Dear Mr. Hasenberg:
As requested, Hepworth-Pawlak Geotechnical, Inc. has completed the garnma radiation
survey at the subject site. The survey was perfonned in accordance with our professional
services agreement to you dated June 17,2008.
Gamma radiation measurements were taken on an approximate250 foot grid pattern and
at the corners of existing buildings using a Ludlum Model3 survey meter and Ludlum

The area of steep terrain in the northwest portion of the site is not proposed to be
developed and was omitted from the survey. The radiation readings are shown on Figurel. The 62 readings taken at the site ranged from 0.02 to 0.04 millirems per hour. The
gaflrma radiation survey readings taken at the subject site are typical of the background
level in the Rifle area.
Based on the galnma radiation survey of the project site, radiation mitigation is not
needed. However, there is a potential that radon gas could be present in the area. It is
difficult to assess future radon gas concentrations in buildings before the buildings are
constructed. Testing for radon gas levels could be done in the completed buildings. New
buildings are often designed with provisions for ventilation of lower enclosed (crawlspace
or basement) areas should post construction testing show unacceptable radon gas
concentration.

Dear Mr. Richardson:
We have reviewed the above referenced plan to createi a subdivision by merging two
properties of approximately 39 plus acres and subsequently, subdividing the property into
individual lots. The properties are owned by Jody Daniels and Greg Hasenberg. The combined
acreage of the subdivision would be approximately 79.82 acres. This preliminary plan proposes
that t6e subdivision would be subdivided into seven lots. Jody Daniels owns the 39'93 acre
property to the north that is proposed to be lots 4, 5, 6 and 7 Greg Hasenberg owns the 39'89
,.r" piop"rly to the south that is proposed to be lots 1, 2 and 3' The plan proposes the
development of 7 single family dwelling units and 5 accessory dvrelling units. Each lot will contain
one single family OwJtling un'rt. Rn existing residence is located on lot 3. The applicant proposes
to provide water servicJs through wellJ pursuant to a contract with the West Divide Water
Conservancy District. Sewage *ilt Ue through individual septic disposal systems located on each
lot.
According to information provided by the applicant in the Preliminary Plan and associated
materials including the Water Supply Plan by JeHN Enginee,-ing, three wells would be used to
serve the 7g.82 acre property. Lots i , 2 and 3 would be served by one existing well (Pernrit No.
276142) and lots 4, 5, 6, ,na I would be served by two existing wells (Permit Nos. 66062-F and
216160). The size of each lot varies from approximately 10 to l7 acres.
Currenly, well permit no.276142was issuecj for a monitoring well only. Permit no. 66062-
F was issued for ordinary household purposes inside four single family dwellings, fire protection,
the irrigation of not moreihan 20,000 square feet of home, gardens and lawns and the watering of
up to Jignt domestic animals in accordance with its water allotment contract. Permit no. 216160
was issued for ordinary household purposes inside three single family dwellings, fire protection,
the irrigation of not more than one acre of home, gardens anC lawns and the watering of domestic
animais. The applicant proposes to serve several lots by cornmon wells that will require rtew well
permits and augmentation. New well permits (e.g., characterrized as non-exempt wells) wili need
io be acquired irom the State Engineer's office. All wells vrill need to be augmented' Currently,
the applicant proposes to augment the wells via Water District contract. The production rate for
the weils under permit #276142 and 66062-F is less than 15 gallons per mtnute. This information
is insutficient for issuance of new well permits. Additional information was provided in the Water
Supply plan; however, 1re necessary rnformation to evaluate the physical adequacy of the w-ells
was omitted. The water district contract provided in the lVater Supply Plan was illegible' The

review.
lnsufficient information was provided concerning the physical adequacy of the water
supply. As stated in CRS 30-28-133(3)(d), the subdivider is required to submit "Adequate
evidence that a water supply that is sufficient in terms of quality, quantity, and dependability will be
available to ensure an adequate supply of water for the type of subdivision proposed." Adequate
evidence is usually provided in the form of a water resource report, prepared by a professional
engineer or water consultant, which addresses the quality, quantity, and dependability issues. A
report of this nature was not provided. See the attached Guidelines for Subdivision Water
Supplv Plan Reports for the necessary information
Due to the lack of valid well permits and a water court approved augmentation plan, the
State Engineer finds pursuant to CRS 30-28-136(1XhXl), that the proposed water supply will
cause materiai injury to ciecreed waiei' rights airci is inadequaie. ln aijdition, due to a lack of
information, we are unable to comment on the physical adequacy of the water supply. lf you or
