(1973) Section 30 -28 -101(10)(a) -(d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted April 23, 1984, as amended the undersigned respectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by Resolution the division of a 40 acre tract of land into two tracts of approximately 20 acres each, from the definitions of "subdivision" and "subdivided land" as the terms are used and defined in C.R.S. (1973) Section 30 -28 -101(10)(a) -(d) and the Garfield County Subdivision Regulations for the reasons stated below: TABLE OF CONTENTS SEC. A: GENERAL INFORMATION (Building and Planning Dept. C: EXHIBITS SUBMITTAL REQUIREMENTS: As a minimum, an application requesting an Exemption from the Definition from Subdivision ("Exemption') shall specifically respond to all of the following items below and attache any additional information to submitted with this application: 1. Provide a narrative explaining why exemption is being requested. An exemption is being requested to divide this 40 acres parcel owned by Mickey and Marl Martin, brothers. Marl and Patricia Martin live on the 40 acres and will retain the easterly 20 acres where their home is located and Mickey Martin will, after the exemption, hold clear title to the westerly 20 acres for his own uses. Without the division, Mickey Martin is unable to build a home or sell his part of the family property. 2. Sketch map at a minimum scale of 1 "=200' showing the legal description of the property, dimension, area and legal description of all proposed lots or separate interests to be created, access to a public right-of-way, and any proposed easements for drainage, irrigation, access or utilities. Vicinity map at a minimum scale of 1 "=2000' showing the general topographic and geographic relation of the proposed exemption to the surrounding area within two (2) miles, for which a copy of U.S G.S quadrangle map may be used. It shall be demonstrated that the parcel existed as described on January 1, 1973 or the parcel as it exists presently is one of not more than three parcels created from a larger parcels, as it existed on January 1, 1973. a. Exhibit 11-A: The Martin family purchased the original 80 acre farm, which includes the subject 40 acres on Battlement Mesa in 1947. As of January 1, 1973 the entire 80 acres (NW1/4NE1/4 and NE1/4NW1/4 of Sec. 20 remained intact). Marvin Martin died in 1975, leaving his interest in the 80 acres by joint tenancy to Della Morrow Martin. b. Exhibit 11-B: By Resolution 82-05, the Garfield County Board of Commissioners purported to grant an exemption of 2 acres for a driveway easement. This easement serves the residence occupied by Marl and Patricia Martin on the subject 40 acres, but was never actually conveyed, and since it describes an easement only, does not in fact create a separate parcel. Garfield County Assessor Maps do not show a separate parcel. c. Exhibit 11-C: Della Martin died in 2000 and the original Martin Farm was split in to 2-40acre parcels by Personal Representative Deeds. d. Exhibit 11-0: The westerly 40 acres has since been split by the subdivision exemption process into two parcels known as Lots 1 and 2 of the Carpenter/Martin Exemption. e. CONCLUSION: Applicants submit that the 1982 Exemption for the road easement should be disregarded and that this application complies with the standards for exemption in that, once granted, there will be the remaining parent parcel (E1/2NW1/4NE1/4) and three exemption parcels, the westerly 20 acres of the subject property, and the two Carpenter/Martin parcels. A $300.00 Base Fee: Applicant shall sign the Agreement for Payment form and provide the fee with the application. 13. Submit 2 copies of this completed application form and all the required submittal materials to the Building and Planning Department. Staff will request additional copies once the Exemption application has been deemed technically complete. 2 II. EXEMPTION APPLICABILITY Pursuant to section 8:50 of the Subdivision Regulations, the Board of County Commissioners has the discretionary power to exempt a division of land from the definition of subdivision and, thereby, from the procedure in these Regulations, provided the Board of County Commissioners determines that such exemption will not impair or defeat the stated purpose of the Subdivision Regulations nor be detrimental to the general public welfare. The Board has determined that leases, easements and other similar interests in Garfield County owned property, land for oil and gas facilities, and an accessory dwelling unit or two family dwelling that are subject to leasehold interest only and complying with the requirements of the Garfield County Zoning Resolution, are exempt from these regulations. A. No more than a total of four (4) lots, parcels, interests or dwelling units will be created from any parcel, as that parcel was described in the records of the Garfield County Clerk and Recorder's Office on January 1, 1973. In order to qualify for exemption, the parcel as it existed on January 1, 1973, must have been 35 acres or greater in size at the time and not a part of a recorded subdivision; however, any parcel to be divided by exemption that is split by a public right-of-way (State or Federal highway, County road or railroad), preventing joint use of the proposed tracts, and the division occurs along the public right- of-way, such parcels thereby created may, at the discretion of the Board, not be considered to have been created by exemption with regard to the four (4) lot, parcel, interest or dwelling unit limitation otherwise applicable. For the purposes of definition, all tracts of land 35 acres or greater in size, created after January 1, 1973 will count as parcels of land created by exemption since January 1, 1973. B. All Garfield County zoning requirements will be met. C. All lots created will have legal access to a public right-of-way and any necessary access easements have been obtained or are in the process of being obtained. D. Provision has been made for an adequate source of water in terms of the legal and physical Quality. Quantity and dependability, and a suitable type of sewage disposal to serve each proposed lot. Proof of a legal supply shall be an approved substitute water supply plan contract; augmentation plan; an approved well permit; legally adjudicated domestic water source or a contract for a permanent legal supply of domestic water to be hauled from an outside site for a cistern. Proof of the physical supply from a well for the public meeting, may be documentation from the Division of Water Resources that demonstrates that there are wells within a % mile of the site producing at least five (5) gallons/minute. Prior to the signing of a plat, all physical water supplies using a well shall demonstrate the following: 1) That a four (4) hour pump test be performed on the well to be used. 2) A well completion report demonstrating the depth of the well, the characteristics of the aquifer and the static water level; 3) The results of the four (4) hour pump test indicating the pumping rate in gallons per minute and information showing draw down and recharge; 3 4) A written opinion of the person conducting the well test that this well should be adequate to supply water to the number of proposed Tots; 5) An assumption of an average or no less than 3.5 people per dwelling unit, using 100 gallons of water per person, per day; 6) if the well is to be shared, a legal, well sharing agreement which discusses all easements and costs associated with the operation and maintenance of the system and who will be responsible for paying these costs and how assessments will be made for these costs. 7) The water quality is tested by an approved testing laboratory and meet State guidelines concerning bacteria and nitrates. For water supplies based on the use of cistern, the tank shall be a minimum of 1000 gallons. E. Method of sewage disposal, and a letter of approval of the fire protection plan from the appropriate fire district. F. All State and local environmental health and safety requirements have been met or are in the process of being met. G. Provision has been made for any required road or storm drainage improvements. H. Fire protection has been approved by the appropriate fire district. 1. Any necessary drainage, irrigation or utility easements have been obtained or are in the process of being obtained. J. All applicable taxes and special assessments have been paid. III. PROCEDURAL REQUIREMENTS (The following steps outline how the Exemption from the Definition of Subdivision application review process works in Garfield County.) 1. Submit 2 copies of this completed application form (pages 1-6) including all submittal requirements and the base fee to the Garfield County Planning Department. It will be received and given to a Staff Planner who will review the application for technical completeness within 15 working days. The Planning Department may request an extension of time from the Board of County Commissioners for such review not to exceed an additional fifteen (15) working days. 2. Once the application is deemed technically complete, the Staff Planner will send you a letter indicating the application is complete in addition to requesting additional copies of the application to be provided to the Board of County Commissioners for their review in preparation for the public hearing. 3. Staff will also send you a "Public Notice Form(s)" indicating the time and date of your hearing before the Board of County Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum regarding your requested Exemption application. (If 4 Staff determines you application to be deficient, a letter will be sent to you indicating that additional information is needed to deem your application complete.) 4. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the petition for an Exemption for the public hearing. If proper notice has not occurred, the public hearing will not occur. Notice requirements are as follows: a. Notice by publication, including the name of the applicant, description of the subject lot, a description of the proposed Exemption from the Definition of Subdivision and nature of the hearing, and the date, time and place for the hearing shall be given once in a newspaper of general circulation in that portion of the County in which the subject property is located at least thirty (30) but not more than sixty (60) days prior to the date of such hearing, and proof of publication shall be presented at hearing by the applicant. b. Notice by mail, containing information as described under paragraph (1) above, shall be mailed to all owners of record as shown in the County Assessor's Office of Tots within two hundred feet (200') of the subject lot and to all owners of mineral interest in the subject property at least thirty (30) but not more than sixty (60) days prior to such hearing time by certified return receipt mail, and receipts shall be presented at the hearing by the applicant. c. The site shall be posted such that the notice is clearly and conspicuously visible from a public right-of-way, with notice signs provided by the Planning Department. The posting must take place at least thirty (30) but not more than sixty (60) days prior to the hearing date and is the sole responsibility of the applicant to post the notice, and ensure that it remains posted until and during the date of the hearing. 6. The Applicant is required to appear before the Board of County Commissioners at the time and date of the public hearing at which time the Board will consider the request for Exemption for the subject property. In addition, the Applicant shall provide proof at the hearing that proper notice was provided. 6. At or within fifteen (15) days of the meeting, the Board shall approve, conditionally approve or deny the exemption request. The reasons for denial, or any conditions of approval, shall be set forth in the minutes of the meeting or in a written Resolution. An applicant denied exemption may follow the subdivision procedure in these Regulations. 7. Once the Board makes a decision regarding the request for an Exemption, Staff will provide the Applicant with a letter affirming the action taken by the Board with a list of conditions, if any, to be completed by the applicant. 8. A plat of an approved or conditionally approved exemption shall be presented to the Board for signature within 120 days of approval. The plat shall include a legal description of the exempted property, and Exemption Certificate, the County Surveyor's Certificate and a statement, if four (4) Tots, parcels, or interest have been created on the parcel, that "NOTE: No further divisions by exemption from definition will be allowed." The plat shall be recorded with the County Clerk and Recorder no later than thirty (30) days after the Chairman's signature. The Chairman of the Board of County Commissioners shall not sign 5 a plat of a conditionally approved exemption until all conditions of approval have been complied with. 9. The Applicant shall be required to submit a paper copy of the plat and proof that all the conditions of approval have been met to the Building and Planning Department at least twenty-one (21) days prior to the expiration of the 120 -day deadline required for signing the plat by the Board. This is to ensure timely Staff review of the materials submitted as well as proper scheduling the plat to be signed by the board. 10. Once all of the conditions, if any, have been satisfied, an Exemption Plat shall be presented to the Board for signature within 120 days of approval. The plat shall include a legal description of the exempted property, and Exemption Certificate, the County Surveyor's Certificate and a statement, if four (4) lots, parcels, or interest have been created on the parcel, that "NOTE: No further divisions by exemption from definition will be allowed." These soils are on steep mountainsides. This unit is used almost entirely for wildlife habitat and limited grazing. It is well suited to wildlife habitat and is important winter feeding areas for deer and elk. Grouse, mountain lion, rabbits, and coyotes also use these areas. This unit is poorly suited to community development be- cause of depth to rock, steep slopes, and Rock outcrop. 5. Potts-Ildefonso-Vale Deep, well drained, gently sloping to steep soils on mesas, alluvial fans, terraces, and benches This map unit is in the central and south-central parts of the survey area. The soils formed in loess caps over gravelly material on mesas and in a mixture of basalt and sandstone outwash. Average annual precipitation is about 14 inches, and average annual temperature is about 47 degrees F. This map unit covers about 18 percent of the survey area, or approximately 100,000 acres. This unit is about 40 percent Potts soils, 20 percent Ildefonso soils, 15 percent Vale soils, 10 percent Olney soils, and 15 per- cent soils of minor extent. Potts and Vale soils are on mesas and gently sloping fans. They are deep and well drained. The surface layer is loam or silt loam, the subsoil is clay loam or silty clay loam, and the substratum is loam and silt loam. Ildefonso soils are on moderately sloping to steep fans. They are deep and well drained. The surface layer is stony loam, and the substratum is very stony loam, Olney soils are on gently sloping fans. Minor in this unit are Heldt and Pena soils, Torriorth- ents, Camborthids, and Rock outcrop. About 60 percent of this unit is used for dryfarmed and irrigated crops. Most irrigated crops are hay and pasture. A very small acreage is dryfarmed. The rest of the unit is used for grazing and nonirrigated pasture. Wildlife such as deer, elk, rabbits, grouse, and doves find food and cover on this unit. Deer and elk use this unit as a prime winter feeding area. A few pheasant and chukar live near areas where cereal crops are grown. 6. Morval-Villa Grove Deep, well drained, moderately sloping to moderately steep soils on mesas, mountainsides, and alluvial fans This map unit is in the south-central and extreme east- ern parts of the survey area. The soils formed in alluvium and outwash derived from mixed basalt and sandstone from mountainous areas. Average annual precipitation is about 16 inches, and average annual temperature is about 44 degrees F. This map unit covers about 8 percent of the survey area, or approximately 50,000 acres. The unit is about 15 percent Morval soils, 15 percent Villa Grove soils, 10 percent Tridell soils, 10 percent Zoltay soils, and 50 percent soils of minor extent. Morval soils are on moderately sloping mesas and sides of valleys. They are deep and well drained. The surface layer is loam, the subsoil is clay loam, and the substratum is stony loam. Villa Grove soils are on mountainsides and fans. They are deep and well drained. The surface layer is loam, the subsoil is clay loam, and the substratum is loam. Tridell soils are on strongly sloping to moderately steep mesa sides and fans. They are deep and well drained. The surface layer is stony loam, and the sub- stratum is very stony loam. Average annual precipitation ranges from 12 to 15 inches, and average annual temperature is about 48 degrees F. This map unit covers about 6 percent of the survey area, or approximately 35,000 acres. The unit is about 30 percent. Lazear soils, 30 percent Cushman soils, 15 percent Ascalon soils, and 25 percent soils of minor extent. Lazear soils are on moderately sloping to very steep mountainsides and mesa breaks. They are shallow and well drained. The surface layer is gravelly loam, and the substratum is cobbly loam. Effective rooting depth is 40 to 60 inches. Surface runoff is slow, and the erosion hazard is slight. This soil is used mainly for wildlife habitat and limited grazing. The native vegetation is mainly brome, needlegrass, and sagebrush. There are small areas of dwarfed aspen, but they are of little or no commercial value. When range condition deteriorates, forbs, shrubs, and Kentucky bluegrass increase. Properly managing grazing maintains and improves range condition. Seeding and removing brush improve range on fess sloping areas if it is in poor condition. Intermediate wheatgrass, slender wheatgrass, and mountain or smooth brome are suitable for seeding. Preparing the seedbed and drilling the seed are good practices. Elk, mule deer, coyote, grouse, and rabbit find habitat on this soil. Use of this soil for community development or as a source of construction material is limited by steep slopes. RIFLE AREA, COLORADO 61 lldefonso series The Ildefonso series consists of deep, well drained soils that formed in basaltic alluvium and eolian material. Ildefonso soils are on valley sides, hilly mesas, and benches. Scopes are 6 to 45 percent. The average annual precipitation is about 14 inches, and the average annual air temperature is about 46 degrees F. lldefonso soils are similar to Trideli and Begay soils. Trideli soils are at higher elevations and have a frigid temperature regime. Begay soils do not have a Cca horizon, have less than 35 percent coarse fragments in the control section, and have a cambic horizon. Typical pedon of lldefonso stony loam, 6 to 25 percent slopes, about 2,490 feet east and 300 feet north of the southwest corner of section 35, T. 7 S., R. 96 W.: A1-0 to 2 inches; brown (10YR 5/3) stony loam, dark brown (7.5YR 3/2) moist; weak very fine to medium granular structure; soft, friable; 20 percent rock frag- ments (10 percent stones, 5 percent cobbles, and 5 percent gravel); calcareous; mildly alkaline; clear smooth boundary. AC -2 to 8 inches; brown (10YR 5/3) stony loam, dark brown (10YR 4/3) moist; moderate medium suban- gular blocky structure; slightly hard, friable; 20 per- cent rock fragments (10 percent stones, 5 percent cobbles, and 5 percent gravel); calcareous; moder- ately alkaline; clear smooth boundary. Cl ca -8 to 15 inches; white (10YR 8/2) very stony loam, light gray (10YR 7/2) moist; moderate coarse subangular blocky structure; slightly hard, friable; 35 percent rock fragments (20 percent stones, 10 per- cent cobbles, and 5 percent gravel); visible second- ary calcium carbonate as disseminated lime, lime nodules, and crusts on bottom of stones; calcare- ous; moderately alkaline; gradual smooth boundary. C2ca-15 to 60 inches; white (10YR 8/2) very stony loam, light gray (10YR 7/2) moist; massive; slightly hard, friable; 50 percent rock fragments (30 percent stones, 10 percent cobbles, and 10 percent gravel); calcium carbonate accumulations as disseminated lime, lime nodules, and crusts on bottom of rock fragments; calcareous; moderately alkaline. Cobbles and gravel cover 10 to 20 percent of the surface, and stones cover 5 to 10 percent. The A horizon has hue of 10YR or 7.5YR, value of 5 or 6 dry and 3 or 4 moist, and chroma of 2 or 3. The A horizon contains 15 to 30 percent rock fragments, of which more than one-half, by volume, is stones. The C horizon has hue of 10YR or 7.5YR, value of 7 or 8 dry and 6 or 7 moist, and chroma of 1 to 3 dry and 1 to 4 moist. The C horizon contains 35 to 60 percent rock fragments. The content of stones increases with depth. Small lime nodules are common in the Cca horizon. tnchau series The Inchau series consists of moderately deep, well drained soils that formed in residuum from shale and sandstone. Inchau soils are on moderately sloping to very steep ridges and mountainsides. Slopes are 25 to 40 percent. The average annual precipitation is 18 inches, and the average annual air temperature is about 40 degrees F. Inchau soils are similar to Jerry and Dateman soils. Jerry soils contain more than 35 percent clay in the control section. Dateman soils have a mollic epipedon more than 17 inches thick and contain more than 35 percent stones in the control section. Typical pedon of Inchau loam, 25 to 40 percent slopes, located along the Battlement Creek access road, about 1,000 feet south and 200 feet west of the north- east corner of section 26, T. 7 S., R. 95 W.: 01-1 inch to 0; leaves, twigs, and decomposed grasses. A1--0 to 3 inches; grayish brown (10YR 5/2) loam, very dark brown (10YR 2/2) moist; weak thin platy struc- ture parting to moderate fine granular; soft, very friable, neutral; clear smooth boundary. B1-3 to 11 inches; dark grayish brown (10YR 4/2) Hnht day loam, very dark brown (10YR 2/2) moist; j- erate fine and medium subangular blocky structure; slightly hard, friable, slightly sticky and slightly plas- tic; few thin patchy clay films on peds; neutral; clear smooth boundary. B2t-11 to 18 inches; yellowish brown (10YR 5/4) clay loam, dark yellowish brown (10YR 4/4) moist; mod- erate medium subangular blocky structure; hard, fri- able, sticky and plastic; thin, nearly continuous clay films; 10 percent shale fragments; neutral; clear wavy boundary. B3-18 to 36 inches; yellowish brown (10YR 5/4) gravel- ly clay loam, dark yellowish brown (10YR 4/4) moist; weak medium subangular blocky structure; hard, fri- able, sticky and plastic; few thin patchy clay films; 20 percent small shale fragments; neutral; clear wavy boundary. Cr -36 inches; weathered sandstone and shale. The mollic epipedon generally ranges from 8 to 14 inches in thickness. Depth to paralithic contact ranges from 21 to 38 inches. These soils are generally leachec throughout. The A horizon has hue of 2.5Y to 7.5YR, value of 4 of 5 dry and 2 or 3 moist, and chroma of 2 or 3. The 132 horizon has hue of 7.5YR or 10YR, value of 5 or " drS and 4 or 5 moist, and chroma of 2 to 5. RIFLE AREA, COLORADO 67 C1-12 to 30 inches; very pale brown (10YR 7/3) very stony sandy loam, brown (10YR 5/3) moist; weak fine subangular blocky structure; slightly hard, very friable; 45 percent large stones; calcareous; moder- ately alkaline; gradual wavy boundary. C2ca-30 to 60 inches; very pale brown (10YR 8/3) very stony sandy loam, pale brown (10YR 6/3) moist; massive; slightly hard, friable; 45 percent large stones; visible secondary calcium carbonate as fine seams and soft concretions; calcareous; moderately alkaline. Depth to the Cca horizon is 15 to 30 inches. Content of rock fragments ranges from 35 to 55 percent. The mollic epipedon ranges from 8 to 16 inches in thickness. The A horizon has hue of 10YR or 7.5YR, value of 3 or 4 dry and 2 or 3 moist, and chroma of 2 or 3. The AC horizon has hue of 10YR or 7.5YR, value of 4 or 5 dry and 3 or 4 moist, and chroma of 2 to 4. The C horizon has hue of 10YR or 7.5YR and has more than 15 per- cent calcium carbonate equivalent. Potts series The Potts series consists of deep, well drained soils that formed in alluvium derived from sandstone, shale, or basalt. Potts soils are on moderately sloping mesas, benches, and valley sides. Slopes are 1 to 12 percent. The average annual precipitation is about 14 inches, and the average annual air temperature is about 45 degrees F. Potts soils are similar to Olney soils. Olney soils have more than 35 percent fine and coarser sand in the con- trol section. Typical pedon of Potts loam, 3 to 6 percent slopes, 1,300 feet north and 1,300 feet west of the southwest corner of section 3, T. 7 S., R. 92 W.: A1-0 to 4 inches; brown (7.5YR 5/4) loam, dark brown (7.5YR 3/2) moist; weak medium platy structure parting to moderate fine granular; slightly hard, fri- able; mildly alkaline; clear smooth boundary. B1-4 to 11 inches; reddish brown (5YR 5/4) heavy loam, dark reddish brown (5YR 3/4) moist; weak medium prismatic structure parting to moderate fine subangular blocky; hard, firm, slightly sticky and non- plastic; mildly alkaline; clear smooth boundary. B2t-11 to 20 inches; reddish brown (5YR 5/4) light clay loam, reddish brown (5YR 4/3) moist; moderate medium subangular blocky structure parting to mod- erate fine subangular blocky; very hard, firm, slightly sticky and slightly plastic; calcareous; moderately al- kaline; gradual smooth boundary. Cca-28 to 60 inches; pinkish white (5YR 8/2) loam, light reddish brown (5YR 6/4) moist; massive; hard, firm; visible disseminated calcium carbonate; calcar- eous; strongly alkaline. Depth to calcareous material ranges from 9 to 18 inches. In many places, the lower part of the C horizon has 10 to 15 percent gravel and cobbles. These frag- ments increase in quantity with depth. The A horizon has hue of 7.5YR or 5YR, value of 5 or 6 dry and 3 or 4 moist, and chroma of 2 to 4. The B horizon has hue of 5YR or 2.5YR, value of 5 or 6 dry and 4 or 5 moist, and chroma of 3 to 5. Rhone series The Rhone series consists of deep, well drained soils that formed in residuum from sandstone and marlstone. Rhone soils are on mountainsides and ridges. Slopes are 5 to 70 percent. The average annual precipitation is about 20 inches, and the average annual air temperature is about 40 degrees F. Rhone soils are similar to Silas, Northwater, and Para- chute soils. Silas soils contain 0 to 15 percent rock fragments throughout. Parachute soils have lithic contact at a depth of 20 to 40 inches. Northwater soils have an argillic horizon. The existing Marl and Patricia Martin residence will be on the eastern 20 acres and eventually a new single family residence will be constructed on the western 20 acres. The parcels are located within the service boundaries of the Grand Valley Fire Protection District which provides fire suppression and emergency services within its service boundaries; 2. The address of the property is 700 County Road 303, approximately 3 miles southwest of Parachute, Colorado. The proposed subdivision will consist of two (2) parcels of approximately 20 acres each. Physical Supply The existing Martin Well #2 is intended to provide the water supply for the two proposed parcels. Well Permit #119549 was issued in 1981 by the Colorado Division of Water Resources for the Martin Well #2, copy attached. The well was originally completed on August 24, 1981. The total depth is 280' with an original static water level of 85', as shown on the attached well completion report. Colorado River Engineering Inc. performed a 4 -hour drawdown test and subsequent recovery monitoring on January 31, 2006. The purpose of the test was to examine the yield and to ascertain the groundwater resources available at the property. The well was tested using the existing pump with a measured flow rate of 6-gpm to 7-gpm during the test. The initial pumping rate of 15- gpm was reduced to approximately 7-gpm during the first 5- minutes of pumping. The well production gradually declined to 6-gpm after 2-1/2 hours and remained at 6-gpm for the remainder of the test. The data for the drawdown and recovery portions of the test is shown on the attached Table 1. The initial static water level was measured at 67'-0" below the top of the well casing. At the end of the pumping test, the water level in the well was 111'-8", indicating a drawdown of 44'-8" below the initial water level. Based on the well completion report, approximately 168' of water remained in the well at the end of the 4 -hour pump test (280' total depth — 111'-8" drawdown level). The graph showing the drawdown and recovery water levels is attached as Figure 2. The drawdown test showed the sustained yield of the well to be less than 6-gpm. During the 4 -hour test, the well produced in excess of 1440 -gallons, (240 -min x 6-gpm). Recovery data was obtained to examine the underlying aquifer characteristics. After approximately 1-1/2 hours following the end of pumping, the water level had recovered to within 2'-11" of the original static water level. Two additional water level measurements were recorded at approximately 3-1/4 hours and 17-3/4 hours following the end of pumping. The final measurement indicated that the water level had recovered to the original static water level within 18 -hours following the end of pumping. The graph showing the residual recovery water level and time of test/time of recovery is attached as Figure 3. The well recovery is indicative of a recharging aquifer with no "mining" of water occurring. Water Quality The proposed shared well is not subject to public water system requirements regulated by the Colorado Department of Public Health and Environment (CDPHE). The public system regulations apply only for systems serving 25 or more people. Typically, Garfield County, during the subdivision process, requires testing for bacteria and nitrate/nitrite. These parameters represent the most common health concerns in rural areas. Bacteria presence would show that the risk for pathogenic organism contamination may be of concern. Nitrate and nitrate levels can be elevated in waters in agricultural areas and when ingested, limit the ability of blood cells to absorb oxygen is of particular concern for infants and the elderly. Water quality samples were taken from Martin Well #2 and were forwarded to Grand Junction Laboratories for analysis. Results of the water quality test are attached and are shown below along with the sample collection dates: Nitrate (1/31/2006) Nitrate (5/15/2006) Nitrite (1/31/2006) Nitrite (5/15/2006) Total Coliform Bacteria (1/31/2006) Martin Well #2 33.6 mg/1 28.4 mg/1 0.06 mg/1 0.00 mg/1 0 colonies/100m1 Health Dept Limits 10 mg/1 10 mg/1 1 mg/1 1 mg/1 0 colonies/100m1 Although the water quality test results for bacteria and nitrite are below the CDPHE recommended maximum contaminant levels, the results for nitrate exceed these levels. Based on these results, we recommend that the water from this well not be consumed without supplemental water treatment. A reverse osmosis (RO) system, or other approved treatment for nitrate removal, should be installed to treat all water subject to ingestion. The treated water should be tested periodically to verify that the treatment system is functioning. The source of the high nitrates is not known. High nitrate levels are most commonly associated with agricultural influences from either high fertilizer use or animal waste 2 from feedlots. The subject site did not appear to meet these criteria. If the source is from past manmade activities the nitrates levels should decrease through time. Attached is a consumer fact sheet prepared by the US Environmental Protection Agency (EPA). Additional information regarding nitrate contamination is available from the EPA and other sources. The EPA's "safewater" website has published the following health effects information for nitrate and nitrite exposure. "Short-term: Excessive levels of nitrate in drinking water have caused serious illness and sometimes death. The serious illness in infants is due to the conversion of nitrate to nitrite by the body, which can interfere with the oxygen -carrying capacity of the child's blood. This can be an acute condition in which health deteriorates rapidly over a period of days. Symptoms include shortness of breath and blueness of the skin. Long-term: Nitrate and nitrite have the potential to cause the following effects from and lifetime exposure at levels above the MCL: diuresis, increased starchy deposits and hemorrhaging of the spleen." Water Demands The proposed shared well is intended to serve two (2) dwellings, one (1) on each of the two (2) parcels. It is assumed that each dwelling could be occupied by 3.5 people with each person requiring 100-gpd. The expected total average daily demand for the two (2) dwellings combined would be 700-gpd, (7 -people x 100-gpd/person). At the 6-gpm pumping rate used during the well test, the well would be required to operate for approximately 2 -hours per day. The peak instantaneous demand from the homes could exceed the 15-gpm pump limit established in the exempt permit. To satisfy peak demands and provide carry over storage we recommend that each residence have a minimum of 250 -gallons of storage. Fach storage tank would require fill controls and a booster pump. A well sharing agreement should be developed. Summary The existing Martin Well #2 is proposed to provide the water supply for two dwellings. A 4 -hour well pumping test conducted on the Martin Well #2 indicated a physical supply yield in excess of expected demands. The well test indicates that ample groundwater resources are available to supply the two dwellings. Water quality tests show bacteria and nitrite levels are less than Health Department guidelines, however, nitrate levels are excessive, and treatment using reverse osmosis or other approved removal method be utilized prior to consumption (e.g. under sink units). We recommend disclosure of the high nitrate levels be provided to future lot owners. Future testing of the source water and treated water is recommended. It may cause health problems if found in amounts greater than the health standard set by the United States Environmental Protection Agency (EPA). What are Nitrates/Nitrites and how are they used? Nitrates and nitrites are nitrogen -oxygen chemical units which combines with various organic and inorganic compounds. Once taken into the body, nitrates are converted into nitrites. The greatest use of nitrates is as a fertilizer. Why are Nitrates/Nitrites being regulated? In 1974, Congress passed the Safe Drinking Water Act. This law requires EPA to determine safe levels of chemicals in drinking water which do or may cause health problems. These non -enforceable levels, based solely on possible health risks and exposure, are called Maximum Contaminant Level Goals. The MCLG for nitrates has been set at 10 parts per million (ppm), and for nitrites at 1 ppm, because EPA believes this level of protection would not cause any of the potential health problems described below. Based on this MCLG, EPA has set an enforceable standard called a Maximum Contaminant Level (MCL). MCLs are set as close to the MCLGs as possible, considering the ability of public water systems to detect and remove contaminants using suitable treatment technologies. The MCL for nitrates has been set at 10 ppm, and for nitrites at 1 ppm, because EPA believes, given present technology and resources, this is the lowest level to which water systems can reasonably be required to remove this contaminant should it occur in drinking water. These drinking water standards and the regulations for ensuring these standards are met, are called National Primary Drinking Water Regulations. How much Nitrates/Nitrites are produced and released to the environment? Most nitrogenous materials in natural waters tend to be converted to nitrate, so all sources of combined nitrogen, particularly organic nitrogen and ammonia, should be considered as potential nitrate sources. Primary sources of organic nitrates include human sewage and livestock manure, especially from feedlots. The primary inorganic nitrates which may contaminate drinking water are potassium nitrate and ammonium nitrate both of which are widely used as fertilizers. According to the Toxics Release Inventory, releases to water and land totaled over 112 million pounds from 1991 through 1993. The largest releases of inorganic nitrates occurred in Georgia and California. What happens to Nitrates/Nitrites when they are released to the environment? Since they are very soluble and do not bind to soils, nitrates have a high potential to migrate to ground water. Because they do not evaporate, nitrates/nitrites are likely to remain in water until consumed by plants or other organisms. How will Nitrates/Nitrites be detected in and removed from my drinking water? The regulation for nitrates/nitrites became effective in 1992. Between 1993 and 1995, EPA required your water supplier to collect water samples at least once a year and analyze tem to find out if nitrates/nitrites are present above 50 percent of their MCLs. If it is present above this level, the system must continue to monitor this contaminant every 3 months. If contaminant levels are found to be consistently above their MCLs, your water supplier must take steps to reduce the amount of nitrates/nitrites so that they are consistently below that level. The following treatment methods have been approved by EPA for removing nitrates/nitrites: Ion exchange, Reverse Osmosis, Electrodialysis. How will I know if Nitrates/Nitrites are in my drinking water? If the levels of nitrates/nitrites exceed their MCLs, the system must notify the public via newspapers, radio, TV and other means.
