The Board has the authority under Section 4-103 of the Unified Land Use Resolution of 2008 to grant such requests: Section 4-103 (G) (8) (a) (t) Conditional Approval. The Board's decision to approve or conditionally approve the preliminary plan, minor exemption, major exemption or rural lands development exemption shall be effective for a period of up to one year or until the final or exemption plat has received a Determination of Completeness pursuant to Section 4-103(C), Determination of Completeness, whichever occurs first. Prior to expiration of the original approval, the applicant may make a one-time request for an exiension of up to one year, upon a demonstration of why the original conditions of approval cannot be met. The Quicksilver Court Subdivision was conditionally approved by the Board on December 8, 2008 and the applicant has submitted an application for Final Plat. The Preliminary Plan will expire unless the Final Plat application has been deemed Technically Complete by the Director prior to expiration of the Preliminary Plan approval. The Final Plat application is currently under review by County Staff and a determination has not been made on the adequacy of the application. "c r*Ianning cenrices' irrc firr ,$ ruor"rber 18,2009 Garfield County Planning Department Attn:Tom Veljic 108 8th Street Suite 401 Glenwood Springs, Co 81601 Phone: 970-945-82L2 Fax:970-384-3470 tveliic@ga rfield-cou ntv.com Dear Tom: As you are aware, we recently submitted an application for the Quicksilver Court Subdivision Final Plat the end of October. ln order to preserve the approval for the Quicksilver Court Subdivision Preliminary Plan, the Final Plat must be submitted and be considered technically correct prior to the expiration date of December 8, 2009. lt has been suggested by Staff, that we request an extension of the Preliminary Plan approval in the event our Final Plat application is not technically correct by this terminus date. We are very confident that we will be able to accomplish our goal for Final Plat without further issue; however, not all application details are within our control. For instance, we have been delayed in applying for the Final Plat because of our negotiations with Xcel Energy/Public Service in relocating an easement. While at the onset of discussions it appeared that we would be able to resolve this matter in a short timeframe, we estimate that getting a new easement and agreement (recorded) took upwards of seven (7) plus months to achieve. This document was only recently recorded in October, and we filed not soon after. That being said: We herebv request a one-vear extension of the Quicksilver Court Subdivision Preliminarv Plan approval, extending the expiration date of December 8, 2009, to December 8, 2010. As extensions are a "one- time request," we are asking for the maximum time allowed, in case we are faced with a similar experience as presented earlier. The Board of County Commissioners of Garfield County, Colorado, received a request for an extension to file a Final Plat for the Quicksilver Court Subdivision to subdivide a 79.82 acre property into seven (7) single family residential lots and said property is legally described as Lots 2 and 2A, Grass Mesa Ranch Subdivision located in unincorporated Garfield County. B. The subject property is owned by Jody Daniels and Greg Hasenberg and located south of the City of Rifle at 1155 Quicksilver Way. C. The subject property is located within the Rural Zoning District. D. During the regular public rrreeting of the Board of County Commissioners on the 7th day of December, 2009 upon the question of whether a l-year extention to file the Final plat for the Quicksilver Court Subdivision should be approved, approved with conditions or denied, during which meeting the public and interested persons were given the opportunity to express their opinions regarding the request. ) )ss ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on, Monday , the 7h day of December A.D. 2009, there were present: COMMISSIONER CHAIR JOHN F. MARTIN , Aye COMMISSIONER MISE SAMSON , Aye E. The Board on the basis of substantial competent evidence produced at the aforementioned meeting, has made the following determinations of fact: 1. Proper notice was provided as required for the meeting before the Board of County Commissioners. 2. The meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. The application is in compliance with the standards set forth in the Garfield County Unif,red Land Use Resolution of 2008, as amended. 4. The above stated and other reasons, the proposed preliminary plan has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County.
