is on alluvial fans and hills. 11 formed in
alluvium derived dominantly from sandstone and shale.
Elevation is 7,500 to 9,500 feet. The average annual
precipitation is 18 to 20 inches, the average annual air
temperature is 37 to 40 degrees F, and the average
frost -free period is 70 to 80 days.
Typically, the surface layer is dark grayish brown 4y

temperature is 37 to 40 degrees F, and the average
frost -free period is 70 to 80 days.

frost -free period is 75 to 85 days.
This unit is about 50 percent Jerry soil and 40
percent Millerlake soil.

Section 9 bears S. 80°37'35" W. 2912.28 feet..
4. The depth of the well is 3 feet.
5. The date of the initiation of the appropriation is 1941.
6. The amount of water claimed is 0.033 cubic foot per
second O4 time.
7. The use of the water is domestic and lawn and garden irrigation,
of not more than 1 aC'CC.
8. The State Engineer's number is none.
9. The priority date is December: 31,- 1941.
10.The date of the application was December -30, 1974.
It is the ruling of the Referee that the statements in the
application are true and that the above described water right is
approved.
The above described underground water right meets the
criteria for an exempt domestic well pursuant to C.R.S. 1973,
. 37-92-G02(1) (b) and 37-92-602(4)0 , so long as,it is used
for the purpose., set forth herein.
It is accordingly ORDERED that this ruling shall become

TERMINATION OF PROTECTIVE COVENANTS
AND DEED RESTRICTIONS
WHEREAS, certain protective covenants and deed restrictions were recorded in
Book 477 at Page 469 with the Clerk and Recorder of Garfield County, and
WHEREAS. the majority of tract owners desire to terminate the protective
covenants and deed restrictions, ail as allowed for pursuant to that certain document
above referenced, more specifically Book 477 at Page 469, subparagraph (h).
NOW, THEREFORE, notice is hereby given by a majority of the tract owners
that the protective covenants and deed restrictions are terminated by virtue of the
majority of the tract owners determining that the covenants and restricrions set forth
under the protective covenants and deed restrictions recorded in Book 477 at Page 469,
herein above referenced, should be fully terminated.
It is [he intention of the undersigned that the protective covenants and deed
restrictions above mentioned terminate and that there be no automatic extension as
otherwise provided for under the protective covenants and deed restrictions. The
protective covenants and deed restrictions are attached hereto and incorporated herein as
Exhibit A. A property description is attached as Exhibit B.
