HomeMy WebLinkAbout3.0 Director's Determination 03.18.16Garfield CounU March 18,2016 Lynda Brent 368 Ponderosa Dr. Glenwood Springs, CO 81601 DIRECTOR DETERMINATION - Amended Final Plat - Western Hills Lot 17118 (File No. FPAA-02-16-8420) Dear Ms. This letter is provided to you in regards to Garfield County File FPAA-02-16-8420, pertaining to an Amended Plat to adjust the lot lines between Lots 17 and 18 in Block 9 of Western Hills Subdivision. This letter is notification that your request to amend the final plat of the Western Hills Subdivision has been reviewed by the Community Development Depaftment and the Director hereby issues a determination conditionally approving the request. The conditions of approval are as follows: 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The Plat shall be subject to final review and approval by County Staff prior to submittal of the Mylar plat for final execution, BOCC signature and recording (See Condition #3). All standard plat certificates and signature blocks shall be included on the final plat. The following amendments shall be made to the Plat: a. A Lienholder Ceftificate in a form as prescribed by the County shall be included on the plat for each propefty with a lien (moftgage); b. Plat Note C shall be removed from the Plat and replaced with a Plat Note indicating that all easements indicated on the title commitments are shown on the plat; c. The County Commissioners Cerlificate shall be corrected to match the form prescribed by the County (missing last sentence) and update the date from 2014 to 2016; d. The Title Ceftificate shall be corrected to match the form prescribed by the County, specifically the Certificate shall indicate who the propefty is vested in; e. The typo in Plat Note B ("Sland") shall be corrected. 3. The Applicant has 90 days within which to satisfy conditions of approval and provide the following documentation for BOCC signature and recordation: a. A plat mylar with signed Certificates that include Dedication and Ownership, Title, Taxes, Applicant's Surveyor, Lienholders and any mortgagees; b. Recording Fees. Notice of this decision will be provided to the Board of County Commissioners who has the ability to 'call-up' the application for review at a public hearing. You will be notified of the Board decision once it is received or upon expiration of the 10 day notice period (March 28,2016).
